ITEM TITLE: Resolution authorizing an agreement with HLA Engineering & Land
Surveying Inc for 34th Avenue/Fruitvale/River Rd Boulevard
Roundabouts Project 2447

SUMMARY EXPLANATION:
The 34th Avenue/Fruitvale/River Road Roundabouts Project 2447 consists of installing 2 roundabouts.
One at 34th Avenue & Fruitvale Boulevard and one at 34th Avenue & River Road. Work includes curb,
gutter, sidewalk, drainage, water, sewer, paving and illumination.
The City of Yakima desires to enter into a Professional Services Agreement with HLA Engineering &
Land Surveying Inc for construction engineering services. The agreement is an amount not to exceed
$599,500.00.
The federal project funding includes HSIP, NHFP, TIB, and HLP.
ITEM BUDGETED: Yes
STRATEGIC PRIORITY 24-25: A Resilient Yakima

RESOLUTION NO. R-2024-
A RESOLUTION authorizing an agreement with HLA Engineering and Land Surveying, Inc.
to provide professional construction management, observation and
administration services for the 34th Ave/Fruitvale/River Rd Roundabouts
Project 2447.
WHEREAS, the 34th Avenue/Fruitvale/River Road ROB Project(Project) requires
construction management and the City of Yakima (City) cannot provide such management for
this project; and,
WHEREAS, the Project consist of constructing dual roundabouts; one at the
intersection of 34th Ave and Fruitvale Boulevard and one at River Road and 34th Ave.;
sidewalks, bike lanes, drainage and other work; and
WHEREAS, the City used the procedure established by Washington State law for the
bidding and awarding of public capital improvement projects; and
WHEREAS, HLA was determined to be qualified to perform the needed professional
construction management work and selected to provide professional construction management,
observation, and administrative services, as needed by the City for this Project; and
WHEREAS, the Project received federal funds of HSIP and NHFP, and state funds of
TIB and Supplemental Transportation; and,
WHEREAS, the City Council of the City of Yakima finds that entering into the
Professional Services Agreement with HLA for construction management on the Project is in the
best interests of the City and its residents, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute a Professional Services Agreement
with HLA Engineering and Land Surveying, Inc., attached hereto and incorporated herein by this
reference, not to exceed Five Hundred and Ninety-Nine Thousand Five Hundred Dollars
($599,500) to provide construction management services and services outlined in the
Professional Services Agreement.

Section 1: Supplemental Agreement
The City of Yakima, Washington desires to supplement the Original Contract No. 2022-139 entered
into with HLA Engineering and Land Surveying, Inc., and executed on August 16, 2022, by
Resolution No. R-2022-108 and identified as Contract 2022-139; Supplement No. 1 executed
November 20, 2023. All provisions in the basic contract remain in effect except as expressly
modified by this supplement. The changes to the agreement are described as follows:
Section 2: Scope of Services
Supplement No. 2 provides Construction Observation and Administration services and materials
testing for the Fruitvale Boulevard/River Road/34th Avenue Roundabouts - Construction
Engineering project. See attached Exhibit A for Scope of Services.
Section 3: Term
Section 3,1 shall be replaced with the following:
The term for this Agreement shall be from the date of signature of both parties through
December 31, 2025.

Section 6: Compensation
The first paragraph of Section 6.1 shall be replaced with the following:
COMPENSATION ON A TIME SPENT BASIS AT SPECIFIC HOURLY RATES: For the
services described in EXHIBIT A, compensation shall be according to EXHIBIT B -
Schedule of Rates, attached hereto and incorporated herein by this reference, on a time
spent basis plus reimbursement for direct non-salary expenses. The maximum amount of
compensation to the ENGINEER shall not exceed $1,111,900 without the written
agreement of the CITY and the ENGINEER.
See attached Exhibit B—Schedule of Rates, January 1, 2025, through December 31, 2025.
Section 12: Subcontracts
Revise Section 12.3 as follows:
CITY hereby authorizes the ENGINEER to subcontract with the following persons or firms
for the purpose of completing this AGREEMENT:

Construction Engineering
SCOPE OF SERVICES
9.0 Construction.Engineering
9.1 Provide complete project management throughout the duration of the Project.
9.2 Prepare and issue Notice of Award to the Contractor.
9.3 Coordinate and facilitate preconstruction meeting with the CITY, Contractor, private utilities,
and affected agencies, including preconstruction agenda and meeting record.
9.4 Prepare and issue Notice to Proceed to Contractor.
9.5 Furnish a field survey crew to provide geometric control, including construction staking,
including structures, water main, sewer main, storm water, subgrade elevations, blue-top
elevations, curb and gutter, sidewalk, and illumination.
9.6 Provide submittal review for PROJECT materials as provided by the Contractor per the
PROJECT Specifications.
9.7 Maintain a record of materials (ROM)for duration of PROJECT.
9.8 Coordinate fabrication and materials inspection with the Washington State Department of
Transportation.
9.9 Attend construction meetings associated with civil improvements, anticipated once per week
during construction of the improvements.
9.10 Furnish a qualified resident engineer(inspector) to observe construction for substantial
compliance with plans and specifications and CITY Construction Standards. Per City
direction, twelve(12) hours per day of on-site observation will be used as an average during
construction.
9.11 Provide materials testing, coordinate testing scheduling with subconsultant, and review
sampling and testing for compliance with the contract.
9.12 Prepare daily construction progress reports, including photographs, of completed work.
9.1 Prepare weekly statement of working days and issue to the contractor.
9.2 Monitor and track all minor changes or other force account work associated with the contract.
9.3 Monitor and track Materials on Hand.
9.4 Prepare and provide monthly progress estimates to the CITY and recommend progress
payments for the Contractor.
9 5 Prepare and submit proposed contract change orders when applicable
9.6 Monitor the Contractor's compliance with federal and state labor standards.

9.7 Monitor the Contractor's compliance with Disadvantaged Business Enterprise (DBE) goals
and reporting requirements.
9.8 Prepare and track Funding Agency Reimbursements related to construction. Anticipated
funding sources include Federal HSIP and Washington State Transportation Improvement
Board.
9.9 Conduct final walkthrough inspection with the Contractor and CITY. Prepare and transmit
punchlist to Contractor.
9.10 Prepare and furnish record drawings and field notes of completed work in accordance with
PROJECT field records provided by the resident engineer and those submitted by the
Contractor.
9.11 Prepare and submit recommendation for PROJECT acceptance.
9.12 Prepare and submit Notice of Completion of Public Works Contract(NOC). Monitor lien
releases from state agencies.
9.13 Notify CITY when retainage may be released.
9.14 Ensure the PROJECT is completed as designed and contract specifications are adhered to
during construction.
TIME OF PERFORMANCE
9.0 Construction Engineering
9.1 Engineering services during construction shall begin upon construction contract award by the
CITY and will extend through the completion of construction, and completion of as-constructed
drawings.
9.2 A maximum of one hundred forty (140) working days has been assumed for the construction
of improvements.
9.3 Should the Contractor be granted time extensions for construction completion due to
recognized delays, requested additional work, and/or change orders, engineering services
beyond one hundred forty (140)working days shall be considered additional services.
FEES FOR SERVICES
9.0 Construction Engineering
For the services furnished by the ENGINEER as described in this EXHIBIT A, the CITY agrees to pay the
CONSULTANT the estimated fee not to exceed $1,111,900. This maximum amount may be revised only
by written agreement of both parties.
All work shall be performed on a time-spent basis at the normal hourly billing rates shown in EXHIBIT B,
plus reimbursement for direct non-salary expenses such as vehicle mileage, advertising, and printing
expenses. Outside subconsultant's invoices shall be marked up by a factor of 1.10 times the
subconsultant invoice
