AN ORDINANCE adding a new chapter in the Yakima Municipal Code, Chapter
1.49, authorizing the establishment of a pension trust fund 613
"Police Relief and Pension Fund."
WHEREAS, the City of Yakima provides pension, medical, and disability benefits
for LEOFF I and the prior pension acts; and
WHEREAS, The City of Yakima Police Relief and Pension Board sits as the local
administrative body for the administration of the fund for LEOFF I and the prior pension
acts pursuant to the Revised Code of Washington Chapter 41.20; and
WHEREAS the City desires to establish a pension fund entitled "Police Relief
and Pension Fund" to segregate revenues collected and the expenditures incurred to
meet the objectives of the Yakima Police Relief and Pension Board; and
WHEREAS City Staff has determined that the creation of the Police Relief and
Pension Fund is in the best interest of the City of Yakima to facilitate the accounting and
recording of revenues and expenditures associated with the Yakima Police Relief and
Pension Board; now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Council does hereby incorporate the above recitals as
findings in support of this ordinance to establish a pension trust fund to account for the
revenues and relevant expenditures associated with the Police Relief and Pension Board.
Section 2. There is hereby added a new City of Yakima Municipal Code Chapter
1.49, Police Relief and Pension Fund for the purpose of segregating revenues received
through and expenditures eligible pursuant to the ordinance and reads as follows:

Police Relief and Pension Fund
Sections:
1.49.010 Creation of Police Relief and Pension Fund.
1.49.010 Operation of Fund.
1.49.010 Creation of Police Relief and Pension Fund.
There is hereby created a pension trust fund known as the Police Relief and Pension
Fund.
1.49.020 Operation of Fund.

The operation and all rules for this fund are governed by the Revised Code of Washington
Chapter 41.20 as written or hereby amended.
Section 3. This ordinance is one making appropriation and shall take effect immediately
upon its passage, approval and publication as provided by law and by the City Charter.
Section 4. If any section, subsection, paragraph, sentence or clause of this ordinance is
declared invalid or unconstitutional for any reason, such decision shall not affect the
validity or constitutionality of the remaining portions of the ordinance.

SUMMARY EXPLANATION:
The City of Yakima Police Relief and Pension Board sits as the local administrative body for the
administration of the fund for LEOFF I. Effective management of these funds is crucial for accountability
and transparency. City staff recommends maintaining the opioid settlement funds in a separate account
to ensure clear tracking of expenditures and promote public trust, which is beneficial for Yakima and its
residents.
