RESOLUTION NO. R-98 52
A RESOLUTION withdrawing Resolution R-98-33 regarding the proposed
annexation of unincorporated island known as the South
40th Avenue/West Viola Avenue Annexation.
WHEREAS, by Resolution R-98-33, adopted on February 17., 1998, the City
Council resolved, pursuant to the provisions of RCW 35.13.182, to annex the
unincorporated island within the City identified as the South 40th Avenue/
West Viola Avenue Annexation; and
WHEREAS, the 1998 state legislature enacted ESHB 2830 which amends and
supplements RCW 35.13.182 with new provisions which probably would
become applicable to the South 40th Avenue/West Viola Avenue Annexation as
it was proposed under Resolution R-98-33 before it could be completed; and
WHEREAS, the new provisions place additional burdens on the City to
complete the South 40th Avenue/West Viola Avenue Annexation as it was
proposed under Resolution R-98-33, which would require more preparation
than can be accomplished within the newly enacted timeframes; and
WHEREAS, it is in the best interest of the City of Yakima that Resolution
R-98-33 regarding the South 40th Avenue/West Viola Avenue Annexation be
withdrawn so the City may pursue annexation of that unincorporated island
after reconsideration of alternative procedures; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Resolution R-98-33 regarding the South 40th Avenue/West Viola Avenue
Annexation is withdrawn.
ADOPTED BY THE YAKIMA CITY COUNCIL this a! day of April, 1998.

ITEM TITLE: Resolutions withdrawing Resolutions R-98-33 and R-98-34
regarding the proposed annexation of unincorporated areas identified as the
South 40th Avenue/West Viola Avenue Annexation and the Cowiche Canyon
Annexation.

SUMMARY EXPLANATION: The 1998 Washington Legislature enacted ESHB 2830,
which was signed by the Governor on April 2, 1998. Annexations based on RCW
35.13.182 that are not complete before June 10, 1998, will be governed by the new law,
which establishes additional burdens, including a possible referendum election within a
very short timeframe. The City would ordinarily spend substantially more time
preparing for such an election than would be allowed for these annexations under the
new law. In consideration of the nature of the new statutory requirements and
timeframes, and according to previous Council direction, the attached resolutions have
been prepared to withdraw the two pending annexations based on RCW 35.13.182.
