R-98-14 3 A RESOLUTION denying the right-of-way vacation petition of Deborah Potter and neighbors to vacate an undeveloped alleyway bounded by Voelker and Ledwich Avenues and Pierce and King Streets, within the City of Yakima, Washington WHEREAS, Deborah Potter and neighbors petitioned to vacate the undeveloped alleyway bounded by Voelker and Ledwich Avenues and Pierce and King Streets, within the City of Yakima, Washington, filed under Community and Economic Development File No. UAZO R/W #1-98, Petition 1236; and WHEREAS, the Hearing Examiner held a public hearing on the proposed right-of-way vacation request on July 23, 1998; and WHEREAS, after considering the contents of the file and evidence received at the public hearing, the Hearing Examiner issued his Examiner's Recommendation on August 13, 1998, Examiner No. 1U98-8-18, and recommended denial of the requested right-of-way vacation; and WHEREAS, on September 15, 1998, the City Council conducted a public hearing as required by Chapter 35.79 RCW to consider the requested right-of-way vacation and the Hearing Examiner's Recommendation, and after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds that the requested right-of-way vacation is not in the public interest, now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Petition 1236 submitted by Deborah Potter and neighbors, filed under Department of Community and Economic Development File No. UAZO R/W VAC # 1-98, to vacate an undeveloped alleyway bounded by Voelker and Ledwich Avenues and Pierce and King Streets is denied. / ADOPTED BY THE CITY COUNCIL this 6 day of October, 1998. The application was reviewed at a public hearing held by the Hearing Examiner on July 23, 1998. On August 13, 1998 the Hearing Examiner rendered his recommendation for denial of the right-of-way vacation request.
