A RESOLUTION authorizing the purchase of "Picture Link Photo Imaging System",
including all necessary options and professional services, from Dynamic
Imaging Systems, Inc. of Marlton, New Jersey for a purchase price not to
exceed $49,000.00, including sales tax, as a sole source purchase without
calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima
Municipal Code Chapter 1.80 generally require that purchase of equipment, materials, or
services in excess of $25,000 be done by competitive bid, subject to certain exceptions; and
WHEREAS, the law recognizes a "sole source purchase" exception from these
competitive bidding requirements when, due to the uniqueness of the product to be purchased
and the fact that there is only one source, it would be futile to utilize competitive bidding for
such product; and
WHEREAS, the Police Department requires the purchase of a photo imaging system to
develop a computer photo image data base for the Police Department's record management
system and to integrate with Yakima County's computer photo image data base; and
WHEREAS, an extensive search and investigation conducted by personnel from the
Information Systems Division and the Police Department reveals that the "Picture Link Photo
Imaging System" from Dynamic Imaging Systems, Inc. of Marlton, New Jersey is the only
system that will satisfy photo imaging requirements of the Police Department, will easily
integrate with the Police Department's current records management system, and that is fully
compatible with the photo imaging system utilized by Yakima County; and
WHEREAS, Dynamic Imaging Systems, Inc. of Marlton, New Jersey is the only source
for purchase of the "Picture Link Photo Imaging System" and is willing to sell the City said
system for approximately $46, 948.37, including sales tax; and
WHEREAS, the City Council finds it would be futile to call for bids regarding a photo
imaging system since there is only one system that will satisfy photo imaging requirements of
the Police Department, will easily integrate with the Police Department's current records
management system, and that is fully compatible with the photo imaging system utilized by
Yakima County, and there is but one source for said system; and
WHEREAS, the City Council finds that it is in the best interest of the City to authorize
purchase of the "Picture Link Photo Imaging System" from Dynamic Imaging Systems, Inc. of
Marlton, New Jersey, now, therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to purchase the "Picture Link
Photo Imaging System", including all necessary options and professional services, from
Dynamic Imaging Systems, Inc. of Marlton, New Jersey for a purchase price not to exceed
$49,000.00, including sales tax, as a sole source purchase without calling for bids.

ITEM TITLE: Resolution authorizing the City Manager to purchase the Picture Link Photo
Imaging System for the price of approximately $46,948.37 from Dynamic
Imaging Systems, Inc. of Marlton New Jersey as a sole source purchase
without calling for bids.

SUMMARY EXPLANATION:
The City of Yakima Police Department is acquiring a Photo Imaging System to capture,
manage, and display the Department's "mug shot" photography. Funding for this acquisition
is from a federal public safety grant in the Police Capital Budget. We are requesting that the
Yakima City Council approve the attached Resolution authorizing the City Manager to
purchase the Picture Link Photo Imaging System for the price of approximately $46,948.37
from Dynamic Imaging Systems, Inc. of Marlton New Jersey as a sole source purchase without
calling for bids.
The proposed Picture Link system consists of all the hardware, software, and implementation
services necessary for a turn -key photo capture station in the City's jail and display station
licenses in the Detectives' area. Our research over the last couple years has proven that the
Picture Link system fully satisfies the Police Department's photo imaging requirements.
Demonstrations have also shown that Picture Link integrates easily with the Police
Department's Records Management System and utilizes the existing data communications
network and the Department's existing server and client computers.

The justification for this Sole Source request is Picture Link's compatibility with Yakima
County's photo imaging system. Yakima County has been using the Picture Link system for
several years. The City Police Department is working with the County Sheriff's department
to develop a county-wide photo data base using two other Dynamic Imaging products
known as Picture Link Submitter and Server DBA. These products only work with the
Picture Link system. Implementation of the county-wide photo database will provide a
great benefit to all the county's law enforcement agencies.
Dynamic Imaging only sells their products directly or through value Added Re-marketers
(VARs) who integrate the imaging system with their police records systems. Since the City's
police records vendor does not re-market Photo Link, the City of Yakima can only purchase
the Picture Link system directly through Dynamic Imaging Systems.
Therefore, because Picture Link satisfies the Yakima Police Department's photo imaging
requirements, integrates easily with the police records management system, utilizes the
existing data communications and computer infrastructure, is compatible with Yakima
County's photo imaging system, will facilitate a county-wide photo image data base, and is
only available to the City directly through Dynamic Imaging, we respectfully request that
the City Council designate Dynamic Imaging as the Sole Source for the Police Departmen+
Photo Imaging System.
