R-98-1 31 • A RESOLUTION authorizing the City Manager and the Finance Director to execute and record a Quit Claim Deed in favor of the City regarding certain property located at McGuinness Park, Yakima, Washington. WHEREAS, pursuant to judicial lien foreclosure proceedings in 1957-58 (Yakima County Superior Court Cause Number 41844), the City of Yakima Treasurer was ordered to execute a certificate of purchase and deed in favor of the City regarding certain property located at McGuinness Park (Yakima County Assessor's Tax Parcel Number 181313-33035), and shown as Parcel "B" on . attached and incorporated Exhibit "A"; and WHEREAS, the City Treasurer executed the necessary certificate of purchase and such was recorded January 31, 1958 under Yakima County Auditor's File Number 1705224; and WHEREAS, the City Treasurer did not execute and record the necessary deed in favor of the City; and WHEREAS, in order to receive certain grant funds from the State of Washington for development of McGuinness Park, it is necessary that the City demonstrate clear title to said property; and WHEREAS, in order for the City to evidence clear title to said property, it is necessary that the City Manager and the Finance Director execute a deed in favor of the City and that such deed be recorded with the Yakima County Auditor; and WHEREAS, the City Council of the City of Yakima has determined that it is in the best interest of the City of Yakima to authorize the City Manager and the Finance Director to execute and record -a deed in favor of the City regarding said property, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and Finance Director are hereby authorized and directed to execute and record the attached and incorporated Quit Claim Deed in favor of the City of Yakima concerning certain property located at McGuinness Park, Yakima, Washington. The driveway from the residence of Jeffrey Lima to Willow Street encroaches upon a small portion of McGuiness Park. City staff has worked with Mr. Lima and he is willing to purchase the property from the City which will allow him access to his driveway and residence. The attached resolution authorizes the City Manager to execute a Quit Claim Deed and all other documents necessary to transfer a small parcel of property to Mr. Lima in exchange for consideration of two hundred sixty-one dollars & 45/100 ($261.45). The second resolution authorizes the execution and recordation of a deed to demonstrate that the City has clear title to Parcel "B" at McGuiness Park. This parcel was acquired by the City through a lien foreclosure in 1957-1958. At that time, the City Treasurer did not execute and record the necessary deed in favor of the City. To receive the IAC grant for development of McGuiness Park, it is necessary to execute a Quit Claim Deed in favor of the City to show clear title.
