HomeMy WebLinkAboutR-1998-122 Federal Transit Administration GrantsResolution No. A RESOLUTION authorizing the filing of applications with the Federal Transit Administration, an operating administration of the United States Department of Transportation, for Federal transportation .assistance authorized by 49 U.S.C. chapter 53, title 23 United States Code, and other Federal statutes administered by the Federal Transit Administration. WHEREAS, the Federal Transit Administrator has been delegated authority to award Federal financial assistance for a transportation project; WHEREAS, the grant or cooperative agreement for Federal financial assistance will impose certain obligations upon the City of Yakima, and may require the City of Yakima to provide the local share of the project cost; WHEREAS, the City of Yakima has or will provide all the annual certifications and assurances to the Federal Transit Administration required for the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The City Manager is authorized to execute and file annual applications for Federal assistance on behalf of the City of Yakima with the Federal Transit Administration for Federal assistance authorized by 49 U.S.C. chapter 53, title 23 United States Code, or other Federal statutes administered by the Federal Transit Administration. Section 2. The City Manager is authorized to execute and file with its applications the annual certifications and assurances and other documents the Federal Transit Administration requires before awarding a Federal assistance grant or cooperative agreement. The City of Yakima received authority from the Designated Recipient to apply for Urbanized Area Formula Program assistance. Section 3. The City Manager is authorized to execute annual grant and cooperative agreements with the Federal Transit Administration on behalf of the City of Yakima Section 4. The above authorization shall continue from year to year indefinitely unless modified or revoked by the City Council. This Grant Agreement covers the Project described below. After the FTA Authorized Official has signed this Grant Agreement, the Grantee should then execute this Grant Agreement. The Grantee, by executing this Grant Agreement, ratifies and adopts, all statements, representations, warranties, covenants, and materials submitted by it; accepts the Federal Govemment's grant award; and agrees to all terms and conditions of this Grant Agreement. The Grantee under this Grant Agreement is not the Designated Recipient. Therefore, the Designated Recipient, in accordance with 49 U.S.C. § 5307 hereby agrees to permit the Grantee under this Grant Agreement to receive and dispense the Federal assistance funds described in this Grant Agreement. The Designated Recipient further agrees that the Grant Recipient shall assume all responsibilities set forth in this Grant Agreement. The Federal Government and the Grantee under this Grant Agreement hereby agree that the Designated Recipient is not in any manner subject to or responsible for the terms and conditions of this Grant Agreement and is a party to this Grant Agreement only to assign the right to receive and dispense Federal funds to the Grant Recipient as described above. Staff assured the Regional Office for our next application requesting funding assistance we would submit an up-to-date City resolution for their files. Attached is an updated resolution authorizing the City Manager to apply for annual FTA assistance and execute grants or cooperative agreements. The Staff requests a standing resolution authorizing the City Manager to submit future FTA annual applications and execute grants which do not require further Council Business Agenda action. This is exactly the same procedure that has been routinely used over the last 10 years in securing transit funding. It remains Staffs opinion the City Council holds sufficient hearings and pre authorizes each transit grant submittal during its Transit Budget review sessions. There is also a requirement that a public notice be placed in the local paper 15 days prior to submitting a final FTA funding application thus giving ample opportunity for citizens to request a public hearing on any transit funding application if they so desire. D-5498 A RESOLUTION authorizing the filing of applications with the Depart- ment of Transportation, United States of America, for grants under the Urban !fess Transportation Act of 1964, as amended. WHEREAS, the Secretary of Transportation is authorized to make grants for mess transportation projects; and WHEREAS, the contract for financial assistance will impose certain obligations upon the City of Yakima including the provision by it of the local share of project costs; and WHEREAS, it is required by the United States Department of Trans- portation in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance under the Urban Mass Transportation Act of 1964, as amended, the City of Yakima give assurance that it will comply with Title VI of the Civil Rights Act of 1964 and the United States Department of Trans- portation requirements thereunder; and WHEREAS, it is the goal of the City of Yakima that minority bus- iness enterprise will be utilized to the fullest extent possible in connection with this project and that definitive procedure shall be established and administered to assure that minority businesses shall have maximum feasible opportunity to compete for contracts in procuring construction contracts, supplies, equipment, contract or consultant and nther services, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The City Manager is authorized to execute and file applications on behalf of the City of Yakima, Yakima County, Washington, with the United States Department of Transportation to aid in the fin- ancing of planning, capital and operating assistance projects pursuant to Section 9 of the Urban Mass Transportation Act of 1964, as amended.
