R-98-51 A RESOLUTION declaring an emergency and authorizing the City Clerk and the City Manager to execute all necessary documents with outside parties for the repair and/or replacement of the Southeast Community Center plumbing system without calling for bids and at a cost not to exceed $40,000.00. WHEREAS, Article VI, Section 6 of the Yakima Charter and Chapter 1.80 of the City of Yakima. Municipal Code require that the purchase of supplies, materials and services costing more than $25,000.00 be accomplished by a call for bid; and WHEREAS, said Charter provision, YMC Section 1.80.040 and RCW 35.22.620(6) allow the City Council to declare an emergency in certain situations and thereby dispense with the need to follow a competitive bid process; and WHEREAS, an inspection of the Southeast Community Center ("Center") revealed major leaks in the plumbing system of the structure; and WHEREAS, if the plumbing system of the Center is not repaired and/or replaced immediately, additional significant structural damage to the Center will occur; and WHEREAS, costs of the necessary plumbing system repairs and/or replacement will exceed $25,000.00, but will not exceed 0,000.00; and WHEREAS, the normal bid process for the plumbing repair and/or replacement work would take approximately 90 days, and would prevent the necessary plumbing repairs and/or replacement being completed before additional significant structural damage occurs to the Center; and WHEREAS, it is essential to the health, safety, and welfare of the citizens of Yakima that immediate action be taken to repair and/or replace the Center plumbing system; and WHEREAS, the City Council finds it to be in the best interest of the City to declare an emergency to exist due to the aforementioned conditions and to authorize execution of all necessary documents with outside parties for the repair and/or replacement of the Center plumbing system without calling for bids and at a cost not to exceed $40,000.00; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: An emergency is hereby declared regarding the current status of the Southeast Community Center plumbing system and the City Clerk and City Manager are hereby Page 1 of 2 (1k)res/ emer se comm cntr plumbing/pm authorized and directed to execute all necessary documents with outside parties for the repair and/or replacement of the Southeast Community Center plumbing system without calling for bids and at a cost not to exceed $40,000.00. John Puccinelli, Mayor BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. 8 For Meeting of April 21, 1998 ITEM TITLE: Resolution Requesting Approval of Waiver of Formal Bid Requirements to Repair the Water Leak at the Southeast Community Center SUBMITTED BY: Chris Waarvick, Acting Director of Public Works Denise Nichols, Parks and Recreation Manager CONTACT PERSON/TELEPHONE: Denise Nichols 575-6020 SUMMARY EXPLANATION: City Council is respectfully requested to approve the attached Resolution (1) declaring an emergency based upon substantial water leakage and the urgency involved in scheduling repairs; (2) waiving the formal bid process for seeking a contractor to make the necessary repairs; and (3) allowing the City Manager to execute an agreement with interested, responsible contractors to complete the needed repairs. In February, 1998, Staff discovered water leakage at the facility and began testing to determine the exact location. The plumbing at the Center is located under the concrete flooring making testing more difficult; therefore, specialists in water leak detection were brought in. After numerous tests and attempts to make repairs, the contractor was unable to precisely identify the exact water leak location or to even narrow the leakage to one location. Test areas showed large amounts of water under the floor indicating the possibility of many leaks. At that point Staff determined that the facility would need to be totally replumbed. The cost to install new plumbing at the Southeast Community Center will not exceed $40,000. This project expense will be funded from the General Contingency Fund.
