A RESOLUTION authorizing, directing, and ratifying the execution of a
Memorandum of Understanding between the City of Yakima
and Council 2, Washington State Council of County and City
Employees, representing Local 1122 of American Federation of
State, County and Municipal Employees, AFL-CIO, and Local
469, International Association of Firefighters, AFL-CIO
regarding the transfer of 911 Calltakers.
WHEREAS, and pursuant to RCW 82.14(B) and YMC Chapter 3.36, Yakima
County (hereafter "County") collects telephone access line excise taxes for the
purpose of funding and providing a 911 emergency service communications system;
and
WHEREAS, various local governmental entities within Yakima County,
Washington, have previously entered into an interlocal agreement with the County
entitled "Yakima County Department of Communications Intergovernmental
Agreement for 911 Answering Services" for provision of 911 emergency
communication services on a county -wide basis to participating members; and
WHEREAS, the County, as required by the provisions of said interlocal
agreement, currently provides 911 emergency communication services through its
911 Calltakers to County residents in various cities, towns, and fire districts within
the County; and
WHEREAS, the City is willing to provide the County with the necessary
support services to efficiently and economically operate said 911 emergency service
communication system ; and
WHEREAS, the SUNCOM Administrative Board desires that the County
contract with the City for said 911 support services; and
WHEREAS, the City and the County passed resolutions authorizing
execution of a 911 support services agreement upon resolution of labor issues with
the 911 Calltakers whereby the City shall provide the County with 911 support
services; and
WHEREAS, on May 1, 1996, the Charter Civil Service Commission approved
a class specification for the new City position of 911 Calltaker and authorized the
lateral transfer of the 911 Calltakers from County employment to City employment;
and

WHERE.AS, on May 7, 1996, the City Council considered and passed an
ordinance formally recognizing the 911 Calltaker position and establishing a
corresponding pay scale; and
WHEREAS, during the last few months, City :representatives and union
representatives of the 911 Calltakers have met on numerous occasions to discuss
various labor issues concerning the transfer of the 911 Calltakers from County
employment to City employment; and
WHEREAS, the 911 Calltakers and their union representatives are willing to
execute the attached Memorandum of Understanding to resolve labor issues
regarding the transfer of their employment from the County to the City; and
WHEREAS, the City Manager and City Clerk have executed the attached
Memorandum of Understanding with the relevant labor unions pending retification
by City Council; and
WHEREAS, the City has transferred the 911 Calltakers from County
employment to City employment as of July 1, 1996; and
WHEREAS, the City Council deems :it to be in the best interest of the City of
Yakima to ratify the execution of the attached Memorandum of Understanding to
resolve labor issues regarding the transfer of the 911 Calltakers from County
employment to City employment, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 'YAKIM.A:
The execution of the attached and incorporated Memorandum of
Understanding between the City of Yaki.:ma and Council 2, Washington State
Council of County and City Employees, representing Local 1122 of American
Federation of State, County and Municipal Employees, AFL-CIO, and Local 469,
International .Association of Firefighters, AFL-CIO regarding the transfer of
911 Calltakers by the City Manager and the City Clerk is hereby authorized,
directed, and ratified.

MEMORANDUM OF UNDERSTANDING
THIS MEMORANDUM OF UNDERSTANDING (hereinafter the
"Memorandum") is made and entered by and between the City of Yakima
(hereinafter the "City"), Council 2, Washington State Council of County and
City Employees, representing Local 1122 of the American Federation of State,
County and Municipal Employees, AFL-CIO (hereinafter "Council 2"),
representing the 911 Calltakers, and Local 469, International Association of
Firefighters, AFL-CIO (hereinafter "Local 469"), also representing the 911
Calltakers.
WHEREAS, in February 1995, and in order to provide efficient emergency
communication services to the public, the Yakima City Council (hereinafter the
"City Council") directed City staff from the Police Department and the Fire
Department to develop a plan to consolidate police dispatch services, fire
dispatch services, and 911 emergency communication services in the new
Police Station/Legal Center.
WHEREAS, the City has agreed to provide Yakima County (hereinafter
the "County") with the necessary support services to economically operate a
911 emergency communication system within the County for the next five (5)
years.
WHEREAS, the County currently employs a number of 911 Calltakers.
WHEREAS, said Calltakers are represented by Local 469 and operate
under a Collective Bargaining Agreement with the County negotiated by
Local 469.
WHEREAS, on May 1, 1996, the City Charter Civil Service Commission
approved a class specification for the new City position of 911 Calltaker under
the City Charter Civil Service System.
WHEREAS, the City and Council 2 have entered into a Collective
Bargaining Agreement (hereinafter the "CBA'l regarding all union represented
City Charter Civil Service positions and effective from January 1, 1994,
through December 31, 1996.
WHEREAS, on May 1, 1996, and to the extent said Calltakers can satisfy
the job requirements and conditions stated in said approved class specification,
the Charter Civil Service Commission authorized the lateral transfer of said
Calltakers from County employment into the newly -created Calltaker positions
under the City Charter Civil Service System.

WHEREAS, to the extent said Calltakers can satisfy the job requirements
and conditions stated in said approved class specification, the City proposes to
formally transfer said Calltakers from County employment to City employment
on Monday, July 1, 1996 in accordance with the terms and conditions of this
Memorandum.
WHEREAS, the City, Local 469, and Council 2 desire to resolve certain
issues concerning the lateral transfer and transition of the 911 Calltakers from
County employment to City employment.
NOW, THEREFORE, in consideration of the mutual covenants and
promises contained herein, the City, Local 469, and Council 2 agree as follows:
1. Pre-employment Tests/Examinations. Consistent with the City's
911 Calltaker class specification, the lateral transfer of each 911 Calltaker from
County employment to City employment is expressly subject to that
911 Calltaker satisfactorily passing a background investigation, polygraph
examination, security clearance, and pre-employment physical examination
(including a drug screening) and psychological examination. The City shall not
hire/transfer any 911 Calltaker who does not pass all of these pre-employment
tests/examinations.
2. Probationary Period. In accordance with the Charter Civil Service Rules
& Regulations, the May 1 Charter Civil Service Commission order, and the City
of Yakima Municipal Code ("YMC"), the transferred 911 Calltakers will be
subject to a six (6) month probationary period. Consistent with YMC Section
2.20.040(2) and Article IV of the CBA, each transferred 911 Calltaker shall,
upon successful completion of the six (6) month probationary period, be
advanced to the next higher pay step over his/her initial hire pay step.
3. Compensation. Compensation for the 911 Calltaker classification shall
be at Pay Range 6.5 ($1,620.64 - 1,939.56 per month) as codified in YMC
Section 2.20.100(4)(F). Each transferred 911 Calltaker shall be compensated
at the pay step closest to and not less than his/her ending rate of pay with the
County.
4. Transfer of Sick Leave and Vacation Leave. Each transferred
911 Calltaker shall be permitted to transfer his/her accrued sick leave and
vacation leave balances to the City subject to the following conditions:
a. Sick leave balances transferred to the City shall be placed in
an "in lieu" account. Each 911 Calltaker shall utilize his/her
transferred sick leave hours before he/she shall utilize sick leave
accrued as a City employee. Sick leave hours transferred from the
County and placed in an "in lieu" account shall not be subject to
any cashout upon termination or retirement under the YMC or any
Collective Bargaining Agreement.

b. Vacation leave balances of up to 176 hours may be
transferred to the City. Vacation accruals after the date of transfer
to City employment shall be subject to the applicable accrual
maximum provided in the YMC or other applicable
regulations/agreements. The City shall cash out vacation leave
balances upon termination or retirement in accordance with the
YMC and/or other applicable regulations/agreements.
c. Each transferred 911 Calltaker shall be permitted to use
vacation leave during his/her probationary period with the City.
5. Paid Holidays. Each transferred 911 Calltaker shall receive eleven (11)
paid holidays, including one (1) personal holiday, in accordance with the YMC
and/or other applicable regulations/agreements.
6. Retirement. Each transferred 911 Calltaker shall be covered, to the
extent possible, under the Washington State Public Employees Retirement
System ("PERS") .
7. Seniority. The seniority of each transferred 911 Calltaker for purposes
of granting leave shall be based upon that person's total time as a
911 Calltaker with the County and the City. Otherwise, seniority of each
transferred 911 Calltaker shall be based upon that person's date of hire with
the City.
8. Longevity Pay. Each transferred 911 Calltaker shall receive longevity
pay in accordance with the YMC and/or other applicable
regulations/agreements. Longevity pay shall be based upon the date each
transferred 911 Calltaker is hired by the City.
9. Self -Insured Health Care Plan. Each transferred 911 Calltaker shall be
covered under and subject to the City's self-insured health care plan. The time
that each 911 Calltaker was covered under the County's health plan shall
count towards satisfying his/her pre-existing conditions provisions under the
City's self-insured health care plan. Additionally, for any 911 Calltaker covered
by the State of Washington LEOFF I pension system, the City shall provide the
primary health care coverage for the employee and the previous LEOFF I
employer shall be considered the secondary coverage for the employee.
10. Applicable Collective Bargaining Agreement. Except as modified or
otherwise provided herein, the current CBA between the City and Council 2
regarding Charter Civil Service positions shall be the applicable collective
bargaining agreement with regard to the 911 Calltakers.

SUMMARY EXPLANATION:
Pursuant to the Yakima County Department of Communications Intergovernmental Agreement for 911 Answering
Services, the attached legislation establishes within the City of Yakima a Public Safety Communications Division
which is jointly directed by the Police Chief and Fire Chief and managed by the new position of Public Safety
Communications Division Manager.
Attachment A is an Ordinance relating to the administrative organization of the Police Department and Fire
Department establishing a Public Safety Comunications Division.
Attachment B is a report regarding the creation of the Public Safety Management Division Manager classification
Attachment C is an Ordinance amending the Classification and Compensation Plan establishing the classification of

The title to the Resolution authorizing the execution of the Memorandum of
Understanding was not on the Agenda on 6/25/96; however, the resolution
was included in the packet item. It was the intent of the Council to
approve the issue, therefore the Memorandum of Understanding was
processed for signatures and a new resolution ratifying those signatures
will be prepared and presented at the 7/2/96 Council Meeting.
ORDINANCE NO. 96- 44
AN ORDINANCE relating to the administrative organization of the police department
and fire department; establishing a public safety communications
division; and amending Sections 1.18.030 and 1.18.040 of the City of
Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 1.18.030 of the City of Yakima Municipal Code is hereby
amended to read as follows:
"1.18.030 Police department.
A. Under the direction of the chief of police, this department
shall:
1. Provide for the protection of persons and property and
prevent crimes;
2. Detect and apprehend offenders and suspected persons;
3. Enforce all ordinances and statutes relating to law
enforcement and traffic control;
4. Preserve peace and order in the city;
5. Perform such other duties as may be required.
B. This department shall consist of three primary divisions,
supervised by police captains and lieutenants responsible to the chief of
police, as follows:
1. The patrol division shall be responsible for uniform field
personnel and operational patrol functions and traffic control.
2. The detective division shall be responsible for the
investigative functions of the police department, bureau of records and the
youth bureau.
3. The administrative services division shall be responsible for
administrative services, communications and complaints, and training
functions.
C. Public safety communications division. Under the joint
direction of the police chief and the fire chief, and the supervision of the
public safety communications manager, this division shall:
1. Provide communication services to the police and fire
departments and other public agencies as directed by the city.
2. Provide electronic maintenance and repair services to city
departments and other public agencies as directed by the city."
Section 2. Section 1.18.040 of the City of Yakima Municipal Code is hereby
amended to read as follows:

"1.18.040 Fire department.
A. Under the general direction of the fire chief, the fire
department shall:
1. Provide for the protection of persons and property and the
elimination of fire hazards, except to the extent that administration and
enforcement of the Uniform Fire Code and other fire prevention and
safety codes are assigned by this chapter to the office of code
administration; •
2. Perform such other duties as may be required by law and by
the city manager.
B. The fire department shall consist of three primary divisions,
supervised by the deputy chief and battalion chiefs responsible to the fire
chief as follows:
1. The operations division, which shall be responsible for:
a. Responding to all alarms and preventing and extinguishing
b. Protecting lives and property against loss from fire,
c. Providing basic life support services within emergency
medical services systems,
d. Responding to and mitigating hazardous material
emergency incidents,
e. Maintaining all property and equipment charged to the fire
department,
f. Performing such other duties as may be assigned by the fire

a. Training, education, and safety of all department personnel,

C. Public safety communications division. Under the joint
direction of the police chief and the fire chief, and the supervision of the
public safety communications manager, this division shall:
1. Provide communication services to the police and fire
departments and other public agencies as directed by the city.

Section 3. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter.

Subject: New Public Safety Communications Division Manager Class
Specification
During the course of the past several months, staff has been working toward
creating a Consolidated Communications Center that incorporates Police
Dispatchers, Fire Dispatchers, and 9-1-1 Calltakers. To date, the 9-1-1
Calltakers will transition from the County to City employment as of July 1,
1996, as part of the newly created Public Safety Communications Division.
In order to prepare for the transition of 9-1-1 services to the City, a proposed
class specification for Public Safety Communications Division Manager is
attached for your review. The proposed manager will be responsible for a
division of 24 people that includes a Supervisor, eleven Dispatchers (Police
and Fire), ten 9-1-1 Calltakers and two Electronic Technicians.
The proposed salary range for this position is $4,012.59 to $4,879.24. This
recommended salary is based upon a comparison to the Police Lieutenant
plus an additional $100.00 per month for additional duties above a
Lieutenant such as 9-1-1 board assignment/responsibilites, budget
responsibilities, and for the supervision and direction of the electronics
section. During the initial 6-12 month transition to consolidated police/fire
dispatch operations, a Police Lieutenant will be assigned to the Public Safety
Communications Division as a liaison to assist in the cross training for law
enforcement policies, procedures and regulations.

CLASS SPECIFICATION
PUBLIC SAFETY COMMUNICATIONS DIVISION MANAGER 1274
NATURE OF WORK
This is a responsible, technical and administrative position involving the
management of the City's Public Safety Communications Division.
The employee occupying the position is responsible for the planning, directing,
operation and maintenance of public safety communications including 911 call
answering, fire and police dispatching, and the electronics section.
Supervision is exercised over a staff of calltakers, dispatchers and technical staff.
Work is performed with considerable independence under the general supervision
of the Fire Chief and Police Chief or designee, and is reviewed through observation,
conferences and reports relative to results in effectively accomplishing established
goals and objectives.
REPRESENTATIVE EXAMPLES OF WORK
Supervises and participates in the operation of Fire/Police Dispatch, 911 Call
Answering and the Electronics Section. Supervises and evaluates the performance
of staff. Plans, coordinates and arranges for staff training in safety, operational and
technical skills. Conducts performance evaluations and recommends disciplinary
action as necessary.
Functions as Director of 911 as assigned by the Operation and Administration Boards
for the operation of the 911 system. Prepares and administers the Division budget
including the 911 budget. Develops and administers City, Departmental and 911
policies and procedures regarding telecommunications.
Coordinates the Division's, the City's and 911s telecommunications activities with
those of surrounding agencies to ensure compatibility and interoperability.
Coordinates with all City departments and 911 system administration in conducting
studies, evaluating and interpreting data and developing long and short range
planning of telecommunications needs. Serves as City's and 911's representative as
assigned, with local and regional committees. Ensures security and confidentiality
of sensitive information.
Prepares bids specifications and engineering reports for telecommunications
equipment. Assists all City departments with budget preparation for
telecommunications equipment. Makes presentations to management,
representatives of the community and other agencies in regards to the Division's,
the City's and 911's telecommunications. Meets and works with representatives of
community, city officials, governmental officials, businesses and agencies in formal
and informal forums. Prepares various reports for management, City Council, 911
Boards and other entities as required.
Supervises and participates in the design, upgrading, operation and repair and
maintenance of the City's telecommunications systems including, but not limited
to; radio communications, telephone, paging, cellular telephone, fire alarm,
dispatch, public address and telemetry. Responsible for telecommunications
equipment, dispatching and 911 call answering procedures in compliance with local,
state and federal licensing and regulations.
Participates in the development and operation of the computer systems for the
Public Safety departments, including but not limited to; Computer Aided Dispatch,
Master Street Address Guide (MSAG), records and computer networks. Supervises
the engineering of various telecommunications systems to meet present and future
needs.
Coordinates the Electronics Section activities in regards to repair and maintenance
with City departments and other agencies.
Ensures the Division has adequate equipment, supplies and parts to perform the
required services.
Performs other duties as required.
KNOWLEDGES, SKILLS AND ABILITIES
Thorough knowledge of the Citys telecommunications systems as listed above and
the 911 system. Thorough knowledge of the operation and procedures of the
Fire/Police dispatch and 911 call processing. Knowledge and understanding of
general and governmental accounting, purchasing, budgeting and reporting
processes and procedures. Knowledge of modern supervisory practices and
procedures. Proficient in computers and computer systems and software.
Ability to meet and interact with employees, government officials and the general
public in a courteous and tactful manner, ability to express ideas clearly and
concisely, both orally and in writing. Ability to communicate technical information
to non-technical people.
UNUSUAL WORKING CONDITIONS
May encounter hostile or upset individuals or groups. May be subject to adverse
weather conditions and shocks, burns and other injuries when participating in
Electronics Section activities. May be required from time to time to work beyond
the normal work schedule.
LICENSES, REGISTRATIONS AND CERTIFICATIONS
Must possess /obtain and maintain a valid Washington State Driver's license. May
be required to possess/ obtain and maintain licenses, registrations and/or
certifications to meet standards for the operation of a consolidated communications
center. Shall be subject to background investigation pursuant applicable state and
federal laws, polygraph examination, security clearance, pre-employment physical
and psychological examination.
GENERAL RECRUITING INDICATORS
Any combination of education and experience equivalent to seven (7) years
experience in public safety communications or related fields which includes two (2)
years of supervisory experience. Graduation from a four (4) year college with a
degree in business or public administration, fire or police science or related field
may be substituted on a month -for -month basis for up to thirty-six (36) months of
required experience. Graduation from a two year technical or vocational school or
community college with a degree in telecommunications, fire or police science,
emergency communications or related field may be substitute on a month -for -
month basis for up to twenty-four (24) months or required experience.

AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for
City employees to be effective July 30, 1996; amending Subsections 2.20.100 A,
2.20.100 B, 2.20.110 A, and 2.20.110 C, all of the City of Yakima Municipal
Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Subsection 2.20.100 A of the City of Yakima Municipal Code is hereby amended to read as
follows:
"2.20.100 Classification Plan.
A. Plan Adopted. A classification plan for city employees is hereby adopted to be
effective July 30, 1996, which plan shall consist of the various following subsections of this section."

Section 3. Section 2.20.110 A of the City of Yakima Municipal Code is hereby amended to read as
follows:
"2.20.110 Compensation Plan. A. Pay ranges and pay steps, set out in the schedule constituting
Subsection B through M of this section, for the classes allocated to these pay ranges shall be in full force and
effect as of July 30, 1996. The pay rates shall constitute full compensation for those employees with a work week
of forty hours as set out in other sections of this code. Employees whose work week is less than forty hours shall
be paid at the rate which is in the same proportion to the rates set out herein that their work week bears to forty
hours. The hourly rate for those employees of the Fire Department whose work week exceeds forty hours shall
be computed according to the provisions of Section 2.22.030 of this code.
The performance of employees in the series designated Subsection B through E shall be evaluated annually
in accordance with a management performance evaluation plan. The result of the performance evaluations shall be
the determination by the City Manager of the actual salary of each employee in the designated positions, and the
determination by the City Council of the actual salary of the City Manager, which actual salaries shall be no less
than the minimum nor no greater than the maximum set out in the pay range applicable to the position, according
to the schedules constituting the various following subsection of this section."
