RESOLUTION NO. R-96- 47
A RESOLUTION declaring an emergency and authorizing immediate repair and
rehabilitation of the Fruitvale Power Canal intake project
without calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and Chapter
1.80 of the City of Yakima Municipal Code provide that the City Council may
declare an emergency dispensing with the necessity for bidding for services,
material, equipment and supplies costing more than $25,000 00, and
WHEREAS, RCW 35.22 620(6) similarly provides that the City Council may
adopt a resolution certifying the existence of an emergency situation, thereby
dispensing with the need for competitive bidding procedures, and
WHEREAS, the City of Yakima has incurred substantial damage to its
Fruitvale Power Canal intake during the catastrophic flood of February 1996, thus
requiring extensive and immediate repair/rehabilitation to render that facility
usable for contracted irrigation water delivery purposes, and
WHEREAS, the Governor of the State of Washington has declared Yakima
County a flood disaster area making it eligible for Federal and State financing
assistance for restoration projects and damage repair, and
WHEREAS, the City has engaged professional engineering services to achieve
necessary and timely repair of damaged facilities by providing estimates of
construction costs, coordinating communication between the City and Federal and
State funding agencies, and performing engineering services throughout the
construction and project completion phases, and
WHEREAS, the City Council finds and declares an emergency exists because
of the following factors
• The catastrophic flood of February 1996 caused substantial damage
to the Fruitvale Power Canal intake, necessitating immediate repair,
• The Fruitvale Power Canal, as operated and maintained by the City
has contractual obligations to deliver irrigation water to several
Canal Companies, and
• Until repairs are made to the Fruitvale Power Canal intake, the vital
irrigation water delivery function cannot be accomplished without
serious economic and environmental consequences, and

WHEREAS, the City Council finds it to be in the best interest of the City of
Yakima to declare an emergency to exist under the aforementioned legal authorities
and to authorize immediate repair and rehabilitation of the Fruitvale Power Canal
intake without calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to take all necessary and
prudent actions to immediately repair and rehabilitate the Fruitvale Power Canal
intake at an approximate cost of up to $176,000 00 plus applicable taxes without
calling for bids, and the City Manager is further authorized to execute necessary
construction contracts and state funding agreements.

SUMMARY EXPLANATION
City Council is respectfully requested to approve the attached resolution (1) declaring an
emergency based upon the substantial flood damage caused to the Fruitvale Power Canal Intake
and the time urgency involved in the scheduling of repairs, (2) waiving the formal bid process for
repair of the City's Fruitvale Power Canal Intake, and (3) approving an ordinance amending the
1996 Irrigation Fund Budget to provide for the emergency repair to the Fruitvale Power Canal

STAFF RECOMMENDATION
Approve resolution declaring an emergency for repair of the Fruitvale Power Canal Intake (Project
#1779), waiving the formal bid requirements, and authorizing the City Manager to execute
forthcoming construction project contracts, and authorizing the City Manager to sign and execute
Federal and State funding applications, agreements and amendments Read ordinance only at
the April 16, 1996 Council meeting, pass ordinance after second reading at the May 7, 1996

COUNCIL ACTION
Detailed quotes will be required for the work. This work will consist mainly of heavy riprap
delivery and placement, and some earthwork activities, -- not particularly complex. This request is
driven by the need to have as much of the damaged portion of the canal reconstructed by May 1,
1996, as will be permitted by the present high water The Fruitvale Power Can& was placed int
operation April 8, 1996 This was possible due to work partially completed under an emergenc
work order for reconstruction of what is left of the original intake channel (approximately 375 fe .
Staff believes that immediate reconstruction of the intake channel is critical to the continued
operation of the Fruitvale Power Canal The other authorizations in the attached resolution will
also save vital time in order to facilitate full operation of the canal by the time that the high spring
run-off flows are past.
The recent flooding in the Yakima Valley caused the Governor to declare Yakima County a flood
disaster area thus making it eligible for State and Federal assistance to repair damage done by
the flooding The Fruitvale Power Canal Intake sustained heavy damage to the channel, and
protective dike, which forms a major portion of the intake channel, as well as damages sustained
to that portion of the intake channel that departs from the river channel proper and proceeds to the
control structure at Cowiche Creek, which was completely filled with heavy river gravel and
assorted debris The flooding scoured away almost all of the intake channel that had previously
paralleled the main river channel thus rendering it impossible for us to divert water below the
present high water stage, until rehabilitated With concurrence by Federal and State
governments, the participation cost is currently estimated to be as follows

_IIIIStaff proposes to obtain at least three quotes for each of the remaining segments of work, In lieu
of a formal bid process, to restore the intake channel to it's pre -flood state
To expedite restoration of the intake channel, and have it back into operation by early May, 1996,
staff recommends that the formal bid process be waived This would save the approximately two
(2) months required for prepare of plans and specifications, advertising the project, award and
execute the contract, and start Work. Otherwise, it may become impossible to provide irrigation
water to some areas of the City It is recommended that 3 quotes be solicited The contractor with
the best prices and time frame for immediate availability would be selected to perform the various
work elements necessary to rehabilitate the Fruitvale Power Canal Intake
The City share for this repair work, approximately $43,953.00, must be recouped
in the 1997 Irrigation Assessment. If the estimated cost is unchanged, this will
necessitate that the rate for each of the affected system's be increased by
$0 0008 per square foot, or a percentage increase ranging from 5.9% for the low
to 13.0% for the high in 1997.
Funding appropriated from the 1996 Irrigation Fund Budget for these repairs will be apportioned
to the irrigation systems that receive benefit from the Fruitvale Power Canal The apportioning
be on a percentage basis, percentages are set forth in attached Exhibit "A" It is staffs intent

assistance eligibility, selected contractors, and work progress
