YAKIMA CITY COUNCIL MINUTES
December 10, 2024

5:30 PM City Council Regular Meeting — Conducted in person and virtually via Zoom.
1. Roll Call
Present: Mayor Patricia Byers, presiding; Assistant Mayor Matt Brown and Councilmembers
Reedy Berg, Janice Deccio, Rick Glenn, Danny Herrera and Leo Roy
Staff: City Manager Vicki Baker, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra
2. Pledge of Allegiance
Mayor Byers led the Pledge of Allegiance.
3. Interpreter Services
Mayor Byers introduced Jorge Villasenor who announced interpreter services are available
in Spanish.
4. Public Comment
Joe Daniels, City resident, read religious passages.
Joe Mann, downtown business owner, spoke in support of the City's DYBID downtown
beautification program.
Jeanna Hernandez, City resident, encouraged the Council to focus on setting policy as
opposed to micromanaging other efforts.
5. Open Discussion for the Good of the Order
A. Council Nominating Committee recommendations regarding appointments to boards,
commissions, and committees
Council member Deccio reported on the November 25, 2024, Council Nominating
Committee meeting.
The Nominating Committee's recommendation for appointments:
. Yakima Arts Commission - Margot Stroop (Yakima Valley Museum position) and
Kimberly Ruck (Yakima Symphony Orchestra position)
The Nominating Committee's recommendation for re-appointments:
. Lodging Tax Advisory Committee (LTAC) - Charles Robin, Luis Gutierrez, and
Lisa Vallejo
MOTION: Brown moved and Berg seconded to approve the Council Nominating
Committee recommendation. The motion carried by unanimous vote.

6. Council Reports
None.
7. Consent Agenda
Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there
were any additions or deletions from Council members present. Items I, J and S were removed
from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions
and ordinances, by title. (Items on the Consent Agenda are handled under one motion without
further discussion—see motion directly below.)
MOTION: Deccio moved and Brown seconded to approve the consent agenda as read. The
motion carried by a 7-0 roll call vote.
A. Approval of minutes from the December 3, 2024 City Council regular meeting
B. Set date of January 7, 2025, for public hearing and approval of an Interlocal Agreement for
the 2024 Justice Assistance Grant (JAG) Program
C. Approve payment of disbursements for the period November 1-30, 2024
D. November 2024 Investment Transaction Report
E. Project Completion and Contract Acceptance for Tri-Valley Construction Inc for the S. 2nd
Avenue Water Main Replacement Project AC2792

RESOLUTION NO. R-2024-215, A RESOLUTION amending Financial Management
Policy 3-190 for the City of Yakima.
H. Resolution updating financial policy 3-200: Fund Balance for General Fund & Operating
Reserve
RESOLUTION NO. R-2024-216, A RESOLUTION amending the Fund Balance for General
Fund and Operating Reserve Requirements for Enterprise Funds, Policy Number 3-200, for
the City of Yakima.

K. Resolution authorizing an agreement with Connetix Engineering, Inc. to provide
engineering services for City of Yakima Project WF2837 Wastewater Treatment Plant
SCADA System Upgrade
RESOLUTION NO. R-2024-219, A RESOLUTION authorizing an agreement with
Connectix Engineering, Inc. to provide engineering services for City of Yakima Project
WF2837 Wastewater Treatment Plant SCADA System Upgrade.
L. Resolution authorizing an agreement with City of Yakima Public Works for CDBG funding
for construction of the Aquatic Center at Martin Luther King, Jr. Park
RESOLUTION NO. R-2024-220, A RESOLUTION authorizing an amendment to the
agreement between the City of Yakima and City of Yakima Public Works to use
Community Development Block Grant (CDBG) funds for the construction of the Aquatic
Center at Martin Luther King, Jr. Park.

M. Resolution authorizing an Interlocal Agreement with Washington Traffic Safety
Commission to provide funding for a law enforcement liaison
RESOLUTION NO. R-2024-221, A RESOLUTION authorizing the City Manager of the City
of Yakima to execute an Interlocal Agreement with the Washington Traffic Safety
Commission for funding a Law Enforcement Liaison.
N. Resolution authorizing a lease agreement with Yakima MSA Limited Partnership for a
tower and ground space lease located at Fire Station 93
RESOLUTION NO. R-2024-222, A RESOLUTION authorizing the City Manager to execute
a Lease Agreement with Yakima MSA Limited Partnership for attachment locations upon
the tower located at Fire Station 93 with an address of 511 N. 40th Avenue as well as a
parcel of ground space adjacent to the base of the Tower.
O. Resolution authorizing a professional services agreement with BERK Consulting Inc. for
the City of Yakima's Periodic Update, Climate Resilience Element, and Transportation Plan
Update
RESOLUTION NO. R-2024-223, A RESOLUTION authorizing the City Manager to execute
a Professional Services Agreement with BERK Consulting to facilitate and assist in the
state mandated update of the City's Comprehensive Plan Periodic Update, in compliance
with the Growth Management Act.
P. Resolution authorizing a Community Aviation Revitalization Board (CARB) Loan
Application with the Washington State department of Transportation (WSDOT) for the
Yakima Air Terminal-McAllister Field
RESOLUTION NO. R-2024-224, A RESOLUTION authorizing a Community Aviation
Revitalization Board (CARB) Loan Application with the Washington State Department of
Transportation (WSDOT) for the Yakima Air Terminal-McAllister Field.
Q. Ordinance amending the 2024 Budget for the City of Yakima and making appropriations
from unappropriated fund balances within various funds for expenditure during 2024 for
various purposes (Second Reading)
ORDINANCE NO. 2024-044, AN ORDINANCE amending the 2024 Budget for the City of
Yakima; and making appropriations from Unappropriated Fund Balances within various
funds for expenditure during 2024 for various purposes.
R. Ordinance adopting the City Council's decision on the Comprehensive Plan Amendment
(CPA#004-24) and Rezone (RZ#004-24) for property in the vicinity of 2300 E. Birch Street
ORDINANCE NO. 2024-045, AN ORDINANCE amending the Future Land Use Map and
Zoning Map of the City of Yakima for parcel 191329 -41410 as follows: Future Land Use
Map from Low Density Residential to Commercial Mixed Use, and Zoning Map from
Suburban Residential (SR) to General Commercial (GC).

T. Ordinance updating Classification and Compensation Plan for City Employees Section
2.20.100
ORDINANCE NO. 2024-047, AN ORDINANCE relating to City personnel; adopting a
classification and compensation plan for City employees to be effective January 13, 2025
and repealing all preceding pay ordinances in the City of Yakima Municipal Code.

MOTION: Brown moved and Deccio seconded to approve Items I and J. The
motion carried by 7-0 roll call vote.
S. Ordinance amending Yakima Municipal Code Chapter 12 Development Standards
relating to construction of public improvements
ORDINANCE NO. 2024-046, AN ORDINANCE amending the City of Yakima Municipal
Code Chapters 12.01 and 12.20 relating to construction of public improvements.

MOTION: Brown moved and Deccio seconded to pass the ordinance for Item S.
The motion carried by 7-0 roll call vote.
8. Public Hearings
None.
9. Department Items
A. Discussion about developing an Adopt-A-Block program
City Manager Vicki Baker presented a concept for an "Adopt a Block" program in the
City of Yakima. Meloney Rosen, Executive Director of Yakima Valley Habitat for
Humanity, described a potential public-private partnership opportunity to revitalize
Yakima neighborhoods. Randy Bonds, IT Services Supervising Senior Analyst,
demonstrated the interactive platform for the proposed Adopt-A-Block program.
B. Discussion to evaluate alternate options for maintaining DYBID
City Manager Vicki Baker introduced the discussion and informed the Council of the
current agreement with the Downtown Association of Yakima (DAY) for downtown
maintenance and beautification services which expires December 31, 2028. The
current scope of work includes, but is not limited to, trash and graffiti removal,
landscape maintenance, pressure washing, safety services, and snow removal. Other
services provided by the City of Yakima include irrigation water, flowers, and police
presence at DAY events, for a total annual cost of approximately $265,000.

City Manager Baker presented alternative options and quotes provided from other
contractors, including providing in-house maintenance by adding two new positions to
cover these services.
After Council discussion,
MOTION: Brown moved and Deccio seconded to send this to the DYBID advisory
group to discuss the alternative options and any other ideas and report back to
Council in 45 days. The motion carried by unanimous consent.
C. Resolution creating an ad hoc budget advisory committee
City Attorney Sara Watkins briefed the Council on the proposed resolution to create an
ad hoc budget advisory committee to advise the City Council on matters concerning
the City's budget, priority-based budgeting and strategies, and revenue and
expenditure options.

MOTION: Deccio moved and Brown seconded to adopt the resolution. The motion
carried by a 7-0 roll call vote.
RESOLUTION NO. R-2024-225, A RESOLUTION creating an ad hoc budget advisory
committee.
D. Resolution rescinding resolution R-2024-193, passed on October 15, 2024, and
authorizing the dedication of opioid settlement money to support the Community
Diversion Court for five years, to be used for opioid abatement approved strategies, with
an option to extend another five years
Senior Assistant City Attorney Cynthia Martinez briefed the Council on the updated
resolution clarifying the amount to be dedicated and the specific Opioid Abatement
Strategies.

MOTION: Brown moved and Deccio seconded to adopt the resolution. The motion
carried by a 7-0 roll call vote.
RESOLUTION NO. R-2024-226, A RESOLUTION rescinding Resolution No. R-2024-
193, passed on October 15, 2024, and authorizing the City Manager to dedicate opioid
settlement money to support the Community Diversion Court for five (5) years at
$419,591, to be used for opioid abatement approved strategies, with an option to
extend another five (5) years.
E. Resolution authorizing an agreement with People for People for the City of Yakima
Community Diversion Court through December 2029
Senior Assistant City Attorney Cynthia Martinez briefed the Council on the proposed
resolution for case management and programming services with People for People for
the City of Yakima Community Diversion Court through the Yakima Municipal Court
beginning in January 2025.

MOTION: Deccio moved and Brown seconded to adopt the resolution. The motion
carried by a 7-0 roll call vote.

RESOLUTION NO. R-2024-227, A RESOLUTION authorizing an agreement with People for
People to provide assessment, case management services, treatment referral, and return-to-
work education programming for the City of Yakima Community Diversion Court through
December 2029.
F. Ordinance amending City of Yakima Municipal Code Section 6.56.050 Depositing or burning
material
Senior Assistant City Attorney Cynthia Martinez briefed the Council on the proposed
ordinance relating to unlawful burning on public property.

MOTION: Brown moved and Deccio seconded to pass the ordinance. The motion
carried by a 7-0 roll call vote.
ORDINANCE NO. 2024- 048, AN ORDINANCE amending the City of Yakima Municipal
Code section 6.56.050, Depositing or burning material.
10. City Manager Update
City Manager Baker expressed appreciation working with Council and looking forward to
2025.
11. Other Business
MOTION: Glenn moved and Brown seconded to have a future discussion regarding
homelessness issues and positive solutions to actively reduce that problem. The
motion carried by unanimous vote.
MOTION: Byers moved Berg seconded to have a future study session on land use
basics, middle housing legislation, and the comprehensive plan process. The motion
carried by unanimous vote.
12. Adjournment
MOTION: Brown moved and Deccio seconded to adjourn to the next City Council study
session on December 17, 2024, at 5:00 p.m. in the Council Chambers at City Hall. The
motion carried by unanimous vote. The meeting adjourned t 6:57 p.m.
