A RESOLUTION authorizing the purchase of a used 2001 Kovatch Mobile Engine (Water
Tender), from the Town of Little Elm Fire Department, Texas, and reciting
special market conditions
WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal
Code Chapter 1 80 generally requires that purchases over $25,000 be done by competitive
bidding, subject to certain exceptions, and
WHEREAS, the City has entered into an agreement with Yakima County Fire District No.
11, as authorized by Resolution No 2015 -150, whereby the City agreed to acquire and maintain
a water tender truck for suppression purposes within the City of Yakima and Yakima County Fire
District No. 11, and for which the fire district has agreed to reimburse the City of Yakima in the
amount of $75,000 toward purchase of such equipment; and,
WHEREAS, the Town of Little Elm, Texas owns a used 2001 Kovatch Mobile Engine,
Serial Number 4945 which it has declared surplus to the uses and needs of the Little Elm Fire
Department and has offered to sell such equipment to the City of Yakima for $120,000, and
WHEREAS, City of Yakima Fire Department staff has inspected the unit and found it to
be of excellent shape and value, with estimated fair market value exceeding the $120,000
purchase price, and
WHEREAS, City of Yakima Fire Department staff have conducted a search and no other
used equipment was found that meets the needs of the City; and
WHEREAS, pursuant to RCW 39.04.280(1)(b), any requirement for competitive bidding
for the acquisition of the above - described equipment is hereby waived due to the following special
market conditions:
(a) The described vehicle and equipment is used equipment for which the development
of bid specifications is impractical, inefficient and so general in nature as to be
ineffective to solicit and support any responsive bid,
(b) No readily ascertainable market exists for the purchase and sale of used fire
equipment of the type described above;
(c) The described vehicle and equipment is currently owned by another municipality and,
pursuant to the principles and purposes of Chapter 39.34 RCW, municipalities have
the ability to negotiate the sale and disposition of municipal property on terms and
conditions mutually agreeable to such municipalities. The purchase and sale of the
fire equipment described above has been negotiated between the respective
municipal corporations, and concerns the single sale and acquisition of the described
property; and
WHEREAS, the City Council finds that it is in the best interests of the City to approve the
purchase of the equipment described above, and that such approval will enable the City to provide
necessary and appropriate fire prevention and firefighting services; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The City Council finds and determines that special market conditions exist
justifying the waiver of competitive bidding in this acquisition, which bidding requirements are
hereby waived
Section 2. The purchase of the fire equipment, together with all fixtures and
associated equipment as described above, for the amount of $120,000, from the Town of Little
Elm, Texas, is approved
Section 3. The City Manager, or his designee, is hereby authorized to accomplish the
purchase of such equipment, and to execute any and all documentation to accomplish such
purchase.

ITEM TITLE: Resolution authorizing the purchase of a used water tender, and
waiver of the competitive bidding process

SUMMARY EXPLANATION:
On September 1, 2015, Resolution No. R- 2015 -110 was adopted by the City Council which
authorized the City of Yakima and Yakima County Fire District No. 11 to enter into an agreement
for services where the City of Yakima would provide services to the residents within the
geographical area of Yakima County Fire District No. 11 equivalent to the services provided to the
residents of Yakima.
Unfortunately, there is a large area within Yakima County Fire District No. 11 that does not have
fire hydrants or infrastructure to provide a water supply for fire suppression. Resolution No. R-
2015 -150 authorized the acquisition and use of a Water Tender truck (a mobile water
supply) for fire suppression purposes, which would be owned by the City of Yakima. In this
agreement, Yakima County Fire District No. 11 agreed to contribute $75,000 toward the purchase
of the Water Tender truck and associated equipment.
After researching the market for a Water Tender, a low mileage used truck that meets the needs
of the City of Yakima Fire Department (Fire Department) was located in Little Elm, Texas. The
Town of Little Elm has installed hydrants since they purchased the Water Tender, and they are
now surplusing it. The Town of Little Elm, Texas has agreed on a selling price of $120,000.
During the search, most other units were converted over - the -road trucks with much higher
mileage and price.
The Fire Department hasCapital Funds budgeted for this item. The Fire Department is asking the
City Council to authorize purchase of this Water Tender, and waive the requirement for
competitive bidding per RCW 39.04.280(1)(b) due to special market conditions.
