A RESOLUTION declaring one used 85 -foot snorkel truck to be surplus and
authorizing its sale.
WHEREAS, the City of Yakima Fire Department owns one used 1968 85 -foot
model 10-80S snorkel truck, serial number 3671937, for which the department has no
immediate or foreseeable use and which is surplus to the needs of the department; and
WHEREAS, said surplus snorkel truck currently impedes the needed apparatus
storage space within the station; and
WHEREAS, the City Council deems it in the best interest of the City that said
snorkel truck be disposed of as surplus by bid or negotiated sale to another government
agency; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Council hereby declares the aforementioned 1986 85 -foot snorkel truck to
be surplus to the needs of the City of Yakima, and the Fire Chief is hereby authorized and
directed to dispose of said snorkel truck by bid or negotiated sale to another government
agency.

INTERGOVERNMENTAL TRANSFER AGREEMENT
(RCW 39.33.010)
The City of Yakima, Washington, a municipal corporation, hereby sells, transfers and assigns
to the City of Leavenworth, Washington, a municipal corporation, pursuant to RCW 39.33.010
authorizing sales and transfers between municipalities of the State of Washington, the fire truck
described on the attached Exhibit "A" and incorporated herein subject to the following terms and
conditions of this agreement, in "as is" condition:
1. The fire truck has been declared surplus by the City of Yakima. The City of Yakima
warrants that it has clear title to the fire truck free and clear of encumbrances.
2. The total purchase price for the fire truck is $30,000.00. The City of Leavenworth
shall pay the City of Yakima the sum of $15,000.00 on Wednesday, July 5, 1996 and the balance
of $15,000.00 on July 5, 1997.
3. The City of Yakima shall deliver the fire truck together with all maintenance records,
manuals and all apparatus and equipment pertaining to the fire truck to Leavenworth City
Representatives F.O.B. City Hall, Yakima, Washington, on or before 3 P.M. on Monday, June 24,
1996 so the fire truck may be available for a City of Leavenworth Fire Department inspection prior
to sale. Having inspected the fire truck, the City of Leavenworth shall supply a certificate of
acceptance at the time of mailing the initial payment hereafter, or shall return the fire truck to the
City of Yakima, F.O.B. Yakima City Hall, on or before July 1, 1996. The City of Leavenworth shall
be solely responsible for the truck and its transportation to and from Yakima City Hall and shall
defend, indemnify and hold the City of Yakima harmless from any and all claim, loss, or liability
arising therefrom.
4. Upon payment by the City of Leavenworth to the City of Yakima of the $15,000.00
down payment on July 5, 1996, the City of Yakima shall transfer title to the vehicle to the City of
Leavenworth and deliver to the City of Leavenworth a signed title certificate and execute all other
documents necessary to change title to the City of Leavenworth. The City of Leavenworth shall pay
any excise tax on the transfer together with any and all other fees required to obtain a new title from
the State of Washington.

SUMMARY EXPLANATION:
The Department has placed two new Aerials into service and no longer has a
use or a place to store this piece of equipment. The surplusing of this
apparatus will allow us to sell it to a small City or Fire District.
