R-96- 113 A RESOLUTION authorizing and directing the City Manager and the City Clerk of the City of Yakima to execute an agreement with Pavement Engineers, an engineering firm, for the evaluation of certain street section in the City of Yakima WHEREAS, the City of Yakima acknowledges the need to provide necessary evaluation of streets for preliminary design purposes; and WHEREAS, the City of Yakima desires to engage Pavement Engineers, an engineering firm, on an independent contractor basis for the evaluation of certain street sections in the City of Yakima; and WHEREAS, Pavement Engineers, has the experience and expertise necessary to provide said independent contractor services and is willing to provide such services in accordance with the terms and conditions of the attached agreement; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to enter into an agreement with Pavement Engineers, in accordance with the terms and conditions of the attached agreement; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk of the City of Yakima are hereby authorized and directed to execute the attached and incorporated agreement with Pavement Engineers, an engineering firm, for the evaluation of certain street sections in the City of Yakima ADO .) ATTEST: City Clerk «.)_..,,..t ..�..� Buchanan, Mayor PROFESSIONAL SERVICES AGREEMENT THIS AGREEMENT is made and entered into by and between the City of Yakima, a Washington municipal corporation (hereinafter the "City"), and Pavement Engineers, an engineering firm (hereinafter "Engineer"). WHEREAS, the City requires an evaluation of streets for preliminary design purposes. WHEREAS, the Engineer represents that it has the expertise necessary to perform the services required by the City. NOW, THEREFORE, in consideration of the mutual covenants, promises, and agreements set forth herein, it is agreed by and between the City and Engineer as follows: 1. Scope of Services. Engineer shall provide the City with nondestructive testing and pavement design for the following streets in the City of Yakima: Reconstruct Pavement: 1. Yakima Ave. (1st Str. to 6th Str.), 4 lanes, 0.42 mi. 2. Yakima Ave. (1st Str. to 7th Ave.), 4 lanes, 0.63 mi. 3. Yakima Ave. (7th Ave. - 16th Ave.), 4 lanes, 0.60 mi. 4. South 1st Str. (Mead Ave. - Washington), 4-5 lanes, 0.54 mi. 5. South 1st Str. (Washington - South City Limits), 4-5 lanes, 0.61 mi. 6. Washington Ave. (1st Str. - 3rd Ave.), 4 lanes, 1.01 mi. 7. Lincoln Ave. (Pierce Str. - North 1st Str.), 4 lanes, 0.44 mi. 8. West Lincoln Ave. (Pierce Ave. - North 24th Ave.), 4 lanes, 1.00 mi. Widen/Reconstruct 9. River Road (6th Ave. - 16th Ave.), 2 lanes, 0.51 mi. 10. Nob Hill Blvd. (1st Str. - 18th Str.), 4 lanes, 0.87 mi. All the streets to be evaluated have an asphalt concrete surface except for River Road which has a Bituminous Surface Treatment. Most of the streets appear to have a portland cement concrete pavement under the asphalt surface along the inner lanes. Transverse cracks are evident in the asphalt surface and may have been caused by the joints and cracks in the portland cement concrete pavement below. For those streets that have been widened beyond the width of the original pavement, asphalt concrete on a gravel base was used. A longitudinal crack between the two dissimilar pavement sections is evident. Page 1 of 6 (ls)agr/pvmt engnrs pm This analysis has been divided into four tasks as follows: Task 1: Non -Destructive Deflection Testing Engineer shall conduct non-destructive deflection testing using the KUAB Falling Weight Defectometer which can impact the pavement surface with loads from 5,000 to 12,000 pounds depending on the configuration of the equipment. For this project, the equipment will be configured to apply three (3) impact loads of approximately 5,000, 9,000, and 12,000 pounds. These loads are intended to simulate heavy truck and bus loads. Tests will typically be located at 200 foot intervals in all through lanes in order to obtain sufficient test points for analysis. Engineer anticipates the results of the testing along the outer lanes that have been widened with asphalt concrete, will be different than the results along inner lanes that appear to be a composite pavement structure of asphalt concrete over portland cement concrete. The purpose of this testing is to characterize the strength of the pavement layers and the subgrade below. This will provide the basis for developing rehabilitation strategies such as overlays and reconstruction. Engineer anticipates taking up to six hundred eighty-three (683) deflection tests which will take five (5) days. Task 2: Determine Pavement Structure An important ingredient of this analysis is knowing the existing pavement structure. This information may be available from airport records, and to the extent possible, the City shall provide these records. Based on our deflection survey, we will provide a list of locations to core the pavement to identify the material and measure the thickness of the pavement layers. Although Engineer will not know the exact number of cores necessary until the deflection results are reviewed. Engineer anticipates approximately fifty (50) cores will be required. The City of Yakima shall be responsible for this coring and, therefore, no costs have been assigned this task. Task 3: Traffic Information The evaluation and design of an adequate pavement structure depends on the anticipated traffic that will use the street segment. The City shall provide this information to Engineer in the form of Average Daily Truck Traffic, ADTT, broken out by truck type (by axles) and buses. Page 2 of 6 (1s)agr/pvmt engnrs pm Task 4: Analysis and Report The strength of the individual pavement layers and subgrade shall be determined from the deflections and pavement structure information above. This information, along with the traffic data, shall be used to develop a rehabilitation strategy for the street segment. Engineer shall study several rehabilitation strategies including Overlay and Reconstruction (both asphalt and portland cement concrete). If portland cement concrete exists below the asphalt surface, Engineer shall review the feasibility of pulverizing the material and leaving it in place as a crushed base. This analysis and a report will be presented in the form of charts and graphs that will profile the deflections, layer modulus, and overlay thicknesses. 2. Term. The term of this Agreement shall commence upon execution hereof and shall terminate at the time of completion of all services/tasks required hereunder or December 31, 1996, whichever date occurs first. 3. Consideration. The City agrees to compensate Engineer for the services rendered hereunder as follows: Task 1: Task 2: Task 3: Task 4: Nondestructive Deflection Testing, five (5) days at $1,200.00 per day Pavement Cores, provided by the City Traffic Information, provided by the City Analysis and Report Preparation, eighty (80) hours at $110.00 per hour $ 6,000.00 No Charge No Charge $ 8,800.00 TOTAL - ALL TASKS $ 14,800.00 Engineer shall submit an invoice to the City at the conclusion of each task. The total amount of compensation to be paid to Engineer shall not exceed Fifteen Thousand Dollars ($15,000.00). 4. Additional Services and Changes. During the term of this Agreement, the City may require additional services and/or changes to the scope of the services provided by the Engineer under this Agreement. The City shall provide the Engineer with written notice of such additional services and/or changes. If such changes affect the cost, or time required for performance of this Agreement, an appropriate adjustment shall be made if requested by the Engineer at the time such notice is given; otherwise, Engineer shall be deemed Page 3 of 6 (1s)agr/pvmt engnrs.pm to have waived any request for additional compensation or extra time within which to perform this Agreement. 5. Status of Engineer. Engineer and the City understand and expressly agree that Engineer is an independent contractor in the performance of each and every part of this Agreement. Engineer and its employees shall make no claim of City employment nor shall claim against the City any related employment benefits, social security, and/or retirement. 6. Taxes and Assessments. Engineer shall be solely responsible for compensating its employees and for paying all related taxes, deductions, and assessments, including but not limited to, federal income tax, FICA, social security tax, assessments for unemployment and industrial injury, and other deductions from income which may be required by law or assessed against either party as a result of this Agreement. In the event the City is assessed a tax or assessment as a result of this Agreement, Engineer shall pay the same before it becomes due. 7. Nondiscrimination Provision. During the performance of this Agreement, Engineer shall not discriminate on the basis of race, age, color, sex, religion, national origin, creed, marital status, political affiliation, or the presence of any sensory, mental or physical handicap. This provision shall include but not be limited to the following: employment, upgrading, demotion, transfer, recruitment, advertising, layoff or termination, rates of pay or other forms of compensation, and selection for training. 8. Compliance With Law. Engineer agrees to perform those services under and pursuant to this Agreement in full compliance with any and all applicable laws, rules, and regulations adopted or promulgated by any governmental agency or regulatory body, whether federal, state, local, or otherwise. 9. No Insurance. It is understood the City does not maintain liability insurance for Engineer and/or its employees. 10. Indemnification and Hold Harmless. Engineer agrees to protect, defend, indemnify, and hold harmless the City, its elected officials, agents, officers, employees from any and all claims, demands, losses, liens, liabilities, penalties, fines, lawsuits, and other proceedings and all judgments, awards, costs and expenses (including attorneys' fees and disbursements) resulting from Engineer's performance and/or non-performance of this Agreement. 11. Delegation of Professional Services. The services provided for herein shall be performed by Engineer, and no person other than regular associates or employees of Engineer shall be engaged upon such work or services except upon written approval of the City. 12. Assignment. This Agreement, or any interest herein, or claim hereunder, shall not be assigned or transferred in whole or in part by Engineer to any other person or entity without the prior written consent of the City. In Page 4 of 6 (1s)agr/pvmt engnrs pm the event that such prior written consent to an assignment is granted, then the assignee shall assume all duties, obligations, and liabilities of Engineer stated herein. 13. Termination. The City or Engineer may terminate this Agreement, with or without cause, by giving the other party ten (10) days written notice of termination. 14. No Conflict of Interest. Engineer represents that it or its employees do not have any interest and shall not hereafter acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of this Agreement. Engineer further covenants that it will not hire anyone or any entity having such a conflict of interest during the performance of this Agreement. 15. Severability. If any portion of this Agreement is changed per mutual agreement or any portion is held invalid, the remainder of the Agreement shall remain in full force and effect. 16. Integration. This written document constitutes the entire agreement between the City and Engineer. There are no other oral or written Agreements between the parties as to the subjects covered herein. No changes or additions to this Agreement shall be valid or binding upon either party unless such change or addition be in writing and executed by both parties. 17. Notices. Unless stated otherwise herein, all notices and demands shall be in writing and sent to the parties to their addresses as follows: TO CITY: TO ENGINEER: City Engineer City Hall 129 North 2nd Street Yakima, WA 98901 Didrik A. These streets will be constructed with bond funds or other city funds over a much longer time. The specific details of the existing subsurface conditions of the pavement section are critical to the design and accurate cost estimates for the improvements. Pavement Engineers was selected from the 1995 - 1996 consultant roster and have submitted a proposal to evaluate the street segments noted above. This work was considered in the Yakima Avenue Project in the 1996 budget. The cost is estimated to not exceed $15,000.
