For Meeting of: December 13, 2016 ITEM TITLE: Resolution setting the time and place for hearing on January 10, 2017, at 6:30 PM in the City of Yakima Council Chambers to hear from the public on the City of Yakima assuming the rights, powers, functions and obligations of the City of Yakima Transportation Benefit District SUBMITTED BY: Bronson Faul, Senior Assistant City Attorney SUMMARY EXPLANATION: At the November 28, 2016 City Council study session, a motion was passed directing staff to proceed with the necessary actions required to create a Transportation Benefit District (TBD). One element of this includes a public hearing prior to assuming the rights, powers, functions and obligations of the TBD. Provided the Council sets January 10, 2017 as the date for the TBD public hearing, it is appropriate for Council to also schedule the public hearing on assuming the rights, powers, functions, and obligations of the TBD by the City for the same date. If the hearing is conducted on January 10, 2017 and Council chooses not to enact the TBD, then the public hearing on assuming rights, powers, functions, and obligations would not be necessary. R-2016- A RESOLUTION setting the time and place for hearing on January 10, 2017 at 6:30 PM in the City of Yakima Council Chambers to hear from the public on the City of Yakima assuming the rights, powers, functions and obligations of the City of Yakima Transportation Benefit District. WHEREAS, the City of Yakima created a Transportation Benefit District on January 10, 2017 as authorized by RCW 35.21.225 and governed by the provisions of Chapter 36.73 RCW; and WHEREAS, a public hearing must be held prior to the City of Yakima assuming all rights, powers, functions and obligations of such Transportation Benefit District pursuant to RCW 36.74.020, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That assumption of the rights, powers, functions and obligations of the Transportation Benefit District by the City of Yakima shall be presented for hearing and determination by the City Council on Tuesday, January 10, 2017, at the hour of 6:30 p.m. in the Council Chambers of the City of Yakima, at Yakima City Hall, 129 N. 2nd Street, Yakima, Washington, or as soon thereafter as the same so that all persons interested may appear and be heard, and that notice of such hearing be given as approved by law.
