HomeMy WebLinkAbout1961-221 ORDINANCE NO. 111 AN ORDINANCE authorizing the appointment of special police officers, regulating the wearing of special police officer uniforms and badges, defining offenses and prescribing penalties, - and declaring an emergency. BE IT ORDAINED BY THE CITY OF`YAKIMA: Section] . UNLAWFUL WEARING OF BADGE. It shall be unlawful for any person, unless he is a duly and regularly appointed and acting special police officer under the provisions of this ordinance, or a police officer of the United States Government, the State of Washington, the County of Yakima, or the City of Yakima, to wear or carry upon his person or to possess any special police badge or similar insigniaor thing in imitation or similitude thereof, or to wear the uniform of a special police officer or any similitude thereof, or to act or serve 41 / as a special police officer. Section 2. DEFINITIONS. The term "special police officer", as used in this ordinance, shall mean any person acting as a patrolman, guard, watchman, merchant patrolman, auxiliary law enforcement officer, private detective or any person engaged in any occupation the purpose of which is to afford police or fire protection. Special police offi- cers who are not performing such duty as a part of their regular City employment, shall serve without compensation of the City of Yakim:. No special police officer, unless performing such duty as a part of his regular City employment, shall be considered an employee of the City of Yakima for any purpose, and in no event shall any special police officer be entitled to the benefits of the Police Pension Fund • Act, Section 3. APPLICATION FOR APPOINTMENT. 1. Any person, othertha -1- City or Metropolitan Park District employees or Civilian Defensv or 111 auxiliary police personnel, desiring appointment as a speeial police officer shall file with the Chief of Police an application form properly filled out and signed by the applicant and also by the duly authorized representative of the applicant's firm or organization. Each applica- tion shall include: (a) An affidavit of applicant's previous history, setting out in full the applicantgs name, age, residence, occupation and place of employment for the preceding five years. Such affidavit shall show sufficient facts to prove good character, competency and integrity, and shall list any previous police record; (b) Character reference statements from five reputable residents, each of whom shall certify that he has personally known the applicant for a period of three years prior to the application and 111 that he believes the applicant is competent, honest and of good char- acter and suitable to engage in police work; (c) A doctor's certificate showing the physical condition of the applicant; (d) A good and sufficient bond in the sum of $1 in form to be approved by the City Attorney and with sureties approved by the City Clerk and conditioned to secure and indemnify the City against all claims and demands for the service of or growing out of any acts done: or omitted by such police officers; provided, that no bond shall be required where a similar bond is required under the licensing ordinances of the City of Yakima. (e) A picture, physical profile and finger prints of the • applicant; (f) A statement showing the necessity for the issuance of such commission. -2- 4 S41 4i 2. City or Metropolitan Park District employees or Civilian 0 Defense or auxiliary police personnel -who require appointment El.t special police officers in order to properly perform the duties to which they are assigned shall file with the Chief of Police an appli- cation form properly filled out and signed by the applicant, and also by the head of the department under whom the duties will be .performed. Such application shall include: (a.) An affidavit of applicants previous history s setting out in full. the applicant's name, age, residence, occupation and place of employment for the preceding five years. Such affidavit shall show sufficient facts to prove good character, competency and integrity, and shall list any previous police record; (b) Character reference statements from the immediate supervisor of applicant and the head of the department, each of • whom shall certify the length of time he has personally observed applicant and that he believes the applicant is competent, honest and of good character and suitable to engage in polic work; (c) A doctor's certificate showing the physical condition of the applicant; (d) A picture, physical profile and fingerprint; of the applicant; (e) A statement from the department head showing the necessity the issuance of such commission. Section 4. APPOINTMENT. Upon receipt of properly completed and satisfactory applications, the City Manager may commission fremtime totime„ in accordance with the provisions of this ordinance, such number of special police officers as he shall deem necessary and who 411 are found by him to be qualified therefor Commissions will be istued on printed forms signed by the City Manager. -3 Section 5. DUTIES, Successful applicants will be commisAcied as special police ifficers for such special duty as xtated in the application subject to the orders rule: and regulations of the Police Department and the Chief of Police. Special polic officer also shall: (a) Keep on file with the Chief of Police the true home address and telephone number of such special police officer; (b) Wear on his person a special police officer badge at all times while performing the duties of special police offictr; (c) Maintain himself at all times while acting a a special police officer in a businesslike, quiet and dignified manner; (d) Submit proposed uniforms to the Chief of Police for approval. • Section 6. BADGES, ISSUANCE, Special police officers° b:dges shall be stamped "special", or of such wording and shape as designated by the Chief of Police and shall be of such a different shape and design from the official police officers badges as to be readily distinguishable. Special polict officers badges shall be issued only by th- Chief of Police and only to those persons who have secured commissions :s provided in this ordinance andwho have paid all deposits, license fee':' required by licensing ordinances, and poeted the bond as requir'd. The Chief of Police shall make a charge of Two Dollars for the issuance of every badge, which sum shall be considered as rental for the use of such badge, and which sum shall be reimbursed upon proper return, of the badge and commission. • Section 7. REVOCATION OF APPOINTMENT—COMMISSION NOT TRANSFERABLE, Any special police officer may be removed by the City Manager at :ny time at his pleasure. Any special police officer who has been removed ..- w.; or who has ceased to perform the duties which require a speeial police 411 officers badge and commission, shall forthwith return the same to the Chief of Police. Badges -and commissions are not transferable. Section 8. VIOLATION.-PENALTY. The violation of or failure to comply with any of the provisions of this ordinance shz11 constitute a , misdemeanor punishable by a fine not exceeding Three Hundred Do1lare or by imprisonment in the City Jail not exceeding ninety dye v or by both fine and imprisorment. Section 1. This ordinance is one to provide for the immediate preservation of the public peace, property, health and saf4ty and an emergency is declared to exist, and this ordinance shall be in fsal force and effect immediately upon its passage, approval and publica- tion as provided by law and by the City Charter. 111 PASSED BY THE CITY COUNCIL, signed and approved thiz 8th day of Mach 1961.
