For Meeting of: November 26, 2024 ITEM TITLE: Ordinance amending City of Yakima Municipal Code Section 3.85.020, Aquatic Center at Martin Luther King Jr. Park Fund SUBMITTED BY: Scott Schafer, Public Works Director SUMMARY EXPLANATION: The increase of the stormwater in-lieu tax from 15% to 20°/o is intended to provide necessary funding for the operation of the new Aquatic Center at Martin Luther King Jr. Park which is anticipated to open in June 2025. The 5°/o would generate approximately $220,000 per year to the General Fund which would then be dedicated to the Aquatic Center at Martin Luther King Jr. Park Fund. Attached for review is the revised Yakima Municipal Code Chapter 3.85.020; redlined version and a clean version. WHEREAS, Chapter 3.85 of the Yakima Municipal Code establishes the Aquatic Center at Martin Luther King Jr. (MLK Jr.) Park Fund for the City of Yakima, which pays for the operation of the Aquatic Center at MLK Jr. Park; and WHEREAS, on November 19, 2024, the City Council approved an increase in the stormwater in-lieu tax under YMC 7.64.040 from 15% to 20%; and WHEREAS, the increase in stormwater in-lieu tax is intended to provide necessary funding for the operation of the Aquatic Center at MLK Jr. Park; and WHEREAS, The City Council of the City of Yakima finds and determines that YMC 3.85.020 should be amended to reflect the funding source for the operation of the Aquatic Center at MLK Jr. Park, and the amendment is in the public interest and best interest of the City and its residents; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 3.85.020 of the City of Yakima Municipal Code is hereby amended to read as follows: 3.85 Aquatic Center at Martin Luther King Jr. Park Fund 3.85.010 There is hereby a fund created to be known as the aquatic center at Martin Luther King Jr. Park fund. 3.85.020 The aquatic center at Martin Luther King Jr. Park fund shall consist of money collected from the aquatic center at Martin Luther King Jr. Park activities and money collected in stormwater tax imposed under YMC 7.64.040, contributions for the park's purposes from private sources, or contributions from other city funds as authorized by the city council, and may be further supported by budget allocation of the property tax or other revenue source not restricted in use by law. 3.85.030 The money in the aquatic center at Martin Luther King Jr. Park fund may be used to meet any expense incurred by the city of Yakima in the course of its operation of the aquatic center at Martin Luther King Jr. Park; provided, that no expenditures shall be made from such fund unless the city council shall approve such expenditure by passing an ordinance appropriating money within the fund for the purpose for which the expenditure is to be made or by including an appropriation for such purpose in the budget. Section 2. This ordinance is one making appropriation and shall take effect immediately upon its passage, approval, and publication as provided by law and by the City Charter. 7 PASSED BY THE CITY COUNCIL, signed and approved this 19th day of November, 2024.
