A RESOLUTION Authorizing and directing the City Manager and the City
Clerk to execute a power line utility easement in favor
of PACIFICORP, a corporation, dba Pacific Power & Light
Company.
WHEREAS, the Yakima River Greenway Foundation is moving its offices to
a building newly located at Sarge Hubbard Park where electrical power
utility service is not currently available; and
WHEREAS, the new Yakima River Greenway Foundation office building
requires electrical power; and
WHEREAS, electrical power utility service cannot be extended to the new
Yakima River Greenway Foundation office building unless a power line
easement is conveyed to PACIFICORP, a corporation, dba Pacific Power &
Light Company, the electrical power utility franchise holder; and
WHEREAS, the City of Yakima owns Sarge Hubbard Park including the
land over which a power line easement is needed to provide electrical
power service to the new Yakima River Greenway Foundation office
building; and
WHEREAS, the Yakima City Council recognizes the community service
provided to the citizens of Yakima by the Yakima River Greenway
Foundation, and further appreciates the benefits, both to the Foundation
and the City of Yakima, resulting from the establishment of this new office
at Sarge Hubbard Park, and considers it to be in the best interests of the
City of Yakim that a power line easement be conveyed to the electrical
power utility franchise holder, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and the City Clerk are hereby authorized and directed to
execute a deed conveying to PACIFICORP, a corporation, dba Pacific Power
& Light Company, an easement for electrical utility power line over and
across City owned property at Sarge Hubbard Park.

For value received, the City of Yakima, a municipal corporation of the State
of Washington, hereinafter referred to as "Grantor", does hereby grant to
PACIFICORP, a corporation, dba Pacific Power & Light Company, its successors and
assigns, hereinafter referred to as "Grantee", an easement and right of way for an
underground electric transmission and distribution line of one or more wires and
all necessary or desirable appurtenances (including telephone and telegraph wires,
and the right to place all of any part of such line underground) at or near the
location and along the general course now located and staked out by the Grantee
over, across and upon the following described real property in Yakima County,
State of Washington, to wit:
That part of Yakima County Assessor's Parcel No. 191320-13001 in the
Northeast Quarter (NE1/4) of Section 20, Township 13 North, Range
19 East, Willamette Meridian consisting of a strip of land ten feet wide
by approximately 125 feet long as depicted but not drawn to scale in
the drawing attached to this instrument as 'Exhibit "A"'.
The location and course of said easement and right-of-way are
approximately as shown on the sketch attached as Exhibit "A" which
by this reference is made a part of this instrument.
Together with the right of ingress and egress over the adjacent lands of the
Grantor for the purpose of constructing, reconstructing, installing new wires on,
maintaining and removing such line and appurtenances, and exercising other
rights hereby granted.
Grantors reserve the right to use said easement and right-of-way for roads,
agricultural crops or other purposes not inconsistent with the easement and right-
of-way granted hereby, but in using or operating any irrigation pipes, motorized
vehicles or other equipment, or in any other such use of said easement and right-
of-way, Grantor (including its successors or assigns) shall conform strictly to the
provisions of any then -applicable safety code or regulations pertaining to required
clearances from the wires or conductors of such line.
GRANTEE shall enjoy all rights necessary to construct, operate and maintain an
underground electric transmission and distribution line of one or more wires and
all necessary or desirable appurtenances including without limitation the right to
enter into and upon said lands for the purpose of installing, making connections
with, inspecting, repairing, and maintaining said an underground electric
transmission and distribution line of one or more wires and all necessary or
desirable appurtenances, and causing no damage, in entry or entries, which can
reasonably be avoided.

SUMMARY EXPLANATION:
Bringing electrical power to the new Yakima River Greenway Foundation office at
Sarge Hubbard Park requires the installation of an underground power transmission
line. Such power lines need to be located within a recorded power line utility
easement. The land being crossed belongs to the City of Yakima, therefore, Council
authorization is required to permit the City Manager to execute the necessary
easement document.
