RESOLUTION NO. R-97-1 a 3
authorizing a sole source designation and purchase of five replacement mobile
data terminals from Badger Computers.
WHEREAS, the City of Yakima currently requires the purchase of five mobile data terminals for
use by the City of Yakima Police Department; and
WHEREAS, the Police Department may require the purchase of additional mobile data terminals
during calendar years 1997 and 1998; and
WHEREAS, Article VI, Section 6, of the City of Yakima Charter and Chapter 1.80 of the City of
Yakima Municipal Code generally require the use of a public bid process for the purchase of equipment
which exceeds $25,000.00, subject to certain exceptions; and
WHEREAS, the law recognizes a "sole source purchase" exception from these competitive
bidding requirements when, due to the uniqueness of the product to be purchased, it would be futile to
utilize competitive bidding for such product; and
WHEREAS, an extensive search and investigation conducted by City personnel reveals that only
Badger Computers offers mobile data terminals that satisfy specific mandatory criteria required by the
Police Department; and
WHEREAS, it would be futile to call for bids for mobile data terminals for the Police Department
since there is only one source for said terminals that satisfies the mandatory criteria of the Police
Department; and
WHEREAS, the City Council deems it to be in the best interest of the City to purchase mobile
data terminals from Badger Computers consistent with the terms and conditions of the attached proposal;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to purchase five mobile data terminals, and
such additional mobile data terminals as are necessary during 1997 and 1998, for the Police Department
from Badger Computers as a sole source purchase without calling for bids in accordance with the
attached and incorporated proposal from Badger Comuters.

ITEM TITLE: Consideration of a Resolution Authorizing the Sole Source Purchase
of Replacement Mobile Data Terminals

SUMMARY EXPLANATION:
In December 1995, Council authorized the sole source purchase of replacement Mobil
Data Terminal (MDT) units following an extensive research. The research determined
there was only one vendor, Badger Computers, that produced a computer that contained
specific mandatory criteria required for our agency.
Badger Computers, a division of Teklogix Mobil Computer Group, continues to be the only
vendor that meets all of the required specifications, and is least expensive. Therefore,
staff is requesting Council authorize the sole source purchase of replacement Mobile Data
Terminals from this vendor. Staff is further requesting this authorization apply for the
purchase of future replacement units if the sole source conditions outlined above continue
to exist.
The approved 1997 Police Department budget includes necessary funding for the
replacement of five units. Upon Council's authorization, staff will proceed to purchase
these necessary units.
