For Meeting of: July 19, 2016 ITEM TITLE: Ordinance adding a new section to Title 11 of the Yakima Municipal Code, Chapter 11.18 City Fuel Gas Code; and adopting the International Fuel Gas Code as the fuel and gas code for the City of Yakima SUBMITTED BY: Sara Watkins, Senior Assistant City Attorney Glenn Denman, Supervising Code Inspector (509) 575 -6268 SUMMARY EXPLANATION: Washington State law requires cities and counties to adopt the state - approved editions of the International Fuel Gas Code. Previously, the fuel and gas code requirements for buildings and other structures were found in other international code provisions. The City of Yakima adopted the 2015 versions of other codes, which no longer include the fuel and gas code provisions in them, necessitating a new and separate ordinance to be included in the Yakima Municipal Code. The 2015 edition of such code has been approved by the state for adoption by local jurisdictions. The fees associated with permits issued pursuant to such code has not been changed in this Ordinance. WHEREAS, the fuel gas code requirements for buildings and other structures were previously found in other international code provisions, but were removed and replaced with the 2015 International Fuel Gas Code; and WHEREAS, the State of Washington previously enacted the International Fuel Gas Code in its regulations as the fuel gas code for the State of Washington; and WHEREAS, the City of Yakima adopted the 2015 versions of other codes, which no longer have fuel gas code provisions in them, necessitating enacting a new ordinance to ensure the fuel gas code provisions were included in the Yakima Municipal Code; and WHEREAS, the City Council finds and determines that adopting this ordinance is in the best interest of the residents of the City of Yakima and will promote the general health, safety and welfare; now, therefore BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Chapter 11.18 of the Yakima Municipal Code shall be added to read as follows: Chapter 1t FUEL GAS CODE Sections: 11.18.010 City Fuel Gas code. 11.18.010 City fuel gas code. ........................................................................................................................................................................................................................................................................................................ ............................... The fuel gas code of the city of Yakima shall be comprised of the 2015 Edition of the International Fuel Gas Code, as published by the International Code Council, Inc., and as adopted and maintained by the State Building Code Council in Chapter 51 -52 -21000 WAC. The above - referenced text is incorporated in this chapter by reference. One or more copies of the text that comprises the fuel gas code of the city of Yakima shall be maintained on file in the office of the code administration manager of the city of Yakima. Section 2. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional, unlawful or invalid by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. 1 PASSED BY THE CITY COUNCIL signed and approved this day of July, 2016.
