RESOLUTION NO. 2016-124
authorizing the execution of Supplement No. 2 to the Professional Services
Agreement (Contract No 2014-180) with Maul Foster Alongi (MFA) , not to
exceed $54,100, for post interim action professional services required for
the former Tiger Oil Site located at 2312 West Nob Hill Boulevard
WHEREAS, the Yakima City Council has established that the environmental cleanup and
redevelopment of the former Tiger Oil property at 2312 West Nob Hill Boulevard is both an
"Economic Development" and "Improving the Built Environment" priority; and,
WHEREAS, on October 8, 2014, the Yakima City Council approved Resolution R-2014-
121, which authorized a Professional Services Agreement with MFA to prepare remedial design,
permitting and construction oversight for the environmental cleanup of the former Tiger Oil site at
2312 West Nob Hill Boulevard in an amount not to exceed $230,000; and
WHEREAS, on May 19, 2015, the Yakima City Council approved Resolution R-2015-068,
which authorized Supplement No 1 of this Professional Services Agreement, in an amount not to
exceed $55,000 for post interim action professional services, which included groundwater
monitoring and testing for eight (8) quarters for seven (7) monitoring wells; and
WHEREAS, the Washington State Department of Ecology has recommended that an
additional nine (9) groundwater monitoring wells be sampled and tested to better understand the
results of the interim action, and
WHEREAS, the Scope of Work and Budget included in this Supplement to the
Professional Services Agreement meet the needs and requirements of the City of Yakima for this
project which by necessity has evolved and expanded to accommodate the complexity of the
redevelopment project, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute the Supplemental Agreement with Maul
Foster Alongi, Inc. attached hereto and incorporated herein by this reference not to exceed Fifty -
Five Thousand Dollars ($54,100) to provide post interim action professional services required for
the former Tiger Oil site located at 2312 West Nob Hill Boulevard

Section 1: Supplemental Agreement
The City of Yakima, Washington desires to supplement the contract agreement entered into with Maul
Foster Alongi, Inc, and executed on October 8, 2014 by Resolution No. 2014-121 and identified as
Contract 2014-180 All provisions in the basic contract remain in effect except as expressly modified by
this supplement. The changes to the agreement are described as follows
Section 2: Scope of Services
The additional task to be performed as part of this Supplemental Contract is to provide post interim action
professional services, which includes
1 Conduct three (3) quarters of groundwater monitoring and report under the currently agreed to
monitoring regime
2 Assist the City in discussions with the Department of Ecology regarding next steps for the site
following the completion of the eight (8) quarters of post -interim remedial action groundwater
monitoring
Section 5: Compensation
Payment for this supplemented work will, as shown on Exhibit A is not exceed $54,100, bringing the total
amount of the Agreement to $339,100

SUMMARY EXPLANATION:
Yakima City Council has established that the environmental cleanup and redevelopment of the
former Tiger Oil property at 2312 West Nob Hill Boulevard is both an "Economic Development"
and "Improving the Built Environment" priority. On October 8, 2014, the City authorized a contract
with MFA to prepare remedial design, permitting and construction oversight for the environmental
cleanup of the former Tiger Oil site at 2312 West Nob Hill Boulevard. The amount of the contract
for professional services was $230,000. On May 19, 2015, the City authorized Supplement No. 1
of this contract, in an amount not to exceed $55,000 for post interim action professional
services.
Supplement No. 2 of the professional services agreement (contract no. 2014-180) is to complete
the post interim action professional services required for the former Tiger Oil site located at 2312
West Nob Hill Boulevard. The original monitoring plan included seven (7) monitoring well
locations. After the first quarter of monitoring, the Department of Ecology recommended that the
number of monitoring well locations be increased to sixteen (16). The increase in the number of
required samples to be tested has increased the cost of this work. The funds to pay for this
additional work will come from the $300,000 Tiger Oil Insurance Settlement that the City acquired
when it purchased the property.
