A RESOLUTION authorizing and directing the City Manager and City Clerk of the
City of Yakima to execute an agreement to provide D.A.R.E. services
with the City of Toppenish and Toppenish School District No. 202.
WHEREAS, Toppenish School District No. 202 desires to continue providing Drug
Abuse Resistance Education (hereafter "D.A.R.E.") to its students; and
WHEREAS, the City of Toppenish has no personnel available for this purpose,
but desires to provide qualified personnel through the Police Department of the City
of Yakima, Washington; and
WHEREAS, the City of Yakima has the personnel and expertise necessary to
provide said D.A.R.E. services to the City of Toppenish and Toppenish School District
No. 202; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to enter into an agreement to provide D.A.R.E. services to the City of
Toppenish and Toppenish School District No. 202 in accordance with the terms and
conditions of the attached Agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby authorized and directed to execute
the attached and incorporated D.A.R.E. Program Interlocal Cooperation Agreement
with the City of Toppenish and Toppenish School District No. 202 for the purpose of
providing D.A.R.E. services.

D.A.R.E. PROGRAM
INTERLOCAL COOPERATION AGREEMENT
THIS AGREEMENT is made and entered by and between the CITY OF YAKIMA
(hereafter -"Yakima"), the CITY OF TOPPENISH (hereafter "Toppenish"), and
TOPPENISH SCHOOL DISTRICT NO. 202 (hereafter the "School District").
WHEREAS, the School District desires to continue providing Drug Abuse
Resistance Education (hereafter "D.A.R.E.") to its students; and
WHEREAS, the City of Toppenish has no personnel available for this purpose,
but desires to provide qualified personnel through the Police Department of the City of
Yakima, Washington, according to the proposal attached hereto, marked as Exhibit "A";
and
WHEREAS, the City of Yakima has the personnel and expertise necessary to
provide said D.A.R.E. services to Toppenish and the School District; and
WHEREAS, the School District, Toppenish, and Yakima intend to render the
maximum cooperation possible to accomplish the purposes set forth above and wish to
interchange mutual aid for these purposes.
NOW, THEREFORE, in consideration of the mutual covenants, promises, and
agreements set forth herein, and on the condition that the grant application specified in
Exhibit "A" is funded, it is agreed by and between Yakima, Toppenish, and School
District as follows:
1. Scope of Services. Yakima, through its Police Department, shall provide
qualified, duly commissioned police officers for a maximum of sixteen (16) hours per
week of class time at the School District in such class rooms as shall be designated by the
School District for seventeen (17) weeks commencing in January, 1996. the officers, to be
known as D.A.R.E. officers, shall exercise their best efforts to educate the students they
are assigned to in the recognized methods of resisting drug abuse.
The School District and Toppenish shall provide all training materials required
for students enrolled in the program to be presented by the D.A.R.E. officers.
2. Consideration. Toppenish shall compensate Yakima for providing said D.A.R.E.
officers as above stated by paying the sum of Nine Thousand, Two Hundred Forty-six
Dollars ($9,246.00), except that any additional time requested by the School District and
approved by the Toppenish Police Department will be paid by the School District to
Toppenish and reimbursed to Yakima at the rate of Thirty Dollars ($30.00) per hour and
Ten Dollars ($10.00) per travel day.
3. Term of Agreement. The term of this Agreement shall commence upon
execution hereof and terminate upon completion of the D.A.R.E. program hereunder or
on June 15, 1997, whichever event occurs first.

4. Termination of Agreement. This Agreement may be terminated by any party
hereto, with or without cause, by providing all other parties fifteen (15) days written
notice of termination.
5. No Additional Responsibilities/Liabilities. It is understood that unless adopted
plans or agreements dictate otherwise, all services and/or resources provided under the
terms of this Agreement are furnished and supplied voluntarily and at the discretion of
the furnishing agency. The furnishing agency shall have the primary interest of
protecting the welfare of its own constituency and does not assume any responsibilities
or liabilities in not providing resources and/or services to other parties of this
Agreement.
6. Waiver of Claims. Each party to this Agreement waives all claims against the
other party or parties for compensation for any loss, damage, personal injury, or death
occurring as a result of the performance of this Agreement.
7. Mutual Aid. Mutual Aid extended pursuant and under this Agreement shall be
furnished in accordance with the provisions of Chapter 38.52 RCW, as well as all other
applicable provisions of law.
8. Severability. If any portion of this Agreement is changed per mutual agreement
or any portion is held invalid, the remainder of the Agreement shall remain in full
force and effect.
9. Integration. This written document constitutes the entire agreement between
Yakima, Toppenish and School District. No changes or additions to this Agreement
shall be valid or binding upon either party unless such change or addition be in writing
and executed by both parties.
10. Notices. Unless stated otherwise herein, all notices and demands shall be in
writing and sent to the parties to their addresses as follows:

or to such other addresses as the parties may thereafter designate in writing. Notices
and/or demands shall be sent by registered mail, postage prepaid. Such notices shall be
deemed effective when mailed or hand delivered at the addresses specified above.
11. Governing Law. This Agreement shall be governed by and construed in
accordance with the laws of the State of Washington.
12. Venue. The venue for any action to enforce or interpret this Agreement shall lie
in the Superior Court of Washington for Yakima County, Washington.

17 hour DARE Core Curriculum for Ten (10) 5th Grade Classes at Kirkwood
School. Based on one officer, two days per week.
Estimated Costs:

SUMMARY EXPLANATION:
The attached document renews an agreement by and among the Yakima Police
Department, the City of Toppenish Police Department and the Toppenish School District to
provide Drug Abuse Resistance Education (D.A.R.E.) instruction to Toppenish elementary
school students. This is the third year the police department has provided this service to
the Toppenish School District.
