A RESOLUTION fixing time for public hearing before the Hearing
Examiner on February 6, 1997, on a petition filed with the City Clerk
by Providence Yakima Medical Center to vacate South 10th Avenue
between West Walnut and Chestnut Avenues and consideration of a
master zoning review application for the construction of a new
medical office building.
WHEREAS, pursuant to RCW 35.79.010, a petition has been filed with the
City Clerk, requesting the vacation of a street or alleyway (or portion
thereof) within the City of Yakima, a true copy of which petition is
attached and incorporated into this resolution; and
WHEREAS, such a petition has been signed by the owners of more than
two-thirds (2/3) of the property abutting upon the street or alley (or
portion thereof) which is requested to be vacated, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The above -referenced petition for vacation is hereby referred to the
Hearing Examiner for public hearing pursuant to section 1.43.080 of the
City of Yakima Municipal Code. The Hearing Examiner is directed to make
written recommendation to the City Council regarding said petition. The
Hearing Examiner Public Hearing shall be held on February 6, 1997 at 9:00
a.m. in the City Council Chambers of City Hall, which date and time are not
more than sixty (60) days nor less than twenty (20) days after the passage
of this resolution.
It is further resolved that the City Clerk give notice of the Hearing
Examiner public hearing in the form and manner prescribed by RCW
35.79.020 and Section 1.43.080 of the City of Yakima Municipal Code.
ADOPTED BY THE CITY COUNCIL this 7th day of January 1997.

To the City Council of the City of Yakima, Washington.
Comes now the undersigned petitioners and, pursuant to
35.79, now respectfully show:

The undersigned petitioners request that the following described street, alley or
portion thereof, located in the City of Yakima, be vacated pursuant to RCW 35.79.
(provide legal description below, or attach to petition, if lengthy.
That portion of South 10th Avenue between Chestnut Street and Walnut Street in
the City of Yakima, Washington, to -wit:
Beginning at the Northwest corner of Block 372 of Yordy's
Supplemental Addition to Capitol Addition to North Yakima (now
Yakima) as recorded in Volume "B" of Plats, Page 111, records of
Yakima County, Washington; thence westerly along the north line of
said plat extended a distance of 58.5 feet; thence southerly parallel to
the west line of said plat a distance of 400 feet to a point on the south
line of said plat extended; thence east a distance of 58.5 feet to the
southwest corner of said plat; thence northerly along the west line of
said plat to the point of beginning.
Each of the undersigned petitioners is the owner of an interest in real estate
abutting on the above-described area. The undersigned petitioners constitute
owners of more than two-thirds of said abutting property.
Wherefore, petitioners pray that proceedings be had hereon for the vacation
of said area in the manner prescribed by RCW Chapter 35.79.

ITEM TITLE: Resolution setting February 6, 1997 as the date for a Public Hearing by
the Hearing Examiner to consider a petition filed with the City Clerk by Providence of
Yakima Medical Center, to vacate South 10th Avenue between West Chestnut and
Walnut Avenues along with a master zoning review application for a new medical
office building.

SUMMARY EXPLANATION:
Providence of Yakima Medical Center, has filed Petition #1215 with the City Clerk to
vacate South 10th Avenue between West Chestnut and Walnut Avenue. A master
zoning review application has also been submitted for the construction of a 50,175
square foot, three story medical office building with same day surgery space, roof -top
helipad and associated parking. The project is located east of the existing medical
office building in the block bounded by Chestnut and Walnut, and 10th and 11th
Avenues.
The petition for vacation and related zoning review application is referred to the
Hearing Examiner for public hearing pursuant to section 1.43.080 of the City of Yakima
Municipal Code. The Hearing Examiner is directed to make written recommendation
to the City Council regarding said petition. The Hearing Examiner Public Hearing
shall be held on February 6, 1997 at 9:00 a.m. in the City Council Chambers of City
Hall.
