R-97- 133 A RESOLUTION ratifying the approval by the City Manager of a permit for a fireworks display on October 17, 1997 and waiver of the application fee of $50.00 for Eagle Fireworks, Inc., the Davis High School Booster Club, Davis PTSA, and Davis High School ASB pursuant to Yakima Municipal Code Section 10.15.040. WHEREAS, pursuant to Section 10.15.040 of the City of Yakima Municipal Code, Eagle Fireworks, Inc., on behalf of the Davis High School Booster Club, Davis PTSA, and Davis High School ASB, applied for a permit for a public display of fireworks at Davis High School scheduled on October 17, 1997 and requested a waiver of the $50.00 permit application fee; and WHEREAS, the application was filed on October 13, 1997, for an event to be held prior to the next City Council meeting; and WHEREAS, due to the time limitations, the City Manager granted the permit application and fee waiver subject to ratification by the City Council; and WHEREAS, the City Council deems it to be in the best interests of the City of Yakima to ratify the action of the City Manager granting the permit application and waiving the $50.00 application fee of Eagle Fireworks, Inc., the Davis High School Booster Club, Davis PTSA, and Davis High School ASB, pursuant to Yakima Municipal Code Section 10.15.040, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The actions of the City Manager granting a permit for a fireworks display on October 17, 1997 and waiving the $50.00 fireworks display permit application fee of Eagle Fireworks, Inc., the Davis High School Booster Club, Davis PTSA, and Davis High School ASB are hereby ratified. In addition, the applicant shall submit a Certificate of Insurance in an amount not Tess than Fifty Thousand Dollars and One Million Dollars for each person and event respectively. And riot less than Twenty -Five Thousand Dollars for property damage liability for each event and the Certificate of Insurance shall also name, as additional insured parties, the City of Yakima, its officers and employees acting in their capacity as agents of the City. YMC 10.15.040 and 10.15.065. Davis High School applied for a special fireworks permit on October 13, 1997, for a fireworks display to be held during half time at the homecoming football game. The event was to be held prior to the next City Council meeting. Based on previous years annual homecoming fireworks events a verbal approval was granted. Plans and specifications, as well as evidence of insurance are on file in the Office of Code Administration.
