SUMMARY EXPLANATION:
Amalie Vivanco is requesting a right -of -way use permit to allow for the placement of a mobile
food vendor within the right of way adjacent to 702 S. 1st Street. The property is located within the
General Commercial (GC) zoning district. The proposed food vendor cart is on wheels and will be
removed daily. The required commissary kitchen for this vendor is at 702 S 1st Street.
Right -of -Way Use permits are processed under the provisions of Chapter 8.20, which requires
review by the code administration manager and final approval by City Council. The permit also
requires liability insurance as prescribed in Section 8.20.060, which will be provided to the Office
of Code Administration prior to the issuance of any permit. Approved permits are valid for a
period of one year, renewable annually. This allows the City an opportunity to review any public
health /safety /welfare issues that may need to be addressed in subsequent years.
This application was reviewed by the Development Services Team on September 27, 2016. No
formal comments were received objecting to this request.

RESOLUTION NO. R -2016-
A RESOLUTION authorizing issuance of a right -of -way use permit to allow the
placement of a food vendor stand within the public right -of -way
along South 1S St.
WHEREAS, pursuant to Chapter 8.20 YMC, the City Council is authorized to
approve issuance of permits for construction of certain improvements within rights -of -way
within the City's commercial districts; and
WHEREAS, Amalia Vivanco has submitted an application for a right -of -way use
permit to allow for the placement of a food vendor stand within the public right -of-
way /sidewalk at 702 S. 1S St., approximately 70 feet south of the intersection of Race and
S. 1S St. within the General Commercial (GC) zoning district.
WHEREAS, the application was deemed complete on September 19, 2016; and
WHEREAS, the applicant has provided proof of liability insurance; and
WHEREAS, city staff has recommended approval of such permit; and
WHEREAS, the City Council, having considered such application and the
recommendation of city staff, hereby finds and determines that issuance of the requested
right -of -way use permit authorized pursuant to Chapter 8.20 YMC is in the best interest of
residents of the City of Yakima and will promote the general health, safety and welfare;
now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager, or his designee, is hereby authorized to execute and issue a
right -of -way use permit in accordance with the provisions of YMC Chapter 8.20 and in
conformity with the application for such permit submitted by Amalia Vivanco on
September 6, 2016, and designated as city Regulatory License No. RL- 160042, for a food
vendor stand within the public right -of -way located approximately 70 feet south of the
intersection of Race and South 1S St.,
ADOPTED BY THE CITY COUNCIL this 4th day of October, 2016.

REQUEST
Amalia Vivanco is requesting a Right -Of -Way Use Permit to place a food vendor stand within
the public right -of -way, located between the sidewalk and street, approximately 70 feet south of
the intersection of Race and S. 1S St. The property is located within the General Commercial
(GC) zoning district.
FINDINGS
DEVELOPMENT SERVICES TEAM (DST) REVIEW: A DST meeting will be held on September
27, 2016, for technical review of this request. No formal comments or concerns have been
received objecting to the request.
CONCLUSIONS
1. The use of the sidewalk /public right -of -way at 702 S. 1S St., is consistent with state law, and
the provisions of the Yakima Urban Area Zoning Ordinance which does not prohibit or limit the
location of a food vendor stand. However, a right -of -way use permit is required to permit this
feature within the public right -of -way.
RECOMMENDATION
According to the findings listed above, the City of Yakima Planning Division has no objection to
the granting of this right -of -way use permit.

Supplemental Questions for a Mobile Food Unit
The permit holder must obtain approval from other applicable regulating agencies prior to
operating a mobile food unit, including the Department of Labor and Industries and the Health
District. Please provide copies of the approvals from those agencies.
1. When not in operation, a mobile food unit must be stored at an approved servicing area or
other approved location. Where do you plan to park the mobile food unit when you are
not open for business? WAC 246- 215- 121(3)
2. The owner of a mobile food unit must submit a plan of operation. Any changes to the
plan of operation including but not limited to changes in the menu must be approved by
the regulatory authority. The plan of operation should include the following per WAC
246- 215 - 121(6):
(a) Menu (may attach a copy)
(b) What is the location of the site(s) from which you plan to operate the mobile food
unit? (Include a site plan and the hours of operation for each site)
(c) How and where do you dispose of your wastewater?
(d) What is the method you will use for disposing of cooking grease?
(e) The person in charge must ensure that the water system on the mobile food unit is
supplied from an approved source of water. Where do you plan to fill your water tanks?

(f) Where are the restrooms for your employees?
(g) What is your cleaning schedule?
3. The person in charge of a mobile food unit must ensure all foods, including ice, are from
an approved commissary. What is the current business name and address of the approved
commissary you plan to use? WAC 246- 215- 121(8a)
4. The permit holder must designate a name for the business and provide it to the regulatory
authority and ensure that the name is posted on the mobile food unit in a manner easily
visible to customers during the hours of operation. Is your business name posted and
easily visible to customers? WAC 246- 215- 121(16)
5. Any accessory items (i.e. waste receptacles, step stools, etc.) associated with the mobile
food unit must be removed from the premises at the end of each work day. Mobile food
units shall not use freestanding awnings, canopies, umbrellas, etc.; all such devices shall
be permanently attached to the unit and fully supported.
