R-2025-019 A RESOLUTION authorizing a grant application for a feasibility study on the wastewater infrastructure around the Wiley City area to the Yakima County Supporting Investments in Economic Development (SIED). WHEREAS, the Wiley City is a Limited Areas of More Intensive Rural Development (LAMRID) within the City of Yakima's Urban Growth Area (UGA); and WHEREAS, the City of Yakima has been notified that grant funds may be available to conduct a feasibility study to evaluate options for addressing domestic and industrial wastewater in the Wiley City area upon submission of completed SIED grant application and satisfaction of certain conditions; and WHEREAS, the City of Yakima has been approached and asked to apply for a SIED application and administer the grant, if awarded, solely to conduct a feasibility study of the Wiley City wastewater system expansion; and WHEREAS, the grant application will request a total of approximately one hundred and twenty thousand dollars ($120,000) in SIED funding administered by the Yakima County; WHEREAS, the City Council deems it to be in the best interest of the City and its residents to authorize submission of the grant application to the Yakima County for grant funds needed to create a feasibility study and plan for the Wiley City/Ahtanum area regarding wastewater system options, and, if grant funds are awarded, to accept the funds for the purposes identified in the grant application, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to submit a completed SIED grant application to the Yakima County for the feasibility study of the Wiley City wastewater system. SIED will not entertain requests for project cost overruns. For the success of your project, ensure project cost estimations are realistic. Local Match. A local match of twenty (20)percent of the SIED request is required. Local match may be demonstrated as cash or in-kind contribution. Other Funding Sources. A statement is required from the planning jurisdiction relating to the type of public facility for which a SIED investment is sought. Permits. No more than$2,000,000 total award from SIED when loan and grant combined.) Interest rates on loans are established when the County formally approves the project contract by using the County Interfund Loan Rate,as authorized by law. Loans are given for a term of 10 years and annual payments are made in equal amounts on June 1s`of each year. An interlocal agreement will be established between the County and the applicant specifying repayment dates and a loan amortization schedule. Loan payment installments are based on an ordinary annuity,compounded annually. If an applicant needs additional flexibility on loan repayment schedules they can request a deferral. Interest on loans will continue to accrue from the date the contract is approved by the County,even if the applicant is granted a deferral on their first loan payment. If an applicant requests a deferral of the first loan payment,the applicant must justify the request. A SIED loan is a general obligation of the jurisdiction receiving the loan. Wiley City/Ahtanum Sewer and Wastewater Feasibility Plan Project Title: Date of Application: Project Summary:Describe the public infrastructure project and the private development that will occur. Explain why the private development requires the public infrastructure project: The Wiley City/Ahtanum area is a rapidly growing community with approximately 5,500 residents,several large agricultural businesses, and essential public services, including an elementary school. However,the area currently relies on aging septic systems that are insufficient for its current population and economic activity.These systems present possible environmental challenges,with wastewater potentially impacting local ponds, creeks, and the groundwater supply. The proposed feasibility plan will evaluate and create a plan that should be composed of a comprehensive wastewater management solution for Wiley City, addressing public health and environmental concerns and enabling economic development.This feasibility plan will assess two primary options for wastewater management: 1. Connection to the City of Yakima's Wastewater Treatment Plant(WWTP): Gravity Sewer System: This option would evaluate the possible extension of Yakima's existing sewer infrastructure to Wiley City. This option would likely minimize the need for on-site treatment facilities but would require significant infrastructure installation. Pump Station and Force Main System: For areas not compatible with gravity flow, the feasibility plan would also evaluate a system of pump stations which could transport wastewater through force mains to Yakima's WWTP,which may optimize land use in the area. 2. Local Wastewater Treatment Plant(WWTP)Options for Wiley City: Conventional Activated Sludge or Membrane Bioreactor(MBR) Systems:The feasibility plan will evaluate the feasibility of constructing a local WWTP, potentially using MBR technology,which could produce reuse-quality water that could be used for irrigation and groundwater recharge. Reuse Water Production:The feasibility plan would also look at whether treated water could supplement irrigation during drought conditions, recharge local groundwater supplies,and augment local streams, helping address water scarcity. Private Development Dependence on Public Infrastructure A primary private-sector stakeholder in Wiley City is Gilbert Orchards, a major agricultural business that provides critical employment and economic stability to the region. Gilbert Orchards is poised for expansion to meet growing demand, but the current lack of wastewater infrastructure limits its ability to grow.Without a new wastewater solution, Gilbert Orchards and other local businesses face rising maintenance costs for septic systems and restricted growth potential, particularly as state and federal wastewater regulations become stricter.A reliable wastewater solution is essential for Gilbert Orchards to expand operations,increase production,and create new jobs,directly impacting the economic growth of the Wiley City area. The feasibility study and plan proposed would create a plan for the area. However, there should be no implication or other reliance on the City of Yakima moving forward with any recommendations in the plan that would connect the area to City facilities. This application should not be relied upon for any further action by the City to connect the area to City facilities. This application is for the sole purpose of providing the area with a feasibility study and plan, nothing more. SIED funds are requested for the feasibility and planning stages, including engineering analyses, environmental assessments, and cost estimations for the alternative wastewater solutions listed above.These funds will support only the evaluation of the above(A2)to determine future options for the area. No facilities or further construction of any of the options listed in the study or plan are contemplated by the applicant at the time of this application. The sole purpose of this application is to obtain funding for the feasibility study and plan. There should be no expectation that the City will fund or construct options found in the final plan. The feasibility study and plan will help evaluate options for the area's wastewater treatment. Ultimately, a new wastewater solution will alleviate constraints on business expansion, particularly benefiting Gilbert Orchards,a significant employer in the area. Improved infrastructure will also reduce environmental risks, enabling potential residential development and enhancing public health,which is expected to attract more businesses to the region. However, this application is solely to fund the feasibility study and plan and there should be no expectation that the City will fund or construct any option outlined in the final plan. A5. This feasibility study and plan will provide valuable planning information and options with regards to wastewater to the Wiley City/Ahtanum area which may support the expansion of Gilbert Fruit/Gilbert Orchards by enabling them to overcome wastewater limitations currently hindering growth,which would enhance local employment and economic stability. Gilbert plans to add a new cherry packing line which would employ and additional 50-100 people if additional wastewater capacity is feasible and can be constructed. Gilbert Cellars winery and tasting room has also expressed interest in expanding, but for lack of adequate sewer/water treatment. New restaurant and mechanic shop are being remodeled and require sewer connection. Housing developer desires to build on 19 lots, but cannot without sewer connection. The Fair and Rodeo grounds in Wiley City,as well as the Ahtanum Valley Elementary,would benefit from an improved sewer system. C2. Explain why the private development requires the proposed public infrastructure improvements described in this application. This application does not propose public infrastructure improvements,and none are contemplated by the application, or implied with the City's application for the feasibility plan and study. The proposed feasibility study and plan are required because before any decisions or evaluations as to an appropriate and feasible wastewater solution can be constructed,the area needs to know the options, costs, and other details associated with wastewater infrastructure in the area. The plan will provide the basis for any further decisions made by the Wiley City/Ahtanum area residents and businesses moving forward. Further, if the Wiley City/Ahtanum area residents seek to move forward with any of the options in the final plan, it is unlikely that construction of a wastewater treatment facility in the area would move jobs from other parts of the county. It is likely that job opportunities would expand in the WWTP service area if a facility is ultimately constructed. No expanded employment opportunities are anticipated from the completion of the facility study and plan,as they are planning documents and no construction of any facility is required after the plan has been finalized. In the event the Wiley City/Ahtanum area residents are able to move forward with construction of a WWTP facility Gilbert Orchards has indicated it is committed to creating accessible job opportunities for disadvantaged and unemployed workers in Yakima County.The company will work closely with the local workforce development office and community organizations to recruit from within the county and provide job training and advancement opportunities, particularly for entry-level and seasonal roles if it expands after a WWTP facility is constructed. ATTENTION: If a developer is involved in the project, the tenant must also be a party to this agreement or there must be an additional agreement between the developer and the tenant. 2. PURPOSE. The purpose of this Agreement is to clarify the intentions of the parties regarding the completion of THE PUBLIC FACILITIES PROJECT. This section should also contain an explanation of the need for the public improvements. 3. BACKGROUND. The purpose of this section is to provide a description of the public improvements, which can be referenced, thereafter, as"required public improvements" 4. AGREEMENT. This section must contain the following: a) A statement that the applicant agrees to construct the required public improvements providing that SIED financing is approved. b) A statement by the business of the projected number of permanent, full-time jobs created and/or retained as a result of the public facilities project. (Attention. Job estimates identified here must equal those in Question C5) c) A statement by the business of the estimated private capital investment. d) An agreement by the business to contact the local One-Stop Career Center, Job Service Center, or appropriate Community Based Organization for assistance in filling new positions e) An agreement by the business to provide the applicant with employment and investment data as requested by SIED. f) If applicable, this section must also contain a list of any public and/or private contributions to the public facilities project, such as cash contribution or donated land. 5. CONTINGENCY. This Agreement is contingent upon receipt of SIED funds by THE APPLICANT and is intended to meet the first level of convincing evidence of private development as required by SIED. For Meeting of: January 14, 2025 ITEM TITLE: Resolution authorizing submittal of a SIED grant application for a feasibility study on wastewater infrastructure around the Wiley City area SUBMITTED BY: Bill Preston, Community Development Director *Trevor Martin, Planning Manager SUMMARY EXPLANATION: The City of Yakima has been notified that grant funds may be available to conduct a feasibility study to evaluate the options for addressing domestic and industrial wastewater in the Wiley City area upon submission of a SIED grant application. The City of Yakima has been approached and asked to apply and administer such grant to conduct this study. The need for this study is outlined in the attached draft grant application.
