A RESOLUTION authorizing and directing the City Manager and the City
Clerk to execute a Memorandum of Understanding with the
Yakima Police Management Association.
WHEREAS, the police lieutenants have formed a labor organization
under the name 'Yakima Police Management Association" ("YPMA"); and
WHEREAS, since the spring of 1996, City representatives have been
meeting and negotiating with the YPMA regarding compensation and working
conditions; and
WHEREAS, the attached Memorandum of Understanding represents the
results of said negotiations; and
WHEREAS, the City Council deems it to be in the best interest of the City
of Yakima to execute the attached Memorandum of Understanding with the
YPMA, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to execute the attached and incorporated
Memorandum of Understanding with the Yakima Police Management
Association.

Memorandum of Understanding
This Memorandum of Understanding acknowledges and confirms the
agreement between the City of Yakima (hereinafter the "City"), and the
Yakima Police Management Association (comprised of the Yakima Police
Department Lieutenants) (Mike Vowell, Jeff Schneider, Mel Light, and
Roy Wilson) (hereinafter the "Lieutenants") regarding compensation and
specific working conditions for the Lieutenants.
NOW, THEREFORE, it is agreed by and between the City and the
Lieutenants as follows:
1. Management Group. The Lieutenants shall be considered part of
the "Management Group" and shall receive the same general fringe
benefit package as all other City management employees.
2. Management Pay and Compensation Adjustment. The
compensation of the Lieutenants shall be covered under and adjusted in
accordance with the management pay and compensation adjustment
provisions set forth in YMC §§ 2.20.115 and .116.
3. Overtime. The Lieutenants shall be eligible for and shall be
permitted to earn overtime in accordance with YMC § 2.40.100.
Fractions of an hour served on overtime duty shall be rounded to the
next quarter hour for the purpose of computing the amount of overtime.
The parties agree that the use of overtime shall be prudently exercised
and shall be subject to Police Department policies and procedures.
4. Court Time. The Lieutenants shall be eligible for and shall accrue
court time at the same rate as the members of the Yakima Police
Patrolmen's Association. Compensation for court time may be in pay or
time off; provided, however, that the maximum amount of accrued
compensatory time off shall be forty (40) hours for any individual
Lieutenant.
5. Compensatory Time Off. Compensation for overtime or court time
may be in the form of compensatory time off in lieu of payment; provided,
however, that the maximum amount of accrued compensatory time off
shall be forty (40) hours for any individual Lieutenant. The parties agree
that the use of compensatory time off shall be prudently exercised and
shall be subject to Police Department policies and procedures.
5. Educational Incentive Pay. Lieutenants shall be eligible for
"Education Incentive Pay" which shall be paid at the rate of seventy-five
cents ($.75) per month per quarter hour of college or university credit
earned while an employee of the Yakima Police Department; provided,
however, that a Lieutenant must earn a grade of "B" or better in a course
before he/she shall be eligible for payment for that course.

6. Dependent Medical Coverage. Effective June 1, 1997, the
Lieutenants shall pay fifty percent (50%) of the dependent unit cost for
medical coverage for dependents through a monthly payroll deduction.
YMC § 2.04.030 shall be amended to reflect this undo tanding.
7. Immediate Adjustment of Compensation. Effective Jae 1, 1997,
the monthly pay schedule for the Lieutenants shall be increased by One
Hundred Dollars ($100) per month. YMC § 2.20.110(E) shall be amended
to reflect this understanding.
8. Review of Compression Adjustment Recommendation. The City
shall review the Management Compensation Study Committee
recommendation for the Lieutenants regarding the incorporation of a One
Hundred Dollars ($100) per month compression adjustment prior to
finalizing the study.
9. Decertification of Bargaining Unit. Upon execution of this
Memorandum of Understanding, the Lieutenants shall take all necessary
steps with P.E.R.C. to decertify their bargaining unit and/or disclaim
interest in exercising their rights to bargain about wages, hours, and
working conditions. Such necessary steps include, but are not limited
to, executing and filing decertification documents and/or disclaimer of
interest documents with P.E.R.C. within thirty (30) calendar days of the
execution of this Memorandum.
10. Term of Memorandum. This Memorandum of Understanding shall
be effective immediately and shall terminate on January 1, 1998;
provided, however, that the Lieutenants may extend this Memorandum
through calendar year 1998 by providing the City written "notice of intent
to extend term" thirty (30) calendar days prior to January 1, 1998. The
extended Memorandum term, if exercised, shall be on the same terms
and conditions as provided herein.

SUMMARY EXPLANATION:
ATTACHMENT 1 -The attached Resolution authorizes a two year collective bargaining agreement with
AFSCME, Local 1122. This contract represents the result of several months of negotiations between the
varties. The settlement package is outlined below:
Major 1997-1998 AFSCME Labor Settlement Provisions
Duration: 1/1/97 - 12/31/98
Wages: Effective 1/1/97 - 3.0% across the board
Effective 1/1/98 - 90% of the average of the U.S. Cities CPI "W" and Seattle CPI "W"
for the period of July 1996 - July 1997, subject to a 2.5% minimum and a 3.5% maximum.
Life
Insurance: Increase coverage from $15,000 to $20,000 upon execution of the collective bargaining
agreement.
Effective 1/1/98 - Increase coverage from $20,000 to $25,000.
According to the City's calculations, this settlement cost is estimated at $347,455 for 1997 and $445,275 for
1998.

ATTACHMENT 2 - The attached Resolution authorizes the execution of a Memorandum Of
Understanding between the City and Police Lieutenants. This Memorandum of Understanding
is the result of the Police Lieutenants and Police Captains filing a Question Concerning
Representation with the Public Employment Relations Commission on April 19, 1996.
Subsequently, a hearing was held on this matter by PERC and the Captains were determined to be
Confidential employees and therefore not part of Yakima Police Management Association (Poliice
Lieutenants). Since that time, City representatives (Don Blesio, John Hanson, and Sheryl Smith)
have been meeting with the Yakima Police Management Association and the attached
Memorandum Of Understanding represents the results of those negotiations. Those matters
covered by the Memorandum Of Understanding generally preserve benefits lost when
promoting to a Lieutenant position. Additionally, the Yakima Police Management Association
agreed to accept the City's proposal on dependent health premium cost sharing which results in
the Yakima Police Management Association paying $120.93/mo for family coverage. The
Captains and Chief have also agreed to the same dependent premium cost sharing formula.
ATTACHMENT 3 - The attached Ordinance amends the Classification and Compensation
Ordinance by adjusting AFSCME employees salaries by 3.0% effective January 1, 1997. Further,
this Ordinance provides for a $100.00/mo. increase fo:r the Yakima Police Management
Association as a result of the bargaining process and the same for Captain and Chief to offset
salary compression effective May 1, 1997.
ATTACHMENT 4 - The attached Ordinance amends Section 2.04.030 of the City of YA i
Municipal Code relating to city and employee contributions toward the city health care plan.
This Ordinance requires the Police Chief, Captains and Lieutenants to contribute towards
dependent health care coverage by sharing the dependent unit cost equally on a 50% - 50% basis.
