A RESOLUTION authorizing execution of an agreement with Yakima County through
it's Public Works Department to install a 12 inch water main from
"R" St. and N. 4th St. to "P" St. and N. 4th St. by change order to
their contract with Superior Asphalt for improvements to "R" St. and
for this City of Yakima to reimburse Yakima County for the
installation.
WHEREAS, the City of Yakima has need for this water main extension; and
WHEREAS, the City has completed the engineering and design of this water
main extension through a contract with Huibregtse, Louman Associates, Inc.; and
WHEREAS, the City does not possess adequate in-house staff, nor the time to
perform the necessary work involved in this installation; and
WHEREAS, the City has budgeted for this water main extension in it's
Water/Irrigation Division CIP budget; and
WHEREAS, the City of Yakima has complied with the provisions of RCW 39.80
which concerns the procurement of engineering and architectural services by a city; and
WHEREAS, the City Council deems it to be in the best interest of the City to
authorize Yakima County to install a water main through a change order to it's contract
with Superior Asphalt for "Rn St. Improvements, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager, City Clerk, and the Assistant City Manager are hereby
authorized and directed to execute the attached and incorporated "Agreement" .

AGREEMENT FOR DOMESTIC WATER IMPROVEMENTS
AND FUNDING
THIS AGREEMENT is entered into between the City of Yakima, (hereinafter the
"City") whose address is 129 North 2nd Street, Yakima, Washington 98901, and Yakima
County Washington, (hereinafter the "County") through its Public Works Department,
whose address is 128 North 2nd Street, Room 408 County Courthouse, Yakima,
Washington 98901.
1. RECITALS
1.1
The County intends to construct a road improvement project known as the
C 2742 "R" Street Improvement Project: Yakima Corporate Limits to N. 6th
Street, (hereinafter "the Road Project").
1.2 The City wants to have domestic water and water service lines (hereinafter
the Water Project") constructed at certain locations within and adjacent to
the limits of the Road Project. The location of the Water Project is shown
on Exhibit "A".
1.3 The County and City agree that having the Water Project constructed in
combination with the Road Project is mutually beneficial.
1.4 The City has determined that it is in its best interest to provide funding for
the Water Project and to allow Yakima County to do the construction.
1.5 The Yakima County Engineer has determined that it is in the best interests
of the County that the Yakima County Public Works Department contract
for the construction of the Water Project within the same construction
contract as the Road Project.
NOW, THEREFORE IT IS HEREBY AGREED:
2. THE CITY SHALL:
2.1 Provide the design, details, specifications, and estimate for the Water
Project to the County.

2.2 Review the proposed change order pricing provided by the County and
provide written notice of approval or disapproval of the Water Project
pricing to the County before the execution of a construction contract
change order.
2.3 Review and approve all Source of Materials submittals regarding the Water
Project.

2.4 Provide all on-site field inspection and construction control surveying for
the construction of the Water Project. The field inspection will be
consistent with Sections 7-08, 7-17, and 7-18 of the Washington State
Department of Transportation's 1996 Standard Specifications for Road,
Bridge, and Municipal Construction.
2.5 Prepare a monthly estimate of quantities used on the Water Project using
the bid item schedule for the construction contract change order items.
The progress estimate will be provided to the County no later than the 5th
day of each month. The progress estimate will include all work completed
through the last day of the previous month.
2.6 Upon review and approval by the City of the amounts charged, provide
monthly progress payments to the County for work performed on the Water
Project by the contractor. Progress payments will be made to the County
no later than the 20th day of each month. The progress payment shall be
based on the progress estimate provided for in item 2.5 of this agreement.
2.7 Upon review and approval by the City of the amounts charged, provide a
final payment to the County for all costs reasonably incurred by the County
that are directly related to the Water Project. These costs shall include
actual water construction costs made to the contractor and County
personnel labor costs for time reasonably spent on the Water Project work.
Final payment shall be made to the County no later than 30 days after the
City receives a reporting of final costs from the County.
3. YAKIMA COUNTY SHALL:

3.1 Incorporate the City's Water Project design, details, and specifications into
the County's Road Project. The Water Project construction items and
change order items shall be listed under a separate construction contract
change order.
3.2 Provide a copy of the proposed change order pricing to the City Water and
Irrigation Division for their review and approval before the execution of a
construction contract change order for this work.
3.3 Provide copies of all Source of Materials submittals for the Water Project
to the City Water and Irrigation Division for their review and approval
before use of the materials on the project.
3.4 Make progress payments to the contractor.
3.5 Provide a report of final costs for the Water Project to the City following
completion of the construction contract. The report shall include a
breakdown of costs incurred by the County.

All work hereinafter described shall be referenced to the contract drawing sheet(s) applicable to the item(s)
of work to be performed. You are ordered to perform the following described work upon receipt of an
approved copy of this change order:
Add new 12" ductile iron water main, fittings, valves, fire hydrants, water services, and
restoration of surfacing along North Fourth Street from "P" Street to "R" Street, Station
18+73 to Station 24+ 82.
This additional work is shown on sheets 5 of 7 and 6 of 7 of plans entitled City of Yakima -
North 4th Street Water Main, Plan and Profile, dated January 1998.
There will be no change in the number of working days as a result of this change order. There will be no
working days charged for this work.

ITEM TITLE: Consideration of a Resolution Authorizing execution of an agreement with Yakima

SUMMARY EXPLANATION:
Yakima County has a contract with Superior Asphalt for Improvements to "R" St. from 04 St. to 6th St. including installing
a water main extension. This agreement authorizes Yakima County to execute a change order with Superior Asphalt to
'nstall a water main from "R" St. and N. 4th St. to "P" St. and N. 4th St. The Water/Irrigation Division included this water
gain extension in it's CIP budget for 1998. Huibregtse, Louman Associates completed the engineering and design of the
extension in 1997. The cost of this water main extension, per the attached change order is $62,066.91 (CIP budget
amount was $500,000). This program will greatly expedite the City's efforts to bring adequate water supplies to the
northeast corner of the City.
