F Planning Division ' 129 North Second Street,2nd Floor Yakima, Washington 98901 4,''r1`'FORArtrf, '��b` Phone (509) 575-6183 • Fax (509) 575-6105 • Email:ask.planning@yakimawa.gov YAKIMA PLANNING COMMISSION RECOMMENDATION TO THE YAKIMA CITY COUNCIL FOR AMENDMENT TO YAKIMA MUNICIPAL CODE September 25, 2024 WHEREAS, Pursuant to RCW 36.70A.130(1) the City is required to take legislative action to review and revise its development regulations in accordance with the Growth Management Act; and WHEREAS, These updates to Yakima Municipal Code (YMC) Title 14, 15 and 16 are considered to be a non-project application without a specific use or site plan to be considered; and WHEREAS, Under the provisions of YMC Ch. 1.42 the Yakima Planning Commission is responsible for the review of amendments to the City's Yakima Zoning Ordinance, Subdivision Ordinance, and other land use matters, and for recommending the approval, modification, or denial of each amendment; and WHEREAS, The Yakima Planning Commission held study sessions to review the proposed amendments on April 24, 2024 and May 8, 2024; and WHEREAS, All required public notice for these amendments were provided, in accordance with the provisions of YMC Ch. 16.10, on August 1, 2024; and WHEREAS, SEPA Environmental Review for these updates was considered, a revised Determination of Nonsignificance was issued on August 23, 2024; and WHEREAS, The Yakima Planning Commission held an open record public hearing on September 11, 2024, to hear testimony from the public, consider the amendments, and provide a recommendation to the Yakima City Council; Now therefore, the Yakima City Planning Commission presents the following findings and recommendation to the Yakima City Council: Based upon a review of the information contained in the application, staff report, exhibits, and other evidence presented at an open record public hearing held on September 11, 2024, the Planning Commission makes the following: PURPOSE AND DESCRIPTION OF PROPOSED AMENDMENTS: The complete track changes text can be found in Exhibit "A" and is incorporated herein by reference. A summary of the amendments is as follows DOC. Yakima WasiaLdi 2015 1994 1. YMC § 14.15.060 Findings and conclusions a. Adding a section reference to 14.15.020 and 14.50. 2. YMC § 14.35.130 Appeals a. Adding a section reference to 14.50. Staff Analysis:Adding reference sections to the code removes any potential ambiguity and provides a specific reference for City staff and the general public. 3. YMC § 14.20.270 Plat vacation—Criteria for approval a. Removing city council and See YMC Chapter 14.50 for appeal procedures. 4. YMC § 14.20.290 Plat alteration—Criteria for approval a. Removing city council and See YMC Chapter 14.50 for appeal procedures. Staff Analysis: Removing the City Council does not remove or restrict any applicant from appealing a staff or hearing examiner decision. This proposal would streamline the process to the Yakima Superior Court. Currently the City has an appeal to City Council option for any land use decisions, however, the Council does not readily have the expertise or training to craft findings and weight in on land use decisions. This change require appeals to be submitted to Yakima Superior Court, which has a process under the Land Use Petition Act (LUPA) to adequately heard and make determinations on land use applications. Making this change would help reduce liability from the City of Yakima, while ensuring the appeals were head by qualified hearing bodies. 5. YMC § 15.13.070 Appeals a. Changing the reference from 15.16.030 to 15.16.005. Staff Analysis: YMC§ 15.16.030 no longer exists within the Municipal Code and the citation should be changed to 15.16.005, which is consistent with the Appeals section. 6. YMC § 15.20.040 Hearing examiner—Duties and powers a. Removing to legislative body and YMC § 15.16.060, and adding a citation for YMC § 16.08.025. b. Changing home occupations to interpretation requests. c. Adding Unclassified home occupations decisions. d. Adding a code reference to Revocation proceedings under YMC Chapter 15.24. Staff Analysis: YMC § 15.16.060 currently does not exist within the Municipal Code, adding the correct reference for 16.08.025 for the appeal of the Hearing Examiners decisions would alleviate any future confusion. For home occupations, City staff processes home occupation requests, adding interpretation requests and unclassified home occupations would help add clarity to a land use determination that does not currently exist in the municipal code. Adding a reference for 15.24 would all add clarity for the revocation process. 7. YMC § 15.13.070 Appeals a. Changing the reference from 16.08.030 to 16.08. 8. YMC § 15.15.O7OAppeals a. Staff Analysis: This proposed change is intended to streamline review for appeals of Hearing Examiner and staff administrative decisions. 16.08 is the Municipal code appeals chapter for all land use decisions. This chapter specifically outlines how to apply for an appeal and how the appeal should be processed. Removing the legislative body language and specifically point to a chapter where the appeals chapter is held would remove ambiguity and add clarity to the appeal process. 11. YMC § 15.29.100 Wireless conditional use permit criteria a. Adding a reference to YMC § 15.29.050. b. Removing the language city council in accordance with YMC 16.08.030 and adding Yakima Superior Court. 12. YMC § 15.19.110 Wireless height variance a. a reference to YMC § 15.29.110. b. Adding a reference to YMC § 15.29.120. c. Adding a reference to YMC Chapter 15.21 d. Adding § 15.29.110.(F) Staff Analysis: These changes incorporate several updates required by the FCC, include appropriate references for fee locations and appeal language, and overall provide for a more efficient and streamlined process. 13. YMC Ch. 16.08: a. Amending YMC § 16.08.020 to follow procedures in 16.08.040. b. Amending YMC § 16.08.025 to follow the procedures under 16.08.040. c. Omitting YMC § 16.08.030. Staff Response: The sections have been modified to reflect the Judicial Appeal process found under YMC§ 16.08.040.This ensures that all appeal processes are the same for all applications across the City. FINDINGS OF FACT 1. This project underwent Environmental Review with the Determination of Nonsignificance Issued on August 23, 2024. 2. Public notice was provided in accordance with YMC Ch. 16.10, with a Notice of Public Hearing and Legal Ad Publication in the Yakima Herald newspaper on August 1, 2024. 3. The proposed amendments are consistent with the following Goals and Policies of the 2040 Comprehensive Plan: Goal 2.1: Establish a development pattern consistent with the community's vision. Policy 2.1.6 Adopt coordinated development regulations that facilitate Yakima's preferred land use pattern (e.g. allowed density, uses, and site provisions) • Refine the land use code on an ongoing basis to make it user-friendly by employing simple language, easy to read charts, and illustrative graphics. DOCo INDEX 3 TXT#002-24 # 630 • Monitor and refine the land use code as needed to facilitate the preferred land use pattern and development character. • Integrate an appropriate balance of predictability and flexibility when updating development regulations that allow ease of administration and interpretation and offer optional ways of meeting requirements when possible. 4. At its September 11, 2024, public hearing, the Yakima Planning Commission heard the staff presentation regarding the proposed amendments. No members of the public provided oral or written testimony. YAKIMA PLANNING COMMISSION'S CONCLUSIONS 1. No adverse impacts have been identified; 2. The proposed updates underwent Environmental Review; 3. The proposed amendments are consistent with the Yakima Urban Area Zoning Ordinance, 2040 Comprehensive Plan, and Housing Action Plan. MOTION Based on the testimony and evidence presented during this afternoon's public hearing, it was moved and seconded that Planning staff draft findings of fact and forward a recommendation of approval to the Yakima City Council. The motion carried unanimously. RECOMMENDATION TO CITY COUNCIL The Planning Commission of the City of Yakima, having received and considered all evidence and testimony presented at the public hearing, and having received and reviewed the record herein, hereby recommends that the City Council of the City of Yakima APPROVE the proposed text amendments to the Yakima Municipal Code. The DNS was retained on June 21, 2024. A revised DNS was issued on August 23, 2024. IV. PUBLIC NOTICE Notice of Public Hearing August 1, 2024 Legal Ad Publication August 1, 2024 No written comments were submitted prior to the drafting of this report. Any comments submitted prior to the hearing will be addressed in a supplemental report made available at the June 26, 2024 hearing. V. FINDINGS AND CONCLUSIONS 1. Revised 7/2023 i.!�" Dy X Page 17 653 •rm City of Yakima Planning Commission Text Amendments—Appeals KANNINAMNIA Under the Yakima Municipal Code (YMC), appellants can appeal a Hearing Examiner decision or further appeal an administrative decision subsequently decided by the Hearing Examiner directly to the City Council. Staff has been directed to review YMC Titles 14, 15, and 16 to revise City Council's role during the appeal process, removing Council from the appeal process and instead having the appellant file directly with Superior Court. The reason for implementing this change primarily pertains to legal expertise and analysis of existing precedent when it comes to land use decisions. City Council generally has a full agenda during their regular meetings, and often does not have the time to analyze a land use determination. Yakima County Superior Court is already familiar with the process and has guidelines in place established by the Land Use Petition Act (LUPA) to process any appeal that comes before the Court. 14.15.060 Findings and conclusions. The administrator shall not approve a preliminary short plat and short subdivision unless written findings are made that the criteria for approval from YMC 14.15.020 along with all applicable laws and regulations have been met. A preliminary short plat may be appealed under the provisions of YMC Chapter A final short plat cannot be recorded during the appeal period. 14.20.270 Plat vacation—Criteria for approval. A. Approval. The hearing examiner shall render the final decision on proposed plat vacations. The hearing examiner's decision may be appealed using the procedures under Chapter 14.50.to the Gity council.See- -,M, rh Ater 14.50 for appeal procedures. B. Criteria for Approval. The proposed plat vacation may be approved or denied after a written determination is made whether the public use and interest will be served by the proposed vacation of the subdivision. If any portion of the land contained in the subdivision was dedicated to the public for public use or benefit, such land, if not already deeded to the city, shall be deeded to the city unless the hearing examiner finds that the public use would not be served by retaining the public interest in such land. C. Vacation of Streets or Other Public Rights-of-Way. When the vacation application specifically proposes vacation of a city street or other public right-of-way, the city's street vacation procedures shall be utilized. When the application is for the vacation of a plat together with any street or other public right-of-way,the procedure for vacation in this section shall be used, but no street or other public right-of-way may be vacated contrary to the provisions of RCW Chapter 35.79 or the city's street vacation ordinance. If any land within the alteration contains a dedication to the general use of persons residing within the subdivision, such land may be altered and divided equitably between the adjacent properties. C. Revised Plat. After approval of the alteration, the final amended plat will be prepared in accordance with the hearing examiner's decision and submitted to the hearing examiner or administrator for signature, after which, it shall be filed with the county auditor to become the lawful plat of record. 14.35.130 Appeals. Any decision of the administrator may be appealed following the procedures set forth in Chapter 15.02.020 Definitions. "Development Permit approval" means written authorization for development or modification of development as defined in this title. When a building or other construction permit is required, the building or construction permit shall serve as the other development permit. If no tbulding_ar_construction permit is required,the zoning decision shall serve as the development permit. "Development Permit denial" means written refusal for development or modification of development. "Zoning decision" means a document issued by the Planning Division, hearing Examiner, or City Council, which serves as the City's final determination of approval or denial of development or modification of development. DOC. INDEX 655 15.20.040 Hearing examiner—Duties and powers. A. Office.The office of the hearing examiner, herein referred to as hearing examiner, is hereby recognized. The hearing examiner shall perform the duties and functions established by this or any other title. Unless the context requires otherwise, the term "hearing examiner" as used herein shall include deputy examiners and examiners pro tern. B. Authorities and Duties. The examiner shall receive and examine available information, conduct public hearings and keep a record thereof, and enter decisions as provided for herein. C. Effect of Decisions. 1. A. Uses Requiring Wireless Conditional Use Permit. Wireless CUPs require a public hearing before the hearing examiner and final approval by the hearing examiner. B. Criteria for Granting Wireless Conditional Use Permit. The proposed use shall meet or exceed the performance standards that are required in the zoning district the proposed use will occupy; 3. The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; 4. The proposed use shall be in keeping with the goals and policies of the comprehensive land use policy plan; and 5. All reasonable and practicable measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. C. Authority to Impose Conditions. The hearing examiner may impose any conditions necessary to address identified impacts associated with the proposed wireless facility and ensure that the facility is compatible with surrounding development. The hearing examiner may: 1. Increase requirements in the standards, criteria or policies established by this title; 2. Stipulate the exact location as a means of minimizing hazards to life, limb, property damage, erosion, landslides or traffic; 3. Require structural features or equipment essential to serve the same purpose set forth above; 4. Impose conditions similar to those set forth in subsections (C)(2)and (3) of this section as deemed necessary to establish parity with uses permitted in the same zone in their freedom from nuisance generating features in matters of noise, odors, air pollution, wastes, vibration, traffic, physical hazards, and similar matters; provided, the hearing examiner may not, in connection with action on a conditional use permit, reduce the requirements specified by this title as pertaining to any use or otherwise reduce the requirements of this title in matters for which a variance is the remedy provided; 5. Assure that the degree of compatibility with the purpose of this title shall be maintained with respect to the particular use on the particular site and in consideration of other existing and potential uses within the general area in which the use is proposed to be located; and DOC INDEX 658 6. Recognize and compensate for variations and degree of technological processes and equipment as related to the factors of noise, smoke, dust, fumes, vibration, odors, and hazard or public need. D. Conditional Use Permits—Effect of Hearing Examiner Decision. The decision of the hearing examiner on a conditional use permit shall be final and conclusive with right of appeal to the GEty-€ uflaYakima County Superior Court in accordance with YMC 16.08.0430. A wireless height variance is required for any major modification to an existing tower, antenna, or base station or construction of a new tower, antenna, or base station that requires a height in excess of height limits defined in YMC 15.29.070(A)(2). B. Variance from Other Standards. A major modification to an existing tower, antenna, or base station or construction of a new tower, antenna, or base station that requires variance from design criteria in YMC 15.29.070 other than height shall follow the standard variance procedures in Chapter 15.21 YMC (including review criteria). C. Criteria for Granting Wireless Height Variance. The hearing examiner shall have the authority to grant a variance from the maximum height allowed for a tower, antenna or base station when, in his/her opinion, the conditions as set forth herein have been found to exist. A wireless height variance is subject to: 1. Compliance with standard wireless permit standards of YMC 15.29.120(D); 2. Standard variance procedures in Chapter 15.21 YMC (not including review criteria); and 3. All of the following criteria must be met: a. The additional height is necessary to provide adequate service and no other alternative is available; b. A significant portion of the tower and related facilities are screened by existing evergreen trees or existing structures; c. Strict application of current height limits would deprive a tower or antenna operator from achieving the minimum height required to meet the proven wireless need; DOG. Any visual impacts will be mitigated to the greatest extent possible using camouflage, stealth or screening as defined by this chapter; g. The location of the tower and antenna has been chosen so as to minimize the visibility of the facility from residentially zoned land and to minimize the obstruction of scenic views from public properties; and h. The variance is the minimum necessary to grant relief to the applicant. D. Decision. Based upon the information provided by the applicant, the results of the visual impact analysis, and findings of compliance or noncompliance with the criteria set forth herein, the examiner may: 1. Approve an application for a variance, which may include additional requirements above those specified in this title or require modification of the proposal to comply with specified requirements or local conditions; or 2. Deny a variance if the proposal does not meet or cannot be conditioned or modified to meet subsection C of this section. E. Burden of Proof. The applicant has the burden of proving that the proposed wireless height variance meets all of the necessary criteria. F. Wireless Height Variance—Effect of Hearing Examiner Decision. The commission discussed the matter. Following the discussion, Commissioner Place made a motion to continue directing appeals from the hearing examiner to the City Council. However, the motion did not receive a second and therefore was not considered. Commissioner Hughes-Mickel requested staff to gather further information from other cities regarding their appeal processes. Crowell informed the commission that he would gather additional information for the upcoming meeting. Text Amendment s—Mixed Use/Downtown Development,Class 1 Uses, and Signs—Crowell reviewed parts of the City of Vancouver Washington's ordinance regarding mixed-use buildings. He also went over minor changes to the signs section. Public Comment—None Other Business—Chair Liddicoat raised a question for Crowell concerning planning and building applications. The city has received some applications and is working on one of its own. Applications are due by April 30th. March 27, 2024 Meeting Minutes — It was motioned by Commissioner Place and seconded by Commissioner Hitchcock to approve the meeting minutes of March 27, 2024, as presented. The motion carried unanimously. Text Amendments—Title 15116 Appeal Sections Crowell explained that after some discussion with the legal department regarding the appeal process, it was recommended to remove the City Council from the appeal process. Any appeals would now go directly to the Superior Court with the new changes. Commissioner Monick agreed with the recommendation. He continued with the text changes in the different sections related to appeals. Chair Liddicoat enquired about the number of appeals the city had. Crowell replied that there were not many, perhaps one every few years. Crowell clarified that if an administrative decision is appealed, it would first go to the Hearing Examiner. If the decision is further appealed, it would then go directly to the Superior Court. On the other hand, if a decision made by the Hearing Examiner is appealed, it would go directly to the Superior Court. Text Amendments—Mixed Use/Downtown Development, Class 1 Uses,and Signs—Crowell continued with the changes discussed at previous meetings. He had separated Mixed-use buildings and Downtown Development as agreed in the previous meeting to make things easier and more understandable. He continued with the layout of the first floor of mixed-used buildings and provided examples of cities similar to Yakima and what their requirements were. He also went over some recent mixed-use projects in existing buildings that staff have reviewed. The commission discussed the proposed changes. Crowell provided an update to the commission regarding the introduction of the new section 15.09.26 Downtown Business District development the commission engaged in a discussion on the matter. He went over the Type 1 review exemptions and added the alteration of parking lots to require a Type 1 or modification process. Crowell had no updates on the sign codes. Public Comment—Anne Knapp, a Yakima resident, had some comments and suggestions about the proposed text amendments discussed during the meeting. Other Business — Commissioner Place raised a query directed at Councilwoman Deccio regarding the requirement set by the City Council for 12,000 signatures on the petitions. Commissioner Monick suggested adding the text amendments being reviewed to be put onscreen and public comment be moved higher up on the agenda. Councilwoman Deccio provided an update, stating that interviews for the positions are scheduled for next week.Additionally,Chair Liddicoat expressed interest in involving a member of the commission in the interview process.
