For Meeting of: October 4, 2016 ITEM TITLE: Resolution authorizing a Right -of -Way Use Permit for Amalie Vivanco to allow for the placement of a mobile food vendor stand within the public right -of -way adjacent to 702 S 1st Street SUBMITTED BY: Joe Caruso, Code Administration Manager (509) 575 -6257 Joan Davenport, AICP, Community Development Director SUMMARY EXPLANATION: Amalie Vivanco is requesting a right -of -way use permit to allow for the placement of a mobile food vendor within the right of way adjacent to 702 S. 1st Street. The property is located within the General Commercial (GC) zoning district. The proposed food vendor cart is on wheels and will be removed daily. The required commissary kitchen for this vendor is at 702 S 1st Street. Right -of -Way Use permits are processed under the provisions of Chapter 8.20, which requires review by the code administration manager and final approval by City Council. The permit also requires liability insurance as prescribed in Section 8.20.060, which will be provided to the Office of Code Administration prior to the issuance of any permit. Approved permits are valid for a period of one year, renewable annually. This allows the City an opportunity to review any public health /safety /welfare issues that may need to be addressed in subsequent years. This application was reviewed by the Development Services Team on September 27, 2016. No formal comments were received objecting to this request. R -2016- A RESOLUTION authorizing issuance of a right -of -way use permit to allow the placement of a food vendor stand within the public right -of -way along South 1S St. WHEREAS, pursuant to Chapter 8.20 YMC, the City Council is authorized to approve issuance of permits for construction of certain improvements within rights -of -way within the City's commercial districts; and WHEREAS, Amalia Vivanco has submitted an application for a right -of -way use permit to allow for the placement of a food vendor stand within the public right -of- way /sidewalk at 702 S. 1S St., approximately 70 feet south of the intersection of Race and S. 1S St. within the General Commercial (GC) zoning district. WHEREAS, the application was deemed complete on September 19, 2016; and WHEREAS, the applicant has provided proof of liability insurance; and WHEREAS, city staff has recommended approval of such permit; and WHEREAS, the City Council, having considered such application and the recommendation of city staff, hereby finds and determines that issuance of the requested right -of -way use permit authorized pursuant to Chapter 8.20 YMC is in the best interest of residents of the City of Yakima and will promote the general health, safety and welfare; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager, or his designee, is hereby authorized to execute and issue a right -of -way use permit in accordance with the provisions of YMC Chapter 8.20 and in conformity with the application for such permit submitted by Amalia Vivanco on September 6, 2016, and designated as city Regulatory License No. RL- 160042, for a food vendor stand within the public right -of -way located approximately 70 feet south of the intersection of Race and South 1S St., ADOPTED BY THE CITY COUNCIL this 4th day of October, 2016. FINDINGS DEVELOPMENT SERVICES TEAM (DST) REVIEW: A DST meeting will be held on September 27, 2016, for technical review of this request. No formal comments or concerns have been received objecting to the request. CONCLUSIONS 1. The use of the sidewalk /public right -of -way at 702 S. 1S St., is consistent with state law, and the provisions of the Yakima Urban Area Zoning Ordinance which does not prohibit or limit the location of a food vendor stand. However, a right -of -way use permit is required to permit this feature within the public right -of -way. RECOMMENDATION According to the findings listed above, the City of Yakima Planning Division has no objection to the granting of this right -of -way use permit. Please provide copies of the approvals from those agencies. 1. When not in operation, a mobile food unit must be stored at an approved servicing area or other approved location.
