A RESOLUTION declaring an emergency and authorizing immediate repair and
rehabilitation of the Industrial Waste Sprayfield project without
calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and Chapter
1.80 of the City of Yakima Municipal Code provide that the City Council may
declare an emergency dispensing with the necessity for bidding for services,
material, equipment and supplies costing more than $25,000.00; and
WHEREAS, RCW 35.22.620(6) similarly provides that the City Council may
adopt a resolution certifying the existence of an emergency situation, thereby
dispensing with the need for competitive bidding procedures; and
WHEREAS, RCW 70.95A.090 provides that pollution control facilities may be
constructed, re -constructed, and approved without the requirement of competitive
bidding; and
WHEREAS, the City of Yakima has incurred substantial damage to its
Industrial Waste Sprayfield during the catastrophic flood of February 1996, thus
requiring extensive and immediate repair/rehabilitation to render that facility
usable for pollution abatement purposes; and
WHEREAS, the Governor of the State of Washington has declared Yakima
County a flood disaster area making it eligible for Federal and State financing
assistance for restoration projects and damage repair; and
WHEREAS, the City has engaged professional engineering services to achieve
necessary and timely repair of damaged facilities by providing estimates of
construction costs, coordinating communication between the City and Federal and
State funding agencies, and performing engineering services throughout the
construction and project completion phases; and
WHEREAS, the City Council finds and declares an emergency exists because
of the following factors:
• The catastrophic flood of February 1996 caused substantial damage
to the Industrial Waste Sprayfield, necessitating immediate repair;
• The Industrial Waste Sprayfield is critically important for pollution
control and abatement purposes; and

• Until repairs are made to the Industrial Waste Sprayfield, the vital
pollution abatement functions cannot be accomplished with serious
economic and environmental consequences; and
WHEREAS, the City Council finds it to be in the best interest of the City of
Yakima to declare an emergency to exist under the aforementioned legal authorities
and to authorized immediate repair and rehabilitation of the Industrial Waste
Sprayfield without calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to take all necessary and
prudent actions to immediately repair and rehabilitate the Industrial Waste
Sprayfield at an approximate cost of up to $1,500,000.00 plus applicable taxes
without calling for bids, and the City Manager is further authorized to execute
necessary construction contracts and state funding agreements.

Confirming our phone conversation, all of the sprayfield
acreage is necessary for us to maintain operation of our canning
facility.
Any reduction of useable acreage would cause the loss of the 1996
operating season.
Issues at risk include:
Loss of $70 million in gross revenue to our company.
Loss of jobs in the community of 275+ Full Time
Equivalents (over 600,000 man hours). Payroll
exceeds $5 million.
- Grower payments for raw product exceed $11 million.
The loss of a full seasons production would jeopardize future
viability of this production facility.

SUMMARY EXPLANATION:
City Council is respectfully requested to approve the attached resolution (1) declaring an
emergency based upon the substantial flood damage caused to the Industrial Waste
Sprayfield and the time urgency involved in the schedule of. repair; (2) waiving the formal bid
process for rehabilitation of the City's Industrial Waste Sprayfield; (3) allowing the City
Manager to execute an agreement(s) for Industrial Waste Sprayfield rehabilitation
subsequent to engineering and legal review of detailed written quotes from interested,
responsible contractors; and (4) authorizing the City Manager to sign all funding applications,
financing agreements and amendments relating to the Industrial Waste Sprayfield
Rehabilitation project. The attached resolution also indicates special consideration in state
law for pollution control facilities with respect to formal bid processes.

Approve resolution declaring an emergency,, waiving the formal bid requirements for the
Industrial Waste Sprayfield Rehabilitation Project (#1776), authorizing the City Manager to
execute forthcoming construction project contracts, and authorizing the City Manager to sign
and execute Federal and State funding applications, agreements and amendments.

Detailed quotes will be required for the work. This work mainly consists of soil delivery,
earthwork and leveling activities -- not particularly complex. This request is driven by the
need to have as much of the damaged portion of the sprayfield planted with appropriate field
grasses by May 15, 1996 in order to secure sprayfield operation to receive Del Monte's
process waste in late July. The formal bid process would require an additional 6 to 8 weeks
to work through thus effectively removing "B" Bench from operation this calendar year. Del
Montehas stated, in the attached letter dated 3/20/96, that "all of the sprayfield acreage is
necessary for us to maintain operation of our canning facility." Staff concurs with that
assessment and directs Council to the consequences as outlined further in their letter if Del
Monte's wastestream cannot be accommodated. The other authorizations in the attached
resolution also save significant time in order to achieve sprayfield operation by the required
time of year for Del Monte's.canning season.
The recent flooding in the Yakima Valley caused the Governor to declare Yakima County a
flood disaster area thus making it eligible for State and Federal assistance to repair damage
done by the flooding. The Industrial Waste Sprayfield sustained heavy damage to the
protective dike (a separate project and funding assistance source) and to what is known as
"B" Bench of the sprayfield. This bench has historically been the most useful area of the
sprayfield, providing up to 40% of the sprayfield capacity. The flooding scoured away the
existing topsoil thus rendering it not usable until rehabilitated. In addition to the earthwork,
several thousand feet of fencing, access roads, drainage and irrigation system components
must be replaced or repaired. The present estimate of cost to rehabilitate "B" Bench is now
discovered to be in the $1,000,000 to $1,500,000 range. With concurrence by Federal and
State governments, the cost participation can be presented as follows:
75% Federal X $1,450,000 = $1,087,500
12.5% State X $1,450,000 = $ 181,250
12.5% Local X $1,450,000 = $ 181.250

$1,450,000
Staff proposes to pursue at least three quotes for the various segments of work in -lieu of a
formal bid process to put "B" Bench back in operation for Del Monte's waste stream. The
City's wastewater treatment facility cannot handle this flow because of its volume, high
strength and upsetting affects on the treatment process. The south portion of "B" Bench must
be seeded by May 15th to be usable by late July or early August. The work on the north half
of "B" Bench would effectively follow to be available within 45 calendar days later.
To expedite getting much of "B" Bench back in service by early August staff recommends that
the formal bid process be waived to save the approximately 2 months it would require to
prepare plans and specifications, ad the project, award and execute the contract, and start
work. It is recommended that 3 quotes be solicited. The one with the best prices and time
would be selected to perform the various work elements necessary to rehabilitate the
Industrial Waste Sprayfield. It is staff's intent to keep Council, the City Manager, and Del
Monte fully informed of this project with respect to federal and state assistance eligibility,
selected contractors, and work progress.
