A RESOLUTION authorizing the removal of three oak trees and one sugar maple
tree located in the City right-of-way at the northeast corner of
Third Street and Yakima Avenue, Yakima, Washington.
WHEREAS, three oak trees and one sugar maple tree are currently located in
the City right-of-way at the northeast corner of Third Street and Yakima Avenue,
Yakima, Washington; and
WHEREAS, the adjacent property owner is in the process of constructing a new
entrance to the Yakima Mall and has reported that these trees are interfering with
said construction; and
WHEREAS, the adjacent property owner has requested authorization to remove
these trees at his expense; and
WHEREAS, if permitted to remove said trees, the adjacent property owner
agrees to plant four replacement trees at his expense in the same general area of a
type/species and at locations approved in advance by the City Parks and Recreation
Division Manager; and
WHEREAS, the City Council deems it to be in the best interest of the City to
grant permission to the adjacent property owner to remove, at his sole expense, the
three oak trees and one sugar maple tree located in the City right-of-way at the
northeast corner of Third Street and Yakima Avenue, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The property owner adjacent to the City right-of-way located at the northeast
corner of Third Street and Yakima Avenue, Yakima, Washington, is hereby granted
permission to remove, at his sole expense, the three oak trees and one sugar maple
tree situated at said location with the condition that he has four replacement trees
planted at his expense in the same general area of a type/species and at locations
approved in advance by the City Parks and Recreation Division Manager.

SUMMARY EXPLANATION:
Joe Morrier has contacted the City to request permission to remove three Oak trees and one
Sugar Maple tree on the northeast comer of 3rd Street and East Yakima Avenue. These trees
were planted in the City right-of-way during the development of the CBD area. This request is
necessary because of the redevelopment of the Yakima Mall.
Removal of the trees would be at the owner's expense. Mr. Morrier has committed to replace
these trees as soon as a landscape architect tells him what variety of trees to plant as
replacements.
