YAKIMA CITY COUNCIL MINUTES
November 19, 2024

5:30 PM City Council Regular Meeting — Conducted in person and remotely via Zoom.
1. Roll Call
Present: Mayor Patricia Byers, presiding; Assistant Mayor Matt Brown and Councilmembers
Reedy Berg, Janice Deccio (attending remotely via Zoom), Rick Glenn, Danny Herrera and
Leo Roy
Staff: City Manager Vicki Baker, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra
2. Pledge of Allegiance
Mayor Byers led the Pledge of Allegiance.
3. Interpreter Services
Mayor Byers introduced Jorge Villasenor who announced interpreter services are available
in Spanish.
4. Public Comment
Joe Daniels, City resident, read a religious passage.
Norma Haro and Rosalba Mendoza, La Casa Hogar, introduced the citizenship class in
attendance.
Neil Hauff and Reed Pell addressed the application withdrawal of the N. 92nd Avenue right
of way vacation petition as it relates to the overall Columbia Ridge development project.
5. Open Discussion for the Good of the Order
A. Small Business Saturday proclamation
Mayor Byers proclaimed November 30, 2024 as "Small Business Saturday". Kristi Foster
with the Yakima Chamber of Commerce and Curt Wilson with the Downtown Association
of Yakima accepted the proclamation.

7. Consent Agenda
Mayor Byers referred to the items placed on the Consent Agenda, questioning whether
there were any additions or deletions from Council members present. Items H & I were
removed from the Consent Agenda. The City Clerk read the Consent Agenda items,
including resolutions and ordinances, by title. (Items on the Consent Agenda are handled
under one motion without further discussion—see motion directly below.)

MOTION: Brown moved and Herrera seconded to approve the consent agenda. The
motion carried by a 7-0 roll call vote.
A. Approval of minutes from the November 4, 2024 City Council regular meeting and
November 12, 2024 study session
B. 2024 3rd Quarter Financial Report
C. October 2024 Investment Transaction Report
D. Approve payment of disbursements for the period October 1-31, 2024
E. Project Completion and Contract Acceptance for Schneider Equipment Inc for Kissel
Park Well Motor Replacement Project AC2825 EPO 2410E
F. Resolution accepting and approving 3rd Quarter 2024 Claim Report
RESOLUTION NO. R-2024-203, A RESOLUTION accepting and approving the 3rd
Quarter 2024 Claim Report for the City of Yakima.
G. Resolution authorizing the City Manager to execute Supplemental Agreement No. 2 to
Task Order No. 2022-01 entered into with HLA Engineering and Land Surveying, Inc. for
the Water/Irrigation and Wastewater Divisions Low-Income and Unserved Utility Areas
Project AC2570 and SC2605
RESOLUTION NO. R 2024-204, A RESOLUTION authorizing the City Manager execute
Supplemental Agreement No. 2 to Task Order No. 2022-01 entered into with HLA
Engineering and Land Surveying, Inc. for the Water/Irrigation and Wastewater Divisions
Low-Income and Unserved Utility Areas Project AC2570 and SC2605.

J. Resolution authorizing a general services contract with Pacificorp, dba Pacific Power, and
granting an underground right-of-way easement for utility purposes for the Aquatic Center

RESOLUTION NO. R-2024-207, A RESOLUTION authorizing a general services contract
with PacifiCorp, dba Pacific Power, for delivery of power to the aquatic center at Martin
Luther King Jr. Park and authorizing an underground easement for utility purposes.
K. Resolution authorizing a contract with Governmentjobs.com, Inc., dba NEOGOV, for a
payroll and benefits program
RESOLUTION NO. R-2024-208, A RESOLUTION authorizing a contract with
Governmentjobs.com, Inc. (dba "NEOGOV") for a payroll and benefits program.
L. Ordinance amending the 2024 Budget for the City of Yakima and making appropriations
from unappropriated fund balances within various funds for expenditure during 2024 for
various purposes (Second Reading)
ORDINANCE NO. 2024-034, AN ORDINANCE amending the 2024 Budget for the City of
Yakima; and making appropriations from Unappropriated Fund Balances within various
funds for expenditure during 2024 for various purposes.

Items Removed from the Consent Agenda
H. Resolution approving Lease Agreement between the City of Yakima and Makito Aviation,
LLC - Fixed Base Operator (FBO)
RESOLUTION NO. R-2024-205, A RESOLUTION authorizing a Lease Agreement with
Makito Aviation, LLC for property located at 2401 S. 21st Ave, Yakima Air Terminal-
McAllister Field.
I. Resolution approving Lease Agreement between the City of Yakima and Makito Aviation,
LLC - Fuel Farm
RESOLUTION NO. R-2024-206, A RESOLUTION authorizing a Lease Agreement with
Makito Aviation, LLC for property located at 2401 S. 21st Ave, Yakima Air Terminal-
McAllister Field.
The City Clerk read the resolutions by title only.
MOTION: Brown moved and Herrera seconded to approve items H and I of the
consent Agenda. The motion carried by a 7-0 roll call vote.
8. Public Hearings
A. Open record public hearing to consider the Yakima Planning Commission's
recommendation on a Comprehensive Plan Amendment (CPA#004-24) and Rezone
(RZ#004-24) request in the vicinity of 2300 E. Birch Street
Senior Planner Eric Crowell introduced this item and briefed Council on the Yakima
Planning Commission's recommendation.
Mayor Byers administered the Appearance of Fairness Doctrine. Each Councilmember
answered negatively or affirmatively to the following questions:
1. Do you have any interest in the property or the application, or do you own property
within 300 feet of the property subject to the application? All Council members
responded they did not.
2. Do you stand to gain or lose any financial benefit as a result of the outcome of
this proposal? The response from Council members was no.
3. Can you hear and consider the application in a fair and objective manner, without
bias? All Council members stated they could.
4. Have you had any ex parte communications with the Applicants, or anyone else,
regarding this application? All Council members responded no. Councilmember
Glenn indicated he had heard some of the Planning Commission's discussions.
Mayor Byers asked if anyone wished to challenge any Council member's participation
in this application on appearance of fairness grounds? No one spoke to the issue.
Mayor Byers opened the public hearing.
James Carmody, representing RWC trucking business, stated they are not opposed
to the comprehensive plan amendment and rezone request, however expressed
concern that the purpose and use of the proposed development does not align with
the General Commercial designation. City Attorney Sara Watkins clarified that the
future use of the proposed development is not part of this public hearing.
With no one else coming forward or calling in to speak, Mayor Byers closed the
public hearing.

MOTION: Deccio moved and Brown seconded to direct staff to prepare
legislation approving the future land use map amendment and rezone. The
motion carried by a 7-0 roll call vote.
B. Closed record public hearing and Resolution to consider the Yakima Planning
Commission's recommendation regarding the preliminary plat of Rainier Court
Phase 5 submitted by Columbia Ridge Homes LLC, located in the vicinity of 406 N.
92nd Avenue
Senior Planner Eric Crowell introduced this item and briefed Council on the Yakima
Planning Commission's recommendation.
Mayor Byers stated this is a closed record hearing and testimony will be limited to the
record regarding the preliminary plat. Mayor Byers administered the Appearance of
Fairness Doctrine. Each Councilmember answered negatively or affirmatively to the

Reed Pell, on behalf of Mr. and Mrs. Hauff, spoke against approval of the preliminary
plat of Rainier Court Phase 5 submitted by Columbia Ridge Homes LLC.
Jeff Peters of PLSA, on behalf of the Columbia Ridge Homes LLC developer Justin
Hellem, spoke in favor of the preliminary plat of Rainier Court Phase 5.
With no one else coming forward or calling in to speak, Mayor Byers closed the
public hearing.
The City Clerk read the resolution by title only.
Following Council deliberation,
MOTION: Brown moved and Deccio seconded to affirm the decision of the
Yakima Planning Commission's and adopt the resolution. The motion carried by
a 7-0 roll call vote.
RESOLUTION NO. R-2024-209, A RESOLUTION approving the Preliminary Long
Plat of Rainier Court Phase 5, a 22-lot subdivision, located in the vicinity of 406 N.
92nd Ave.

C. Public hearing and Ordinance to consider the Yakima Planning Commission's
recommendation regarding text amendments to YMC Title 14 - Subdivisions, Title 15
- Yakima Urban Area Zoning Ordinance, and Title 16 -Administration of
Development Permit Regulations
City Attorney Sara Watkins briefed the Council on the proposed text amendments that
would require final decisions of the Hearing Examiner be appealed directly to the
Superior Court allowing for a more streamlined process.
Mayor Byers opened the public hearing.
Jeanna Hernandez, City resident, urged City Council to pass the ordinance.
With no one else coming forward or calling in to speak, Mayor Byers closed the hearing.
The City Clerk read the ordinance by title only.
After Council discussion and deliberation,
MOTION: Brown moved and Berg seconded to approve the Yakima Planning
Commission's recommendation and pass the ordinance. The motion carried by
a 7-0 roll call vote.
ORDINANCE NO. 2024-035, AN ORDINANCE amending Yakima Municipal Code
Titles 14, 15, and 16 to incorporate text amendments associated with appeals of land
use decisions.
D. Second public hearing on the 2025-2026 Preliminary Biennial Budget for the City of
Yakima
Director of Finance and Budget Viren Mayani briefed the Council on the 2025-2026
Preliminary Biennial Budget and reiterated the current budget forecast challenges.
Mayor Byers opened the public hearing. With no one coming forward or calling in to
speak, Mayor Byers closed the public hearing.
9. Department Items
A. Presentation on the 2025-2029 Consolidated Plan process required by the U.S.
Department of Housing and Urban Development (HUD)
Community Development Director Bill Preston introduced Elizabeth McNannay and
Loren McNeely of Resource Consultants LLC who described and outlined the
process for updating the 2025-2029 Consolidated Plan. The draft plan will be
available for future public hearings with additional public participation opportunities.
B. Resolution authorizing a grant agreement with the Washington Auto Theft Prevention
Authority (WATPA) to purchase pursuit intervention equipment
Yakima Police Sergeant Eric Jones briefed the Council on the proposed resolution.

MOTION: Brown moved and Deccio seconded to adopt the resolution. The
motion carried by a 7-0 roll call vote.
RESOLUTION NO. R-2024-210, A RESOLUTION approving a Memorandum of
Understanding between the City of Yakima Police Department and the Washington
Auto Theft Prevention Authority (WATPA), in which the Yakima Police Department
has received funds through WATPA for the purchase of three (3) Police Grappler
Systems.
C. Ordinance to create a fund to account for Opioid Settlement Revenue (First Reading)
Director of Finance and Budget Viren Mayani briefed the Council on the first reading
of a proposed ordinance to create a fund for the Opioid Settlement Revenue.
The City Clerk read the ordinance by title only.

Revenue.
D. Ordinance to create a fund to account for Yakima Police Department Pension (First
Reading)
Director of Finance and Budget Viren Mayani briefed the Council on the first reading
of a proposed ordinance to create a fund for the Yakima Police Department Pension.
Mr. Mayani specified that this fund would be restricted to the LEOFF 1 Pension only.
The City Clerk read the ordinance by title only.
First Reading of An Ordinance to create a fund to account for Yakima Police
Department Pension.
E. Ordinance amending the City of Yakima Municipal Code Section 5.96.020 relating to
ambulance services
Yakima Fire Chief Aaron Markham briefed the Council on the proposed ordinance
relating to ambulance services.
The City Clerk read the ordinance by title only.
MOTION: Brown moved and Roy seconded to pass the ordinance. The motion
carried by a 7-0 roll call vote.
ORDINANCE NO. 2024-036, AN ORDINANCE amending City of Yakima Municipal
Code Section 5.96.020 relating to ambulance services.
10. City Manager Update
City Manager Baker provided an update on the budget process and requested a workshop
for November 26th

AMENDED MOTION: Brown moved and Deccio seconded to have a budget
workshop meeting on November 26, 2024 at 5:30 p.m. at the Yakima Convention
Center. The motion carried by unanimous vote.
11. Other Business
MOTION: Brown moved and Berg seconded to add to a future agenda a discussion
of the [Substitute House Bill] 1406 affordable housing sales tax dollars. The motion
carried by unanimous vote.
MOTION: Herrera moved and Brown seconded to direct staff to discuss at a future
study session in 2025 an overview of the City's policy regarding speed bumps and
how to apply for one. The motion carried by unanimous vote.
Councilmember Herrera recognized the recent accomplishments of local high school
youth sports teams.
12. Adjournment
MOTION: Brown moved and Glenn seconded to adjourn to the next City Council
special meeting on November 26, 2024, at 5:30 p.m. at the Yakima Convention Center.
The motion carried by unanimous vote. The meeting adjourned at 7:26 p.m.
