M SPACE ASSIGNED: AIRCRAFT TYPE "N" NUMBER COLOR of AI-RCRAFT I I certify I am the owner of the above listed aircraft, that it is certified by competent authority and that it contains an operational two-way radio with 133.25 MHz frequency. 2. 1 understand the tic down rental fee of Forty-Five Dollars ($45.00) per month (plus applicable state sales or leasehold tax) is due and payable in advance on the first day of each month. Invoices will not be mailed by the YAT for tiedown rental. It is the responsibility of the Renter to make the rental payment each month without notice. If payment is not received by the 10th of the month, this agreement shall change to a day-by-day lease at Three Dollars ($3.00) per day until such time as the agreement is cancelled or the rent is paid in full. I agree to park only the above listed aircraft on the space assigned. I further agree to not allow other aircraft owners to use or "borrow" my assigned tie down. 4. This agreement is to be considered a "month-to-moth" agreement. It is further understood this agreement may be cancelled in writing by either party on a thirty (30) day basis. Termination notice should be sent to Airport Manager, Yakima Air Terminal. If this agreement is cancelled by the Airport Manager for non-payment of rent, infraction of airport regulations, or for any other reason, I agree to remove this aircraft from the tie down area within twenty-four (24) hours or at the request of the Airport Manager. 5. It is understood the Yakima Air Terminal or any of its representatives may not be held liable for any damage whatsoever to aircraft, personnel or equipment located on this airport, 6. 1 certify I have a minimum of $1,000,000 of valid liability insurance for bodily injury and property damage. A copy of the certificate shall be provided to be attached to this agreement. The certificate shall name the Yakima Air Terminal as an "additional insured", and the certificate shall be kept current for the file. The insurance carrier shall be licensed to do business in the State of Washington, and the insurance carrier will have an A.M. Best rating of "A-" or higher 7. It is understood this tie down space is reserved for private aircraft owners who use their aircraft for pleasure and/or business transportation only. I certify my aircraft will not be used for revenue producing flights at this airport. It is further understood that no automobiles, motorcycles or any automotive vehicles are allowed on the aircraft parking ramp with the exception of my own vehicle parked on my assigned tie down space while the aircraft is away from Yakima Air Terminal. 9. It is understood I am to furnish my own chocks and tie down lines and that my aircraft will be chocked and tied down at all times when not in use. 10. A, is understood the air, - -A shall not be parked on the tie down s, with flat tires or in a generally unsightly, non-airworthy condition. The interpretation of this paragraph resides solely with the Airport Manager or his/her designated representative. 11. It is further understood that no aircraft maintenance will be performed on this tie down space that includes the actual changing of any fluid, i.e. engine oil change, hydraulic fluid, etc. Fluid replenishment is permitted. The Renter is also given notice under this section not to dispose of any fuel samples directly onto the tiedown or YAT ramp space, 11 Access to Non-Movement Area / ln=ss and Egress. Renter is granted only that vehicular and/or pedestrian access which is reasonably necessary to allow Renter access to the tie down once Renter is on Airport property. Vehicular access to and egress from Airport by the Renter shall be made into and out of only Airport Gate No. . There is pedestrian access along this same fence line. Vehicular or pedestrian access to any and/or all movement areas, whether active or inactive, is expressly prohibited by this Agreement. For the purpose of this Agreement, a movement area is any runway or taxiway utilized for taxiing, takeoffs, and landings of aircraft, exclusive of aircraft loading ramps, aircraft parking areas, and aircraft aprons and tie down spaces. 13, Access ID Airport Administration will assign one (1) Yakima Air Terminal (YAT) identification card to the Renter only. The cost of the badge is dependent on costs associated with the requisite and mandated background check. A request by the Renter for an additional card(s) shall be made in writing stating the reason(s) or rationale why an additional card(s) is/are required. Any request for an additional card may or may not be approved by the Airport Manager at his/her sole discretion. The minimum information required for the issuance of any additional card will include the name, local address, and contact phone number of the individual. The same fees outlined above are applicable for any additional badge. If any card is lost, stolen, or made unusable for any reason, the Renter will pay the applicable fine and costs associated with the issuance of a new or replacement badge in effect at that time. 14. The control and monitoring of access is paramount to Airport security, Accordingly, only authorized users with access to the Airport granted pursuant to this Agreement may hold an ID card to access the Airport. Lost or stolen Airport-issued access cards shall be reported immediately by any means possible to Airport Administration, whereupon the loss or theft will be recorded, and the card will be made "inactive". "Reported immediately" means within twenty-four (24) hours or the next business day, not including weekends or holidays. A new card may then be issued by Airport Administration bearing a number different from the one lost or stolen. 15. Fraud and Intentional Falsification of Records. (a) No person may make any fraudulent or intentionally false statement in any application for any security program, access medium, or identification medium. (b) No person may make any fraudulent or intentionally false entry in any record or report that is kept, made or used to show compliance or exercise any privileges. 16. Security Responsibilities. No person may: (a) Tamper or interfere with, compromise, modify, attempt to circumvent, or cause a person to tamper or interfere with, compromise, modify, or attempt to circumvent any security system, measure, or procedure. (b) Enter, or be present within a secured area without complying with the systems, measures, or procedures being applied to control access to, or presence or movement in, such areas. Any person given vehicular access to the Airport shall be required to read, apply for and pass the test associated with the current edition of the Airport Drivibg Rules & Regulations document provided by the Aiq ort, to qualify for access to the Airport. A copy of the applicatim and test will be kept in the Rentees File, I& Airport Sift Ed SMW:W-. In the interest of Airport s4* and security, in the event Renter fails to abide by this Agreement, the Airport Manager of YAT is authorized by. the Airport's Governing Authority, to immediately deck= this Uasc void, to cancel the same without any legal proceeding and take possession of the tic down, (See paragraph 4abovo) 19. Ajmm—fi-Nww:M Renter acknowledges b0her personal impo#snce in keeping the Airport m"SenersJ and the airs on the assigned tic down spot as safe and secure as passible. Furthe=ore, the Aircraft Owners and Pilots Association (AOPA) through its Airport WATC11 program reconmends utilizing aircraff door locks at all times when the airctaft is unattended and the use of auxiliary locks to further protect aircraft from unauthorized use. Consequently, Renter voluntarily agrees to take one or more of the following actions when the aircraft is stored/tied down at YAT: (a) Lack the doom of the aircraft (if possible); and/M (b) Place a prop look on the aircraft, and/or, (c) Place a throttle lock on the airomft. (d) If the airvraft doors can be locked, Renter shall accomplish either (b) or (o) or both above La addition tr, lockitig aircraft doors. If the aircraft doors cannot be locked, Renter agrees hrJsbc ABU accomplish Omer (b) or (p) or both above. (e) The aircraft is subject to a security inspection by anyone on Airport gaff at any time, If the, aircraft doors are not locked and/or one of the altenialive methods of securing the aircraft is not being accomplished in addition to or in lieu of the aircraft doors being locked, Renter acknowledges and agrees that this shall constitute a debulting condition of this Aptement and thereby subject Renter to mediate termination ofthe Agreement.
