A RESOLUTION approving and adopting an updated paratransit plan to meet Federal
Transit Administration service requirements for complementary
paratransit service consistent with the Americans With Disabilities Act
of 1990.
WHEREAS, the United States Department of Transportation has published final
regulations implementing the Americans With Disabilities Act of 1990 (ADA), which
regulations include a requirement that public entities operating fixed -route transportation
service for the general public also provide complementary paratransit service to persons
unable to use the fixed route system; and
WHEREAS, the City of Yakima does operate a fixed -route transportation service for
the general public and therefore is subject to the above -stated requirement; and
WHEREAS, the City of Yakima Transit Division has prepared an updated paratransit
plan to meet the above -stated requirement and show progress toward the goal of full ADA
compliance by 1997; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The attached and incorporated Americans With Disabilities Act Paratransit Plan
Update is hereby approved and adopted for implementation by the City of Yakima Transit
Division.

As developed in our 1992 through 1995 ADA paratransit Plan update submissions
to the Federal Transit Administration, Yakima Transit is in full compliance with all
six ADA paratransit service requirements and continues to meet the on-going
requirements for public participation of persons with disabilities.
Yakima Transit held a public hearing on the annual ADA paratransit Plan update
submission to FTA on January 9, 1996. (If no substantial issues are raised
concerning the six criteria, this fact will be clearly stated here).
In the event there are substantial comments received on the six criteria, the issues
discussed at the public hearing will be summarized on an attached page for FTA
review.
During 1995, the Transit Administrative Team either met with or contacted by mail
or phone persons with disabilities or organizations representing persons with
disabilities to discuss and solicit comments on local ADA paratransit service relative
to the six service criteria.
The Six Service Criteriia:
(1) Service Area: The entity shall provide complementary paratransit service
(Dial -A -Ride) to origins and destinations within corridors with a width of 3/4
of a mile on each side of a fixed -route (Transit Bus Route). The corridor shall
include an area of 3/4 of a mile radius at the ends of each fixed -route.
Note: Yakima Transit is a City owned and operated transit system and thus
the criterion above applies only to those areas lying within the existing city
limits of Yakima
(2) Response Time: The entity shall schedule and provide paratransit service to
any ADA eligible paratransit person at the requested time on a particular
day in a response to a request for service made the previous day.
Reservations may be taken by reservation agents or by mechanical means,,
(3 Fares: The fare for a trip charged to an ADA eligible paratran.sit user of the
complimentary paratransit service shall not exceed twice the fare that would
be charged an individual paying full fare (i.e. without regard to discounts) for
a trip of similar length, at a siimilar time of day, on the entity's fixed -route
system.
Note: One exception is made for social service agencies or other organization
sponsored trips. A price more than twice the fixed -route fare may be
negotiated for trips guaranteed the agency for its use. For example, if an
agency wants 12 tnps to the Senior Center, the agency makes the
reservations in its name, the agency is paying for the trips, and the trips are
reserved for the agency, the provider can negotiate any price it can with the
agency for the trips.
(4) Trip Purpose Restrictions: The entity shall not impose restrictions or
priorities based on trip purpose.
(5) Hours and Days of Service: The complimentary transit service shall be
available throughout the same hours and days as the entity's fixed -route
service.
(6) Capacity Constraints: The entity shall not limit the availability of
complementary paratransit service to ADA eligible paratransit individual by
any of the following:
(a) Restrictions of the number of trips an individual will be provided;
(b) Waiting lists for access to the service; or
(c) Any operational pattern or practice that significantly limits the
availability of service to ADA paratransit eligible persons.

SUMMARY EXPLANATION:
In 1994, about one half of the Nation's 535 paratransit providers reported they were
already in compliance with the six service criteria of the Americans with Disabilities
Act. The City of Yakima, Yakima Transit is counted among those providers in full
compliance since 1994. It is projected that two thirds of Nation's paratransit providers
are to be in full compliance by the end of 1995. The Act is mandated by Congress to be
fully implemented by all service providers no later than January 26, 1997.
For transit systems that are in full compliance, ADA paratransit service and cost data
is captured by reporting under National Transit Data Base reporting system (formerly
known as Section 15, due each May 15). Therefore, consistent with the current
Administration's policy of reducing the administrative burden of regulation and
paperwork, all systems such as Yakima Transit who are certified in full compliance by
FTA are required to hold a public hearing on the update and submit a one page response
to the Regional Office by January 26, 1996.
