RESOLUTION NO. R-97- 82
A RESOLUTION fixing time for public hearing before the Hearing
Examiner on July 10, 1997, on a petition filed with the City Clerk by
Shields Bag & Printing Company to vacate the alleyway between
Rock Avenue and Landon Avenue, north of Nob Hill Boulevard.
WHEREAS, pursuant to RCW 35.79.010, a petition has been filed with the
City Clerk, requesting the vacation of a street or alleyway (or portion
thereof) within the City of Yakima, a true copy
attached and incorporated into this resolution; and of which petition is
WHEREAS, such a petition has been signed by the owners of more than
two-thirds (2/3) of the property abutting upon the street or alley (or
portion thereof) which is requested to be vacated, now, therefore,
BE IT RESOLVED BY THE CITY COUNT, OF THE CITY OF YAKIMA:
The above -referenced petition for vacation is hereby referred to the
Hearing Examiner for public hearing pursuant to section 1.43.080 of the
City of Yakima Municipal Code. The Hearing Examiner is directed to make
written recommendation to the City Council regarding said petition. The
Hearing Examiner Public Hearing shall be held on July 10, 1997 at 9:00
a.m. in the City Council Chambers of City Hall, which date and time are not
more than sixty (60) days nor less than twenty (20) days after the passage
of this resolution.
It is further resolved that the City

Clerk give notice of the Hearing
prescribed by RCW 35.79.020 and
Municipal Code.

REGARDING: Wastewater .Connection Charge Study -Transmittal
Memorandum for June 3, 1997 Council Meeting
On May 20, 1997, Agenda Item #20, titled "Consideration of
Resolution Adopting the 1997 Wastewater Connection Charge Study
and Approving of Ordinance Establishing Wastewater Connection
Rates and Charges" was presented to City Council for formal
deliberation. Subsequent to the presentation by staff,
representatives from the local Home Builders Association, the
Yakima Association of Realtors, and Yakima County requested
additional time to review the proposal before City Council formally
acted upon the agenda item. City Council deferred the item until the
June 3, 1997 regular City Council meeting respecting the request of
the Home Builders Association and the Yakima Association of
Realtors for an additional two weeks review and discussion time.
City representatives met with the Home Builders Association, by
their invitation, on May 21, 1997. Councilman John Puccinelli lead
the City presentation. On May 27, 1997, City staff met with the
Realtors Association at the invitation of Ron Anderson. At both
meetings, the City followed the deliberation outline (see attached)
as the presentation guide, then answered questions from the groups
and followed up with additional comments as necessary. We are not
privy to any action or recommendations these two groups may make
to City Council regarding this matter at the June 3rd City Council
meeting.
One common misunderstanding, which surfaced in both discussions,
involved the "sewer surcharge" on bi-monthly service charges for
unincorporated customers: For clarification, the following points
are instructive: (1) There currently, does not exist a "sewer
surcharge" for outside city customers. A multiplier is not applied to
the inside city rate to determine the outside city rate as was the
case some years back. The bi-monthly charge assessed to this
customer class is calculated from a distinct and detailed cost base.

using the "Utility Basis" for non -owner customers and "Cash Basis"
for owner investors (City) -- as found in the adopted 1994 and 1996
Wastewater Cost of Service Studies. (2)
The
e facility "operation and
maintenance (O&M)" charges are covered by the monthly service
charges and are distinct and separate from the costs and revenues
discussed in the Wastewater Connection Charge Study. The
Wastewater Connection Charge revenues are to be used for capacity
expansions in the trunkage and treatment systems required to
accommodate new customers. O&M costs, rehabilitation and new
mandate expenditures are shared by the entire customer base
through their bi-monthly service charges.
During the May 20 Council discussion, Councilman Barnett noted
that, in the Study, annual adjustments to the rates and charges were
proposed to be determined by the Seattle Construction Cost index
(CCI). However, the ordinance before you presents an annual
adjustment of 3%. Since the Study was prepared, legal counsel
advised that adjusting by a flat percentage, adjustable by ordinance
amendment, was the preferred method of dealing with the increased
cost of construction over time. Staff respectfully acknowledges

DELIBERATION OUTLINE
• This study fulfills Council direction from the adopted 1994 and 1996
Wastewater Cost of Service Study, and the GMA Capital Facilities Plan.
• This study's recommendations are consistent with and continue City Council
policy eliminating cost subsidies from City of Yakima rate payers.
• New growth pays for itself with regards to trunkage and treatment capacity_
needs.
• Existing connections do not pay the fees outlined in this study.
• This study recommends a program, if enacted, which protects the monthly user
(0 & M) rates from increases due to new growth.
• Monthly user (0 & M) rates would need to be increased approximately 15% to
raise a commensurate $1,045,000. If the program were to be accelerated, the
monthly user rate increase would be higher.
• This study updates the base costs used in the existing Capital Cost Recovery
Charge (CCRC) program -- a necessary technical correction.

• The average cost of a new 10,000 SF fully improved lot in the west urban area is
$42,500. The proposed Wastewater Connection Charge would be approximately
9% of the value of the above referenced lot cost. The cost of an adequate septic
system may exceed $4,000 -- approximately 9.5% of the cost of the above lot.
• This program does not pay for new treatment mandates nor rehabilitation of
existing facilities.

Requirements
• There are no new revenues to accomodate growth -- funds for capacity needs
must come from somewhere. If grants and low interest loans are competitively
