A RESOLUTION authorizing the City Manager and the City Clerk of Yakima to execute a Quit
Claim Deed vacating an abandoned portion of a public utility easement.
WHEREAS, On July 25, 1950 Sinclair Plat was recorded in Volume "0" of Plats, Page
32, records of Yakima County, Washington; and
WHEREAS, said plat created a public utility easement over and across the east six feet
of said plat; and
WHEREAS, On February 19, 2002 Picatti Brother's Inc. submitted a petition to vacate the
portion of said easement that affects the south five feet of Lot 5 and all of Lots 6 and 7 of
Sinclair Plat, EXCEPT the north 30 feet thereof; and
WHEREAS, On May 9, 2002 the City of Yakima's Hearing Examiner held a public
hearing on said vacation and issued his written findings and decision to vacate said portion of
said easement on May 23, 2002; and
WHEREAS, this easement was not purchased nor improved by the City of Yakima; and
WHEREAS, Picatti Brothers Inc., have requested that the City release its interest in this
unused easement to foster the redevelopment of the holdings of Picatti Brother's Inc. in this
area; and
WHEREAS, the City Council deems it to be in the best interest of the City that the
easement be released now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City
Manager and the City Clerk are hereby authorized and directed to execute a Quit Claim Deed
in favor of Picatti Brothers Inc., a copy of which is attached hereto and by reference made a
part hereof.

value received, conveys and quit claims to Picatti Brothers, Inc., all of its right, title, and interest in the
following described public utility easement, situated in the County of Yakima, State of Washington, to

That certain public utility easement lying over and across the east six feet of the south five feet of Lot 5

SUMMARY EXPLANATION:
Picatti Brothers, Inc. owns two adjacent parcels of land located at the northeast corner
of N 23 Avenue and W. Lincoln Avenue. This property is currently vacant, but was until
several years ago the site of the Skookum Bowl. The westerly of these two parcels is
platted and encumbered by a six-foot public utility easement located along the east
property boundary. Now there is a development proposal pending to build a medical
clinic that will cover both parcels. For this project to proceed, the requested portion of
this platted easement needs to be vacated. Staff review has determined that this
easement can be vacated without affecting service to this property or any of the
surrounding properties.
On May 9, 2002 the hearing examiner held a public hearing to consider this vacation.
During the hearing there were no objections to the release of this easement. On May
23rd the hearing examiner issued his written decision that the portion of the easement
petitioned for vacation be approved. You are now being asked to approve the resolution
that will permit the City Manager and the City Clerk to sign the Quit Claim Deed that will
vacate this easement.

The Examiner conducted a public hearing on May 9, 2002. The
staff report presented by Senior Planner Bruce Benson recommended
approval. Don Picatti attended the hearing. Two adjacent
property owners also attended, with questions concerning the type
of activityand location vf . thc utility easement. Their questions
were answered, and there is no opposition to this proposal. The
Examiner inspected the property prior to the hearing.
SUMMARY OF DECISION. The utility easement is vacated.
From the view of the site, the matters contained in the
official record including the staff report, a review of both the
Yakima Urban Area Comprehensive Plan and the Yakima Urban Area
Zoning Ordinance, and from evidence received at the hearing, the
Examiner makes the following:

numbers 181323-12465 and 12036.

3. Easement Description. The staff report is adopted and
incorporated by reference, containing more detail.
Picatti's own two lots. Dividing the lots is an 8 foot wide
public utility easement running north and south. This is in the
general vicinity where the west wall of the former bowling alley
was located. The bowling alley collapsed in 1998 from a heavy
snow load and has since been removed. The easement is located
along the east line of the westerly parcel.
They intend to redevelop their properties, putting a building
across the utility easement. The building will not require this
easement.
The requested area of vacation runs from 30 feet south of the
north boundary line of parcel number 181323-12465 and runs south
to intersect with the north right of way for Lincoln Avenue.
The only properties affected belong to the Picattis. When
sewer is needed for redevelopment of this property, it will be
provided by a side sewer line connecting with the unextinguished
portion of the easement and the remaining portion of the public
sewer main.
4. Jurisdiction. Statutory criteria for vacation of a
utility easement are set forth in the staff report, and have been
met.
This proceeding can be handled as an administrative matter.
The Examiner delegates to the City Director of Community and
Economic Development the duty to sign the mylar for the final
amended plat, and to see that it is properly recorded.
All criteria for vacating this right of way have been met, as
set forth in both state law and local ordinance.
5. Public Notice. Public notice of the hearing was
provided in accordance with the ordinance.

From the foregoing Findings, the Examiner makes the
following:
CONCLUSIONS
1. The Examiner has jurisdiction.
2. For the reasons stated herein, the vacation of this
utility right of way complies with applicable state and local law.
3. Vacation of the utility right of way, as set forth in
the application, is approved, subject to the following conditions.
1. The remaining portion of the easement must terminate in
accordance with the regulations of YMC Title 12.03.050. "Sewer
i i nes shall be terminated with a flush -end (cleanout) or a
manhole as directed by the City Engineer. Manholes will
generally be used when extension of the sewer line is anticipated
and
manhole spacing will be appropriate for the future."

FINAL PLAT—ALTERATIONS AND VACATIONS (14.20.220).
A. The alteration or vacation of final plats filed for record in
the office of the Yakima County auditor shall comply with the
provisions of Chapter 58.12 Revised Code of Washington.
B. All petitions for plat alterations or vacations shall be
submitted on forms provided by the office of environmental
planning and shall be reviewed by the hearing examiner at an open

record public hearing. Yakima Municipal Code Section 1.43.080(D),
delegates to the hearing examiner final authority on plat
alterations. The final amended plat will be prepared in
accordance with the hearing examiner's decision and submitted to
the hearing examiner or his/her designee (director of community
and economic development) for signature. (Ord.98-65 § 2 (part),
1998) .

street vacation ordinance.
D. Easements established by a dedication are property rights that
cannot be extinguished or altered without the approval of the
easement owner or owners, unless the plat or other document
creating the dedicated easement provides for an alternative

method or methods to extinguish or alter the easement. (Ord. 98-
65 § 2 (part), 1998).
BACKGROUND.
On July 27, 1950 "Sinclair Plat" was filed of record in Yakima
County. This plat dedicated an eight -foot public utility
easement running along the east line of the plat. Currently
there is a public sewer line located within this easement. In the
past the portion of the easement to be vacated served the Skookum
Bowl and other businesses within that same building. In 1998 The
Skookum Bowl collapsed under an unusually heavy snowfall.
The Picatti brothers own two adjoining parcels of land, the
westerly parcel is platted and the other is not. The easement is
located along the east line of the most westerly parcel. For all
intents and purposes this places the easement in the middle of
the vacant property fronting Lincoln Avenue and east of N 23rd
Avenue. Because redevelopment of their properties will in all
likelihood include both lots they are requesting the vacation of
this platted easement. The requested area of vacation runs from
30 feet south of the north boundary line of parcel number 181323-
12465 and runs south to intersect with the north right-of-way for
Lincoln Avenue. The only properties that would be affected by
this vacated easement belong to the petitioners. Whenever sewer
is needed for the redevelopment of this property it will be
provided by a side sewer line that connects with the
unextinguished portion of the easement and remaining portion of
the public sewer main.

Wastewater Collections has camera inspected this section of their
sewer main and found no sewer connections. This portion of the
main is not in use.
With the abandonment of the main, the two existing manholes
should be removed, and any portion of the main remaining within
the vacated easement should be removed or crushed. At the new
end of the existing main, approximately 30 feet south of
Gymnastics Plus, a new manhole should be installed and right of
access provided for wastewater maintenance crews to reach the

manhole. This will require a 25 -foot wide easement, along the
north property line, running east from N 23=° Avenue to and around
the new manhole. All work is subject to the approval of the City
Engineer.
PUBLIC USE OF THE RIGHT-OF-WAY.
Platted as a public utility easement some 52 years ago the sewer
line within the portion of the easement requested for vacation
has not been utilized since the winter of 1998. The only

LOCATION OF UTILITIES.
Based upon comments received from both public and franchised
utilities the only sewer pipes are located within this easement.
CRITERIA FOR VACATION OF RIGHT-OF-WAYS.
Current City policy provides that easement vacations are to be
processed under the same criteria used for street and alley
vacations. They are as follows:
1) The petition must explain the public benefit of the project,
the reasoning of the proposed vacation and the limits of the
vacation.

redevelopment of property that has been vacant since the winter
of 1997/98. The vacation will run from 30 feet south of the
current north lot line to the north right-of-way line for Lincoln
Avenue.

Based on my review of this proposal, f have the following comments:
Wastewater Collections has camera inspected this section of the sewer main and found no
sewer connections. This portion of the main is not in use.
With the abandonment of the main, the two existing manholes should be removed, and any
portion of the main that will be under a budding should be removed„d
eek. At the new end of the existing main, south of Gymnastics Plus, a new manhole
should be installed with right of access for wastewater maintenance to the manhole. This will
require a 25 foot wide easement from 23rd Ave. to and around the new manhole.

2002, on a petition filed with the City Clerk by Pacatti Brothers. Inc. for the partial
vacation of a platted utility easement in the vicinity of 2205 West Lincoln Avenue.
WHEREAS, pursuant to RCW 35.79.010, a petition has been filed with the City Clerk, requesting
the vacation of a street, alleyway or platted easements (or portion thereof) within the City of
Yakima, a true copy of which petition is attached and incorporated into this resolution; and
WHEREAS, such a petition has been signed by the owners of more than two-thirds (2/3) of the
property abutting upon the street or alley (or portion thereof) which is requested to be vacated.
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The above -referenced petition for vacation is hereby referred to the Hearing Examiner for public
hearing pursuant to section 1.43.080 of the City of Yakima Municipal Code. The Hearing
Examiner is directed to make written recommendation to the City Council regarding said petition.
The Hearing Examiner Public Hearing shall be held on May 9. 2002 at 9:00 a.m. in the City
Council Chambers of City Hall, which date and time are not more than sixty (60) days nor less
than twenty (20) days after the passage of this resolution.
