ITEM TITLE: Status update and discussion on the use of $100,000 donation to
the City of Yakima pursuant to the settlement agreement in Montes,
et al. v. City of Yakima, et al.

SUMMARY EXPLANATION:
At the City Council business meeting on June 21, 2016, the $100,000 donation to the City of
Yakima was discussed. The donation was part of the settlement in the case of Montes and
Arteaga v. City of Yakima, et al. This agenda item will provide an update on any developments
since the City Council meeting on June 21, 2016, and is to facilitate further discussion on the use
of the proceeds and the process utilized to make a final decision on the use of the funds, which
use pursuant to the settlement agreement is "as mutually determined by the parties ".
The settlement agreement provides that plaintiffs "agree to donate $100,000 of their fee award
back to the City of Yakima to promote equity and equal opportunity for previously underserved
Yakima residents, as mutually determined by the parties. Plaintiffs agree to donate the $100,000
within ten days after the parties reach agreement on the use of such funds."
