A RESOLUTION authorizing the removal of one Sweet Gum tree located in
the City right-of-way at 110 North 2nd Street, Yakima,
Washington.
WHEREAS, the one Sweet Gum tree is currently located in the City right-
of-way
ightof-way at 110 North 2nd Street, Yakima, Washington; and
WHEREAS, the property owner of Instant Press, Inc., has requested
authorization to remove said Sweet Gum since the tree in question blocks the
owners signage; and
WHEREAS, the City Arborist has reviewed the situation, and the Sweet
Gum does not meet the City's criteria of being dead, diseased or dying; and
WHEREAS, if permitted to remove said Sweet Gum tree, the property
Owner of Instant Press agrees to plant one replacement tree at their expense at a
location and of a type/species approved in advance by the City's Parks and
Recreation Manager; and
WHEREAS, the City Council deems it to be in the best interest of the City
to grant permission to the property owner of Instant Press to remove, at their
sole expense, the one Sweet Gum tree located in the City right-of-way at 110
North 2nd Street, Yakima, Washington, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The property owner of Instant Press adjacent to the City right-of-way
located at 110 North 2nd Street, Yakima, Washington, is hereby granted
permission to remove, at their sole expense, the one Sweet Gum tree situated at
said location with the condition that they have one replacement tree planted at
their expense at a location and of a type/species approved in advance by the
City's Parks and Recreation Manager.
ADOPTED BY THE CITY COUNCIL THIS 3rd day of September 2002.

Dear Council Members,
I have been a local business owner for more than 20 years in the downtown Yakima area.
Many things have changed in that time. One of those changes is the point of this letter of request.
As I'm sure most other business owners do, I enjoy the trees and plants on the parking strips
and corners of downtown streets. However, I must respectfully request the removal of one of those
trees. It is directly in front of my place of business at 110 N 2nd Street, and now obscures my business
sign. I've received several complaints from new customers that they cannot see my business sign when
they are trying to find our location.
I ask, please, that the City Council act in a timely manner regarding my request for removal of
this tree.

Re: Tree Removal
Ms. Terry Powell of Instant Press has requested the removal of one Sweetgum tree
located in front of their business at 110 North rd Street. Ms. Powell is concerned that
customers can't fmd their business due to the tree blocking their signage. Ms. Powell was
informed that the tree does not meet our criteria of being dead, dying or diseased which
will require council approval. I explained that our tree budget for the year was spent and
that removal and replanting would be at their expense.

SUMMARY EXPLANATION:
Staff respectfully requests Council consideration of the attached resolution
concerning removal of one Liquidambar Sweetgum tree located at 110 North 2nd
Street. Currently, the tree in question does not meet the criteria of dead, dying,
and/or diseased.
The business owner will pay for the cost of removal. Please see attached
memorandum and photographs.

STAFF RECOMMENDATION: Staff respectfully requests City Council approval of the
Resolution authorizing the removal of one Sweetgum tree located at 110 North 2nd
Street at the business owner's expense.
BOARD/COMMISSION RECOMMENDATION:
COUNCIL ACTION: The resolution was adopted as amended to include a requirement
of the purchase of a replacement tree to be planted at a location
determined by the Parks & Recreation Division.
