A RESOLUTION authorizing and directing the City Manager and the City Clerk
of the City of Yakima to acquire property for improvements to
Fair Avenue, from Spruce Street to Pacific Avenue.
WHEREAS , the City Council, by Resolution R-94-98, Authorized the City
Manager and the City Clerk to enter into an agreement with Huibregtse Louman
Associates Inc. for the design of improvements to Fair Avenue; and
WHEREAS, the City of Yakima has budgeted funds for property acquisition
and construction of improvements to Fair Avenue in the 143 Arterial Street Fund
for 1996 and obtained additional funding from Federal, State and County sources;
and
WHEREAS , the City of Yakima has obtained approval for expenditure of
right-of-way acquisition funds from the State of Washington; and
WHEREAS, Huibregtse Louman and Associates are prepared to make
administrative offers on the properties involved according to the true cost
estimate submitted to the State of Washington, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby authorized and directed to take
all necessary and prudent steps to proceed with the purchase of right-of-way for
improvements to Fair Avenue as described in the attached and incorporated
appendix "A" together with right of way to be acquired from Yakima County at
the intersection of Fair Avenue and Pacific Avenue for a sum not to exceed
$100,000.00. Such purchase transactions shall be approved as to form by the
City Attorney.

SUMMARY EXPLANATION:
The project is funded with federal, state, county and city funds. The project is budgeted in the 143, Arterial
Street Fund for 1996. The expenditure of right-of-way funds has been approved by the state and we are ready to
proceed with the purchase of the necessary right-of-way.
The attached "PROJECT FUNDING ESTIMATE" was submitted to the state with the true cost estimate package
for approval. The "Just Comp" column lists the anticipated compensation for each parcel involved in the phase
1 of the project. Administrative offers for up to $5,000 are authorized by the federal procedures.
This approval will authorize the consultant to make administrative offers for the acquisition of the right-of-way
for all but one parcel. The administrative offers will be consistent with the true cost estimate submitted to the
state. The other parcel is anticipated to be in excess of the $5,000 administrative offer maximum.

We have received FHWA fund authorization, effective July 22, 1996, for this
project as follows:

Enclosed for your information and file is a fully executed copy of Supplement
Number 1 to Local Agency Agreement LA -2407 between the state and your
agency.
Federal funds for this project are limited by your regional ISTEA project selection
agency to $404,000. All costs beyond those in the latest executed agreement
are the sole responsibility of your agency.
Upon receipt of your certification of Right of Way, notification that the project is
ready for advertisement and a supplement to the Local Agency Agreement
which includes construction funds, the construction phase of this project will be
considered for funding.
You may proceed with the administration of this project in accordance with your
WSDOT approved Certification Acceptance agreement.
