ITEM TITLE: Resolution authorizing a Ninth Amendment to 911 Support Services
Agreement with Yakima County

SUMMARY EXPLANATION:
The Ninth Amendment is an extension of the original 2006 agreement where Yakima County
and the City of Yakima agreed that it is in the best interest of both the City and the County to enter
into an interlocal agreement to provide efficient and economical service for countywide 911
service support. The interlocal agreement provides the necessary funding resources to support
personnel, equipment, and training associated with the operations of the Public Safety Answering
Point (PSAP)for the citizens of Yakima County.

RESOLUTION NO. R-2016-
A RESOLUTION authorizing and directing the City Manager of the City of Yakima to
execute a Ninth Amendment to the "911 Support Services Agreement"
with Yakima County for the provision of 911 services that extends the
term of the Agreement to December 31, 2017.
WHEREAS, the City of Yakima has been providing 911 services to the citizens of
Yakima County through the 911 Support Services Agreement (referred to as the "Agreement");
and
WHEREAS, in 2006, the City and County entered into a "911 Support Services
Agreement" between the City of Yakima and the County of Yakima, Washington, City Contract
No. 2006-21 ("Agreement"), whereby the City provides the County and Yakima County 911 with
the necessary support services to efficiently and economically operate the 911 emergency
services communication system within Yakima County; and,
WHEREAS, the Agreement previously was extended by agreement of the parties in the
First Amendment from December 31, 2010 to March 31, 2011; the Agreement was extended in
the Second Amendment to December 31, 2011; the Agreement was extended in the Third
Amendment to December 31, 2012; the Agreement was extended in the Fourth Amendment to
December 31, 2013; the Agreement was extended in the Fifth Amendment to December 31,
2014; the Agreement was modified and extended in the Sixth Amendment to December 31,
2015; and the Agreement was modified and extended in the Seventh Amendment to December
31, 2016; and,
WHEREAS, the current Agreement is set to expire at midnight on December 31, 2016, and the
parties desire to enter into a Ninth Amendment to extend the Agreement for one year to
midnight on December 31, 2017, which amendment is attached hereto and incorporated herein
by this reference; and
WHEREAS, it is within the scope and budget of the City of Yakima to provide such
services; and
WHEREAS, the City Council deems it to be in the best interest of the City and the
citizens of Yakima County to authorize the execution of the Seventh Amendment to the
agreement, now, therefore,
NOW, THEREFORE, in consideration of the mutual covenants, promises, and
agreements set forth herein, it is agreed by and between the City and the County as follows:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to execute the Ninth Amendment to
the "911 Support Services Agreement" with Yakima County for the provision of 911 services that
extends the term of the Agreement from midnight, December 31, 2016 to midnight,
December 31, 2017, all as stated in the Ninth Amendment attached hereto ad incorporated
herein by this reference.

NINTH AMENDMENT TO 911 SUPPORT SERVICES AGREEMENT
BETWEEN THE CITY OF YAKIMA AND THE COUNTY OF YAKIMA, WASHINGTON
THIS NINTH AMENDMENT TO THE 911 SUPPORT SERVICES AGREEMENT is made
and entered into by and between the CITY OF YAKIMA, a Washington municipal corporation
("City") and the COUNTY OF YAKIMA, a Washington State political subdivision ("County") all
pursuant to authority granted to each party pursuant to Chapter 39.34 RCW.
WHEREAS, in 2006, the City and County entered into a "911 Support Services
Agreement" between the City of Yakima and the County of Yakima, Washington, City Contract
No. 2006-21 ("Agreement"), whereby the City provides the County and Yakima County 911 with
the necessary support services to efficiently and economically operate the 911 emergency
services communication system within Yakima County; and,
WHEREAS, the County and City desire to enter into further discussions about the
Agreement; and,
WHEREAS, the Agreement previously was extended by agreement of the parties in the
First Amendment from December 31, 2010 to March 31, 2011; the Agreement was extended in
the Second Amendment to December 31, 2011; the Agreement was extended in the Third
Amendment to December 31, 2012; the Agreement was extended in the Fourth Amendment to
December 31, 2013; and the Agreement was extended in the Fifth Amendment to December
31, 2014; and the Agreement was modified and extended in the Sixth Amendment to December
31, 2015; and the Agreement was modified and extended in the Seventh Amendment to
December 31, 2016; and,
WHEREAS, the County and City desire to extend the term of the Agreement from a
termination date of midnight, December 31, 2016, to a termination date of midnight,
December 31, 2017; and,
WHEREAS, the parties wish to amend Section 4 of the Agreement to limit the amount of
excess County payments retained by the City as a reserve account, restricting the City held
reserve to a reserve equal to not more than one-twelfth (1/12) of the annual budget; any excess
amounts over that reserve value that are received by the City shall be returned to the County to
be deposited into the County 911 Investment Account; and to reimburse the City of Yakima all
reimbursement received from the Washington State Military Department and Emergency
Management Division under the current and future E911 County Coordinator Professional
Development Agreements; and,
NOW, THEREFORE, in consideration of the mutual covenants, promises, and
agreements set forth herein, it is agreed by and between the City and the County as follows:
Section 2 entitled "Term" of the attached and incorporated "911 Support Services Agreement"
between the City of Yakima and Yakima County is amended to read as follows:
2. Term. The term of this Agreement shall commence January 1, 2006, and
shall terminate at midnight, December 31, 20175, unless terminated at an
earlier date by either party in accordance with Section 16 of this Agreement.
4. Consideration. In consideration of the City's providing 911 support services,
the County agrees to provide the City with an annual amount equal to the
annual 911 support services agreed-upon budget for each of the respective
years of this Agreement. Payments shall be made to the City on a monthly
basis. Each monthly payment shall be one-twelfth (1/12) of the City agreed-
upon annual 911 support services budget. The first monthly payment is due
and payable to the City within ten (10) days of the date this Agreement is
executed, with all subsequent monthly payments due and payable to the City
on the tenth (10) day of each month thereafter during the term of this
Agreement.
The County shall remit to the City of Yakima all reimbursement received from
the Washington State Military Department and Emergency Management
Division under the current and future E911 County Coordinator Professional
Development Agreements. The remittance to the City shall be on the next
available warrant issue of the County.
To limit the amount of excess County payments retained by the City as a

that reserve value that are received by the City shall be returned to the
County to be deposited into the County 911 Investment Account.
Except as expressly modified herein, all other terms and conditions of the attached "911
Support Services Agreement," and as amended pursuant to the parties' previous amendments
thereto, shall remain in full force and effect. Pursuant to the requirements of RCW 39.34.040, a
copy of this Ninth Amendment shall be filed with the Yakima County Auditor or, alternatively, be
listed by subject on the public agency's web site.
