For Meeting of: December 13, 2016 ITEM TITLE: Resolution appointing the City Engineer or Chief Engineer as the authorized signor of documents for the sole purpose of requesting reimbursement for federally funded road construction projects SUBMITTED BY: Brett Sheffield, P.E., Chief Engineer 576-6797 SUMMARY EXPLANATION: The Code of Federal Regulations, 2 CFR 200.415(a), has been revised and now states: "To assure that expenditures are proper and in accordance with the terms and conditions of the Federal award and approved project budgets, the annual and final fiscal reports or vouchers requesting payment under the agreements must include a certification, signed by an official who is authorized to legally bind the non-Federal entity, which reads as follows: "By signing this report, I certify to the best of my knowledge and belief that the report is true, complete, and accurate, and the expenditures, disbursements and cash receipts are for the purposes and objectives set forth in the terms and conditions of the Federal award. I am aware that any false, fictitious, or fraudulent information, or the omission of any material fact, may subject me to criminal, civil or administrative penalties for fraud, false statements, false claims or otherwise." To implement this requirement, the first reimbursement for each project must include the agency's documentation confirming the individual signing the reimbursement request is authorized to legally bind the agency. Since the City Engineer or Chief Engineer for the City of Yakima is responsible to ensure that the City follows the federal regulations for all federal transportation grants received, and is responsible for all spending on these projects, it is recommended that the City Engineer or Chief Engineer be granted the authority to legally bind the City solely for the purpose of requesting Federal Transportation Grant reimbursement. R-2016- A RESOLUTION appointing the City Engineer or Chief Engineer as the authorized signor of documents for the sole purpose of requesting reimbursement for federally funded road construction projects. WHEREAS, the City Engineer for the City of Yakima has the authority to "administer construction contracts and authorize progress payments on public improvement projects" pursuant to Yakima Municipal Code 1.18.052(C); and WHEREAS, the Federal Highway Administration, through the State and local MPO/RTPO, makes federal transportation funding available to the City for road construction projects; and WHEREAS, the Code of Federal Regulations, 2 CFR 200.415(a), has been revised to ensure that final fiscal reports or vouchers requesting payment under the Federal agreements must include a certification, signed by an official who is authorized to legally bind the non- Federal agency, here the City; and WHEREAS, the City Council for the City of Yakima approves all contractual agreements, including Federal grant agreements; and WHEREAS, in order to seek timely reimbursement for proper expenditures related to Federally funded grant projects, the City Council for the City of Yakima, wishes to grant, to the City Engineer or Chief Engineer for the City of Yakima, authority to legally bind the City solely for the purpose of requesting Federal Grant reimbursement for these Federal Highway Administration funded projects; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: For the purposes of requesting reimbursement for Federally funded road construction projects, the City Engineer or Chief Engineer for the City of Yakima shall be delegated authority, pursuant to 2 CFR 200.415(a), to legally bind the City in furtherance of the intent of this resolution and the City Engineer or Chief Engineer for the City of Yakima shall be authorized to sign all grant reimbursement vouchers for grant funded road construction projects on behalf of the City of Yakima.
