A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to
execute an agreement between the City of Yakima, Yakima Waste
Systems, Inc., and Yakima County to participate in a pilot recycling
program with the City of Yakima.
WHEREAS, Yakima County has received a grant from the Washington State
Department of Ecology to conduct a pilot residential curbside recycling program including the
City of Yakima; and
WHEREAS, Yakima City Council has previously approved the City's participation in
the project and approved by appropriation ordinance the City's $5,000 matching participation
from the Refuse Operating Fund; and
WHEREAS, the City Council of the City of Yakima deems it to be in the best interests
of the City that it enter into an agreement with the parties for the purposes mentioned above;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby duly authorized to execute the attached and
incorporated Agreement for a pilot curbside recycling project between the City of Yakima,
Yakima Waste Systems, Inc., and Yakima County.

AGREEMENT
THIS AGREEMENT is entered into between Yakima County, Washington,
hereinafter the "County", whose address is 128 N. Second St., Yakima, Washington
98901, and City of Yakima, whose address is 129 N. Second St., Yakima, Washington
98901, hereinafter the "City" and Yakima Waste Systems, Inc., whose address is PO Box
2830, Yakima, Washington 98907, hereinafter the "Contractor", and
WITNESSETH:
In consideration of the terms and conditions contained herein and the attached
Scope of Work which are made a part of this Agreement by this reference, the parties
hereto agree as follows:
1. The Contractor and City shall do all work and furnish all materials
necessary for performing the work in accordance with and as described in the attached
Scope of Work.
2. The Contractor and City agrees to pay for the work as set forth in the Scope
of Work at the time and in the manner and upon the conditions provided.
3. This Agreement contains all terms and conditions agreed upon by the
parties. No change or addition to this Agreement shall be valid or binding upon either
party unless such change or addition is in writing and executed by both parties. All terms
of the attached Scope of Work are incorporated herein by this reference.
4. The parties agree that the Contractor and City are independent and not an
agent or employee of the County. Agents, employees, servants, or representatives of the
Contractor and City shall not be deemed to be employees, agents, servants, or
representatives of the County for any purpose. Employees of the Contractor and City are
not entitled to any benefits the County provides for County employees.
5. The Contractor and City shall not assign or subcontract any portion of the
contracted activities without obtaining prior written approval from the County.
6. Either party may terminate this contract upon sixty days written notice sent
by certified mail to the addresses listed above. If the Contractor or City fails to comply
with the terms and conditions of this agreement, the County may pursue such remedies
as are legally available, including, but not limited to, the immediate termination of this
Agreement.
7. The Contractorand City shall indemnify and hold harmless the County, its
officers, agents, and employees, from all liability, loss or damage, including costs of
defense they may suffer as a result of claims, demands, actions, damages, costs or
judgments which result from the activities to be performed by the Contractor and City, its
agents, employees, or subcontractors pursuant to this Agreement.
8. The Contractor and City shall provide to the County proof of insurance in
the amounts required under the Scope of Work.
9. This Agreement shall be governed by the laws of the State of Washington.
Any action, suit, or judicial proceeding for the enforcement of this Agreement shall be
brought in the Superior Court for the State of Washington in Yakima County, Washington.

10. The term of this agreement shall be from April 16, 1998 to December 31,

CURBSIDE RECYCLING PILOT PROGRAM
Scope of Work
The following Scope of Work is for the purpose of an Agreement with City of Yakima and
Yakima Waste Systems, Inc. for a curbside recycling pilot program.
Yakima County, City of Yakima and Yakima Waste Systems, Inc., has agreed to a
cooperative effort to conduct a residential curbside recycling collection pilot program for
the purpose of determining diversion rates and to provide information for future decisions
in long term solid waste planning within the City of Yakima.
GENERAL PROVISION
Two (2) separate areas will be utilized for the curbside recycling collection pilot program
as follows: (see attached maps)
1. S. 24th Ave to S. 32nd Ave between Nob Hill Blvd and Tieton Dr (Area 1)
2. S. 24th Ave to S 32nd Ave between Tieton Dr and SummitviewAve (Area 2)
The curbside recycling program will be provided from July 1, 1998 through September 30,
1998, at no cost to the residents.
The following recyclable materials will be collected every other week:
Newspaper Mixed Waste Paper
Cardboard Magazines
Alumium Cans Plastic Pet #1
Tin/Steel Cans Plastic HDPE#2
Clear Glass
YAKIMA COUNTY RESPONSIBLITIES
• Develop a letter of introduction and factsheet on recycling to all households in
targeted area
• Develop a pre -survey for the purpose of identifying current disposal and recycling
habits
• Develop post -survey for follow-up, evaluation and final report
• Develop follow-up materail to be used during the curbside pilot program
• Provide for the printing and mailing of all materials, including but not limited to
factsheets, pre -survey, follow-up material during the pilot program and the post -
survey
• Designate media contact for Yakima County: Dan Hesse/Ron Pepper/Loretta

• Final Evaluation and Report
• Provide assistance to the Contractor for the collection of recycling bins from residents
not continuing with curbside collection after the conclusion of the pilot curbside
recycling program

CITY OF YAKIMA RESPONSIBITILITES
• Provide route sheets
• Provide mailing labels throughout pilot project
• Establish baseline garbage weights prior to beginning of pilot project (June)
• Re -weigh garbage near end of program (September)
• Participate in the preparation and review of factsheets, pre -survey, post -survey and
follow-up material during the pilot project
• Participate in the evaluation and final report
• Designate a media contact: Nancy Gaudette
YAKIMA WASTE SYSTEMS, INC., RESPONSIBILITIES
• Participate in the preparation and review of fact sheets, pre -survey, post -survey and
follow-up material during the pilot project
• Deliver bins along with factsheet/participationbrochure prior to collection
• Record recycling tonnage for each pilot area
• Record and track participation rates
• Handle customer service questions and complaints
• Participate in the evaluation and final report
• Continue to provide service to those residents who desire curbside recycling after
September 30, 1998 for a fee of $1.90/month or the Washington State Utilities and
Transportation Commission established tariff rate.
• Provide collection of recycling bins for first month from those who do not want to
continue the program
• Designate a media contact: Scott Robertson
LABOR AND EQUIPMENT
Yakima Waste Systems, Inc., shall provide all the services under their Responsibilities at
no cost to the residents.
COMPENSATION
Yakima County shall pay $1.90 per household fee (maximum of 1,100 accounts total) to
Yakima Waste Systems, Inc., that are included in each area as shown in the attached
maps for curbside collection during the months of July, August and September 1998. Any
current curbside recycle account with Yakima Waste Systems, Inc., shall be credited by
Yakima Waste Systems, Inc., $5.70 (1.90 X 3) and the fee for these accounts shall be
paid by Yakima County during the three (3) month pilot period.
The City of Yakima and Yakima County will share the costs of the 25% matching funds
for all cost associated with this pilot project. City of Yakima maximum share will not
exceed $5,000.00. The Department of Ecology Grant will pay 75% of all costs.
MARKETING
Yakima Waste Systems, Inc., shall be responsible for the marketing of all recyclable
materials collected. Under no circumstance should any of the recyclable materials
collected be landfilled, unless some unforeseen market condition should cause a
particular commodity to be impractical to move, or a load is damaged by fire, etc., and
agreed upon in writing. Any revenue derived from the marketing of the recyclable
materials shall remain the property of Yakima Waste Systems, Inc.
LAWS AND REGULATIONS
Yakima Waste Systems, Inc., shall comply with all federal, state, and local laws, rules and
regulations, including the State of Washington Utilities and Transportation Commission
Permit, concerning the collections, transportation and processing of the curbside recycling
project.
INSURANCE
Yakima Waste Systems, Inc., shall maintain an insurance policy as required by the State
of Washington Utilities and Transportation Commission. A copy of the Certificate of
Insurance will be provided to Yakima County and the City of Yakima prior to providing
service to the residents of the curbside recycling pilot program.

6.) Explain what will happen if the project is successful. Describe the
time frame. Describe the magnitude of the hoped for results.
The time frame of this project starts in March 1998 with completion scheduled
by December 31, 1998. The success of this project will assist Yakima County
to determine the future of solid waste management planning. The key issues
will be the participation rate and amount of materials that will be diverted.
The amount of waste diverted per participating households in the first pilot
project which included the unincorporated urban area represented a 33%
reduction, however the participation rate was only 30%. For this project
to be a success the participation rate needs to be 66% or greater to retain
a service at $1.90/month. With a 66% participation rate and 112 pounds
recycled a month per household would provide positive. influence towards
furthering the course of curbside recycling within the incorporated urban
area of the Solid Waste Management Plan.

GOALJPURPOSE/SCOPE OF WORK
GOAL
Provide curbside recycling as a pilot project to 900 City of Yakima residents at no
cost.
PURPOSE
The purpose of the pilot program will be three (3) fold:
To determine the feasibility of curbside recycling within the City of Yakima where
mandatory garbage service is provided vs. in the unincorporated urban area of
Yakima County which has only voluntary garbage service.
Educate and encourage city residents to recycle household waste rather than
disposing of it in their garbage.
Assist the City of Yakima and Yakima County in future solid waste management
planing.
SCOPE OF WORK
The following Scope of Work is for the purpose of an Agreement with Yakima
County, the City of .Yakima and Yakima Waste Systems, Inc. for a curbside
recycling pilot program.
Yakima County, the City of Yakima and Yakima Waste Systems, Inc., have been
in discussion to develop a cooperative effort to conduct a residential curbside
recycling collection pilot program for the purpose of determining diversion rates
and providing information for future long term solid waste planning within the City
of Yakima.

program. The areas for the proposed pilot program are to be determined.
Criteria for the selection of the pilot area shall include but not be limited to:
1. Curbside access
2. Participation in the City's current yard and wood waste
collection program
3. Limited multiple family units
4. More than one garbage can
The curbside recycling program will be scheduled for a three-month period. The
months are yet to be decided as delivery of recycling bins from the vendor may
impact the schedule. The pilot program will be at no cost to the residents.
The following recyclable materials will be collected every other week:

Tin/Steel Cans Plastic HDPE #2

SUMMARY EXPLANATION.
Yakima County has received 75% grant funding through the Department of Ecology to conduct a
residential curbside recycling pilot program within the city limits of Yakima. City Council has
approved the City's participation in the pilot program and a $5,000 Refuse Division appropriation
has been approved for the City's share in the cost for the 25% matching funds. The program,
involving approximately 1,100 residential customers, is scheduled for a three month period during
July, August and September, 1998.
The attached Resolution authorizes the City Manager to sign the Agreement between Yakima
County, the City of Yakima and Yakima Waste Systems, Inc.,
