Pledge of Allegiance Mayor Cawley led the Pledge of Allegiance. 3. Open Discussions for the Good of the Order A. Proclamations i. Proclamations for Mayor Cawley and Councilmembers Dittmar, Ensey and Ettl Mayor Cawley read proclamations of commendation and appreciation for Council Members Ensey, Dittmar and Ettl. Council Member Ettl read a proclamation of commendation and appreciation for Mayor Cawley. Council members thanked family, friends, citizens and staff for helping make the Council successful and for the recognition. ii. 11th Annual Homeless Persons Memorial Day proclamation Mayor Cawley proclaimed December 21, 2015, as National Homeless Persons' Memorial Day. Don and Anita Monoian accepted the proclamation and invited Council members to attend the 11th Annual Homeless Persons' Memorial Day Candlelight Vigil on Monday, December 21, 2015, at 5 p.m. at the Millennium Plaza. 4. Council Reports None. 5. Consent Agenda Mayor Cawley referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members or citizens present. The Page 1 of 6 322 following items were added to the consent agenda. Item 11 now 5J and item 14 now 5K. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion— see motion directly below.) MOTION: Dittmar moved and Ensey seconded to approve the consent agenda. The motion carried by a unanimous vote, Coffey absent. A. Approval of the minutes from the October 20, November 3 and 17, December 1, 2015 City Council Business meetings; October 27 and November 10, 2015 Council Study Sessions and October 30 and November 6, 2015 Special Council meeting B. Resolution announcing Council Business Meeting schedule for 2016 RESOLUTION NO. R-2015-158, RESOLUTION adopting the City Council 2016 regular business meeting schedule C. Resolution authorizing renewal of an agreement to provide Information Technology services to the City of Selah RESOLUTION NO. R-2015-159, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an Information Technology Services Interlocal Agreement with the City of Selah. D. Resolution authorizing an agreement between the City of Yakima Municipal Court and the Yakima County District Court for probation services RESOLUTION NO. R-2015-160, A RESOLUTION approving an agreement between the City of Yakima Municipal Court and the Yakima County District Court for probation services. E. Resolution authorizing an engineering and consulting services agreement with HDR Engineering, Inc. for engineering and consulting services associated with the 2017 Water System Plan update, not to exceed $220,555 RESOLUTION NO. R-2015-161, A RESOLUTION authorizing the City Manager to execute the attached and incorporated engineering and consulting services agreement with HDR Engineering, Inc. for engineering and consulting services associated with the 2017 Water System Plan update, not to exceed $220,555. F. Resolution authorizing a collective bargaining agreement for 2016-2019 with the American Federation of State, County and Municipal Employees (AFSCME) representing the transit bargaining unit RESOLUTION NO. R-2015-162, A RESOLUTION authorizing the City Manager to execute a collective bargaining agreement for 2016-2019 with the American Federation of State, County and Municipal Employees (AFSCME) representing the transit bargaining unit. G. Resolution authorizing a Memorandum of Understanding with AFSCME Local 1122 Municipal Employees for reallocation of Class Code 6221 Corrections Officer RESOLUTION NO. R-2015-163, A RESOLUTION authorizing the City Manager to execute a Memorandum of Understanding between the American Federation of State, County and Page 2 of 6 323 Municipal Employees (AFSCME) Municipal reallocating the Corrections Officer classification (6221) H. Ordinance granting a non-exclusive franchise to Noel Communications, Inc., a Washington corporation, which authorizes Noel Communications, Inc. to occupy City of Yakima rights-of-way in order to construct, operate, and maintain a telecommunications system ORDINANCE NO. 2015- 045, AN ORDINANCE granting a non-exclusive franchise to Noel Communications, Inc. ("NOEL") to construct, operate and maintain a Telecommunications System, with all necessary facilities, within the City of Yakima, Washington (the "City"); setting forth provisions, terms and conditions accompanying the grant of this Franchise; providing for City regulation of construction, operation, maintenance and use of the Telecommunications System; prescribing penalties for the violations of its provisions; and setting an effective date. Ordinance updating Classification and Compensation Plan for City Employees Section 2.20.100 ORDINANCE NO. 2015-046, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective January 10, 2016; and repealing all preceding pay ordinances in the City of Yakima Municipal Code J. Resolution authorizing an agreement with Yakima Police Athletic League to provide evidence based programming and/or activities in conjunction with the Yakima Gang Free Initiative Youth and Family Development Center RESOLUTION NO. R-2015-164, A RESOLUTION approving an agreement with Yakima Police Athletic League to provide evidence based programming and/or activities in conjunction with the Yakima Gang Free Initiative Youth and Family Development Center, and authorizing and directing the City Manager of the City of Yakima to execute and administer such agreement, with effective date to be January 1, 2016. K. Resolution approving Amendment to Southeast Yakima Community Center Operating Agreement between City of Yakima and 010, regarding 2015 and 2016 Service Fees RESOLUTION NO. R-2015-165, A RESOLUTION authorizing the City Manager to execute and administer an amendment to Southeast Yakima Community Center Operating Agreement between OIC and City of Yakima, for 2015 and 2016 Service Fees. 6. Audience Participation Tom Allen, non-resident, stated he has tried to help with housing issues when appearing in front of this Council and has some ideas for the new Council. He offered suggestions for the new Council as well as his contact information. PUBLIC HEARINGS 7 Closed Record Public Hearing and Resolution on the Preliminary Plat of Rainier Court Assistant Planner Robbie Aaron briefed the Council on the item. Mayor Cawley opened the public hearing and, with no one coming forward to speak, Page 3 of 6 324 closed the hearing. The City Clerk read the resolution by title only. RESOLUTION NO. R-2015-166, A RESOLUTION granting conditional preliminary plat approval for the Preliminary Plat of Rainier Court a twelve lot subdivision for property located in the vicinity of Summitview Ave. and N. 89th Ave. MOTION: Ensey moved and Adkison seconded to adopt the resolution. The motion carried by a unanimous vote, Coffey absent. 8. Closed Record Public Hearing and Resolution on the Preliminary Plat of Summit View Assistant Planner Trevor Martin briefed the Council on the item. Mayor Cawley opened the public hearing and, with no one coming forward to speak, closed the hearing. The City Clerk read the resolution by title only. RESOLUTION NO. R-2015-167, A RESOLUTION granting conditional preliminary plat approval for the Preliminary Plat of Summit View a Forty Four lot subdivision for property located in the vicinity of Summitview Ave. and N. 88th Ave. MOTION: Ensey moved and Dittmar seconded to adopt the resolution. The motion carried by a unanimous vote, Coffey absent. CITY MANAGER REPORTS 9. Sequence and Phasing Report on North First Street Project Chief Engineer Brett Sheffield briefed the Council on the project and recommended bike lanes be built from Martin Luther King, Jr. Blvd. to I Street, with work on the remaining portion of North First Street to be decided at a later date. The following City residents spoke in support of continuing the bike lanes from 1 Street to 1-82: Phil Hoge, Phil Mattoon, Rob Strader, Shirley Strader, Chad Dold, and Neil McClure. After Council discussion, MOTION: Ettl moved and Adkison seconded that bike lanes be added to the entire North First Street project—from Martin Luther King, Jr. Blvd. to 1-82. The motion carried by a 5-1 vote with Lover voting no and Coffey absent. 10. 2015 3rd Quarter Strategic Plan Monitoring Report Interim City Manager Jeff Cutter briefed the Council on the report. 11. Resolution authorizing Memorandum of Understanding with the Seasons Music Festival Board of Directors establishing the terms of repayment of the City's loan for improvements to the Seasons Music Hall to United Builders of Washington, Inc. R-2015-168, A RESOLUTION authorizing the City Manager to execute a Memorandum of Understanding with The Seasons Music Festival establishing the repayment terms for a loan balance for which the Seasons Music Hall is the collateral. MOTION: Dittmar moved and Ettl seconded to adopt the resolution. The motion carried by unanimous vote, Coffey absent. 12. Resolution authorizing Vacant Land Purchase and Sale Agreement with Cleat City, LLC for property to be developed by SOZO Sports of Central Washington, in cooperation with the City, into a premier soccer facility, together with authority to execute documents necessary to lease the purchased property bask to SOZO to allow said development Interim City Manager Cutter briefed Council on the resolution. Dr. Lloyd Butler spoke to the Council about his exceptional experience in working on this project with Sozo Sports and City of Yakima staff. The City Clerk read the resolution by title only. RESOLUTION NO. R-2015-169, A RESOLUTION authorizing the execution of a Vacant Land Purchase and Sale Agreement between the City and Cleat City, LLC to accomplish the City's purchase of a portion of the Cleat City, LLC property that will be referred to as the Yakima Sports Park, all as set forth in the previously executed Agreement between SOZO Sports of Central Washington and the City. MOTION: Dittmar moved and Adkison seconded to adopt the resolution. The motion carried by unanimous vote, Coffey absent. ORDINANCES 13. Ordinance adopting a 2016 Budget for the City of Yakima Finance Director Epperson briefed the Council on the 2016 Budget. The City Clerk read the ordinance by title only. ORDINANCE NO. 2015-047, AN ORDINANCE adopting a budget for the City of Yakima, Washington, for the year 2016; and making appropriations for estimated expenditures. MOTION: Dittmar moved and Adkison seconded to pass the ordinance. The motion carried by unanimous vote, Coffey absent. 14. Other Business None. 15. Adjournment Motion: Ensey moved and Dittmar seconded to adjourn to a Special Council Meeting on December 9, 2015, at 1 p.m. in the Council Chambers at City Hall.
