Phone(509) 575-6183 • Fax (509) 575-6105 • Email:ask.planning@yakimawa.gov rut, YAKIMA PLANNING COMMISSION RECOMMENDATION TO THE YAKIMA CITY COUNCIL FOR COMPREHENSIVE PLAN AMENDMENT AND REZONE CPA#003-24, RZ#003-24 August 28, 2024 WHEREAS, The City of Yakima adopted the Yakima Comprehensive Plan 2040 in June 6, 2017; and WHEREAS, The Washington Growth Management Act and local ordinances provide a process for the annual review of amendments to the Plan as requested by citizens, property owners and/or local government; and WHEREAS, Under the provisions of YMC Ch. 1.42 the Yakima Planning Commission (YPC) is responsible for the review of these applications and for recommending the approval, modification or denial of each request; and WHEREAS, On April 30, 2024, applications for Comprehensive Plan Amendment and Rezone were submitted by Hordan Planning Services of behalf of Grimes Co. and Expensive Hay LLC., to amend the Future Land Use map designation for three parcels from Low Density Residential to Community Mixed-Use and concurrent rezone from Suburban Residential (SR) to Local Business (B-2). Parcels: 18120623028, 18120623027 & 18120623019 (City File CPA#003-24, RZ#003-24); and WHEREAS, The applications were considered complete for processing on June 4, 2024, and public notice was provided, in accordance with the provisions of YMC Ch. 16.10, on June 13, 2024; and WHEREAS, SEPA Environmental Review was completed with a Determination of Nonsignificance issued on July 2, 2024, which was not appealed (City File SEPA#006-24); and WHEREAS, The YPC held a study session to review this Comprehensive Plan Amendment and Rezone May 8, 2024; and WHEREAS, The Yakima Planning Commission held an open record public hearing August 13, 2024 to hear testimony from the public, consider the Amendment and Rezone, and provide a recommendation to the Yakima City Council; DO . INDEX Yakima * ---&—L am-.-...,, • 2015 199 4 684 Now therefore, the Yakima City Planning Commission presents the following findings of fact, conclusions, and recommendation to the Yakima City Council: APPLICATION # CPA#003-24, RZ#003-24 APPLICANT: Hordan Planning Services on behalf of Grimes Co. & Expensive Hay LLC. APPLICANT ADDRESS: 410 N. 2nd St., Yakima, WA 98901 PROJECT LOCATION: 8603 & 8604 W. Ahtanum Rd. PARCEL(S): 18120623028, 18120623027 & 18120623019 FINDINGS OF FACT 1. The applicant requests to amend the Comprehensive Plan Future Land Use Map designation for three parcels from Low Density Residential to Community Mixed Use and concurrent rezone from Two-family Residential (R-2) to Light Industrial (M-1). 2. The City of Yakima Planning Division provided a detailed staff report to the Planning Commission for review during their August 13, 2024 public hearing, with the recommendation of APPROVAL of the proposed amendment and rezone. 3. The proposed Comprehensive Plan Amendment is consistent with the applicable approval criteria in YMC § 16.10.040, as follows: a. The purpose of this request is to bring additional parcels to the same consistent zoning designation as already existing parcels and uses on adjacent properties located near 8603 & 8604 W. Ahtanum Rd. b. The amendment does not correct an obvious mapping error, does not address a deficiency of the 2040 plan, and is consistent with the Growth Management Act and County-wide Planning Policies. c. The proposed amendment from Low Density Residential to Community Mixed Use is consistent with the applicable criteria found in YMC § 16.10.040 4. The proposed Rezone from Suburban Residential (SR) to Local Business(B-2) is consistent with the applicable approval criteria in YMC § 15.23.030, as follows: a. Testimony at the public hearing was considered. b. The property is suitable for uses within the B-2 zoning district. c. The B-2 zoning district is an implementing zone of the Community Mixed Use Future Land Use Designation. d. The property is currently capable of being served by all necessary public utilities and can be accessed by public streets. e. The proposed Rezone is considered compatible with the surrounding neighborhood and no mitigation is proposed at this time. f. The public need for this Rezone will enable a consistent use and development of property into an area that is already developed with similar uses. CONCLUSIONS 1. No adverse impacts have been identified; 2. No adverse written or verbal comments were received during public testimony. 3. This proposal underwent Environmental Review; 4. The proposed Comprehensive Plan Future Land Use Map Amendment from Low Density Residential to Community Mixed Use with a concurrent Rezone from Suburban Residential (SR) to Local Business (B-2) is consistent with the Yakima Urban Area Zoning Ordinance and Yakima Comprehensive Plan 2040. The motion carried unanimously. DESCRIPTION OF REQUEST: Comprehensive Plan Map Amendment (CPA) and Environmental Review requesting to amend the Future Land Use map designation for two parcels from Low Density Residential to Community Mixed-Use and concurrent rezone from Suburban Residential (SR) to Local Business (B-2). II. CURRENT ZONING AND LAND USE: The subject property is approximately 0.84 acres in size and is zoned Multifamily Residential (R- 3). Adjacent properties to this site have the following zoning and land use characteristics: Direction Zoning _Land Use North R-1 Residential South R-1 Residential East B-2 Parking _ West B-2 Restaurant and Coffee Stand III. PUBLIC NOTICE: Posting of Property June 12, 2024 Mailing of Notice of Application July 2, 2024 Public Hearing Notice Published July 2, 2024 IV. FINDINGS OF FACT: A. Environmental Review. Environmental Review (SEPA#006-24) was completed for this application, and a Determination of Nonsignificance (DNS) was issued on July 2, 2024. No appeals were filed. B. Comprehensive Plan Amendment(CPA) Approval Criteria. The Yakima Comprehensive Plan 2040, Future Land Use Map designates this area as Low Density Residential. In accordance with the provisions of the Yakima Municipal Code, the following criteria must be considered in the review of any proposed amendment to the Yakima Comprehensive Plan. DOC INDEX 11 1W_� 688 YMC § 16.10.040 (1): To alter the Future Land Use Map or other plan policy map, or effect a Comprehensive Plan Text Amendment, the proposed amendment must do one or more of the following: (a) Address circumstances that have changed since the last time the relevant Comprehensive Plan or text was considered: Staff Response: The purpose of this request is to allow additional uses on the subject property. Business fitting the Community Mixed Use future land use category are located directly adjacent the site. Changing this parcel to Community Mixed-Use will allow for the concurrent Rezone to B-2. (b) Better implement applicable Comprehensive Plan policies than the current relevant Comprehensive Plan map or text: Staff Response: The purpose of the Community Mixed-Use Future Land Use is intended to allow for a mixture of neighborhood scaled retail, commercial service, office, and high density residential uses. Goal 2.1: Establish a development pattern consistent with the Community's Vision Policy 2.1.3.: Review proposed Future Land Use designation changes for consistency with YMC Ch. 16.10 and the following criteria: • Does the proposal conform to locational criteria set forth for the desired designation? Yes, the site is suitable for commercial use. • Is the site physically suited for the proposed designation? Yes. The site is suitable for commercial uses—business uses are directly adjacent the site. • Is the desired zone one of the implementing zones of the land use designation? Yes, the proposed Local Business (8-2) zone is an implementing zone of the Community Mixed-Use land use designation. • Is the proposal a spot zone or a similar change that may create instability with the surrounding neighborhood? The proposal is not considered a spot zone. It connecting two areas with Community Mixed Use future land use designation. Policy 2.1.10.: Require properties to assume zoning consistent with the City's Future Land Use Plan, as adopted or amended where appropriate. Policy 2.2.2.8.: Commercial Mixed-Use location criteria — Existing and planned commercial centers and primary arterial corridors. Policy 2.5.1: Allow for a mixture of compatible land uses along corridors and within mixed- use designated areas. This includes the integration of multi-family residential and office uses with retail and service commercial uses. (c) Correct an obvious mapping error: Staff Response: Does not apply. (d) Address an identified deficiency in the Comprehensive Plan: Staff Response: Does not apply. (e) Is the proposed CPA coordinated with, and take into consideration, the Comprehensive Plans adopted by Yakima County or cities with which the City of Yakima has, in part, common borders or related regional issues as may be required by RCW 36.70A.100? Staff Response: This proposal is consistent with RCW 36.70A.100. This application is part of the annual CPA cycle for the Yakima Comprehensive Plan which the City of Yakima DOC. INDEX coordinates with adjacent jurisdictions. No comments were submitted from affected jurisdictions. (f) Proposed CPAs must be consistent with the Growth Management Act (GMA), Ch. 36.70A. RCW, and the Yakima County Wide Planning Policy (CWPP). Staff Response: This proposal is consistent with the Growth Management Act and the Yakima Countywide Planning Policy because the proposal directs urban growth to an existing urban area (within City Limits first) and encourages infill in the area where all urban level services and facilities are currently provided. The proposal reduces sprawl and is served with an adequate transportation system. (g) Cumulative impacts of all CPAs, including those approved since the original adoption of the Comprehensive Plan, shall be considered in the evaluation of any proposed amendments. Staff Response: This proposed change from Low Density Residential to Community Mixed-Use is minimal in size (5.44 acres) and in scope. The Site has historically been used for bin storage. This change will have no impact on available land for residential development. C. COMPREHENSIVE PLAN CONCLUSIONS: 1. The amendment is minor in nature. 2. No adverse impacts have been identified by approving this amendment request. 3. The proposed amendment from Low Density Residential to Community Mixed Use is consistent with the applicable criteria found in YMC § 16.10.040. D. REZONE APPROVAL CRITERIA In accordance with the provisions of the YMC § 15.23.030, recommendations to approve or deny proposed rezones shall include the following considerations: (1) Testimony at public hearing. After consideration of any public comments received during the course of the hearing it may be appropriate for the Planning Commission to modify the staff's recommendation. (2) The suitability of property in question for uses permitted under the proposed zoning. The property is well suited for uses listed within Table 4-1 for the B-2 zoning district. (3) The recommendations from interested agencies and departments. No agencies or departments have registered any opposition to this rezone. (4) Compliance with the Comprehensive Plan. The proposed Local Business (B-2) zoning district is an implementing zone of the Community Mixed-Use land use designation, and is consistent with several goals and policies, as indicated above in section IV.B of this report. (5) The adequacy of public facilities, such as roads, sewer, water, and other required public services. This property is currently capable of being served by all public utilities necessary for the support of commercial land uses. INDEX 690 (6) The compatibility of the proposed zone change and associated uses with neighboring land uses. The proposed zone change is compatible with existing neighboring land uses. The property is currently vacant or being used for agricultural storage. (6a) What mitigating measures are planned to address incompatibility, such as sitescreening, buffering building design, open space, traffic flow alteration, etc.? No mitigation is proposed as part of this non-project rezone request. Project-specific considerations will be addressed during future project level review. (7) The public need for the proposed change. The public need for this change is to enable additional land uses on a property already with adjacent commercial uses. E. REZONE CONCLUSIONS: 1. The rezone from Single Family Residential (R-1) to Local Business (B-2) is consistent with the applicable criteria found in YMC § 15.23.030 2. No adverse impacts have been identified by the approval of this rezone. 3. The requested rezone implements the Community Mixed-Use land use designation of the Yakima Comprehensive Plan 2040. 4. The property is currently served, or capable of being served, by all necessary public utilities capable of supporting commercial land uses. V. RECOMMENDATION The Community Development Department recommends APPROVAL of this amendment request from Low Density Residential to Community Mixed-Use in order to accommodate a concurrent rezone from R-1 (Single Family Residential) to B-2 (Local Business). RECOMMENDATION made this 14th day of August, 2024. How is the subject property suitable for uses permitted under the proposed zoning? The subject property is suitable for uses permitted under the proposed zoning change because the property either fronts on North 86th Avenue, Ahtanum Road or both. Ahtanum Road and South 86th Avenue are both classified as urban arterials. The properties are spaced out enough to accommodate individual and shared driveway approaches, if necessary, to separate traffic associated with commercial enterprises. This will prevent disruptive strip commercial driveways from occurring. The property is flat and can easily be developed. The one constraint will be development within the 100-year floodplain and required development standards. In this instance, it appears that the property would be better developed for limited commercial development, instead of constructing residential housing within a designated floodplain. The property is located within a mixed-use area, particularly to the east and west of the subject property, that consists of small convenience type businesses providing services to local residents and vehicle pass-by trips. Lying to the north and south are residential neighborhoods, each across a developed roadway, which are compatible with the proposed zoning, subject to project review by the City Building and/or Planning Departments. The property lies within the City Limits of Yakima and is served with full urban services and facilities. This is a classic infill project, that will remove a localized area of residential zoning (within a designated floodplain) and replace it with a matching zoning district on its east and west sides. Due to the characteristics of the property listed above (subject to floodplain requirements), the site can easily accommodate any land use listed within Table 4-1 (Permitted Land Uses)per Chapter 15.04. What is the status of the existing land use? The status of the existing land use is that the property consists of 3 parcels. The 3 parcels total 5.57 acres. Parcel Number 181206-23028 (4.96 acres) consists of a fruit warehouse, a large concrete pad which is used for fruit bin storage, two storage shed, a shop and an office. Parcels 181206-23019 (.39 acres) and 181206-23027 (.22 acres) are currently vacant. DO . INDEX 725 2. How is the rezone request in compliance with and/or how does the request deviate from the Yakima Urban Area Comprehensive Plan? The rezone request is in compliance with the Yakima Urban Area Comprehensive Plan because it complies with Goals & Policies found in 2.4 which states: "Goal 2.1 --Establish a development pattern consistent with the community's vision." The goal is backed by all of the following policies: 2.1.1 —Designate the general distribution, location and extent of the uses of land for housing, commerce, recreation open spaces, public utilities and facilities and other land uses. 2.1.7—Allow new development only where public services can be provided. 2.1.10—Require properties to assume zoning consistent with the City's Future Land Use Plan, as adopted or as amended where appropriate, and; "Goal 2.2—Provide a mix of land use designations consistent with the community's vision." The goal is backed by all of the following policies: 2.2.3 —Community Mixed-Use: 2.2.3.A—This designation is intended to allow for a mixture of neighborhood scaled retail, commercial service, office and high-density residential uses. 2.2.3.B —Existing and planned future neighborhood center areas, sites along key arterials and collector streets, and transitional areas between residential uses and downtown or other mixed-use centers. Proponent Comment—This project specifically meets the above goal and policies because the proposed change in land use would be located adjacent to an existing commercial center, which is located on the west and east side of the subject property. The property can be served with all public services including, but not limited to; domestic water, sanitary sewer, electricity, telephone service and other necessary public services needed for development of the property. A change in the comprehensive plan from Low Density Residential to Community Mixed-Use would necessitate a change in zoning from Suburban Residential to Local Business. The neighborhood is currently a mixed-use neighborhood of low-density residential uses, community services and commercial services. All these land uses are located, generally north, of Ahtanum Road and serve as a transitional zoning district between Ahtanum Road on the south and residential uses to the north. The landowner desires to transition the property out of its current use, which is quasi- industrial, and into land uses that are more commercial in nature. This is based on the fact that properties to the east and west are currently zoned Local Business. For all the reasons stated above, this proposal implements the comprehensive plan because it meets the goals and policies of the Community Mixed-Use land use designation, which implements the proposed Local Business zoning district. 3. Yes, there are adequate public facilities to serve this proposal. The property either fronts on North 86th Avenue, Ahtanum Road or both. The property is also served with all other infrastructure including domestic water, sanitary sewer, electricity,telephone and any other needed utilities. Additionally, the site is protected by the Yakima Police and Fire Departments and lies within the West Valley School District. Are the existing public facilities capable of supporting the most intensive use of the new (requested)zone? If not,what mitigating measures are going to be implemented to address any short falls in public services that may exist? Yes, the existing public facilities are capable of supporting the most intensive use of the new zone. The property is served with full urban services and facilities, the necessary services can be easily extended to the property, as necessary. If any short fall exists in the delivery of facilities, necessary mitigation will be required of the developer to ensure adequate public facilities are in place at his/her/their expense, as required through land use concurrency statutes. 4. How is the proposed zone change compatible with the existing neighboring uses? The proposed zone change is compatible with existing neighboring uses because the property owner would like to transition out of an intensive agriculturally related industry to a lesser intensive commercial zoning district. Currently, there are, or will be, residential structures on the north and south sides of the property. The residential structures to the north, lie across the roadway known as Apple Tree Parkway and residential structures to the south, lie across Ahtanum Road. Thus,there is a substantial separation between the properties which helps promote compatibility between the uses. Property to the east, across South 86th Avenue, is a church facility, which is compatible with other local businesses that could be proposed on the subject property. Property to the west consist of a portion of Apple Tree Golf Course, a restaurant and an espresso stand. These uses are also compatible with any proposed Local Business land use. Li C. What mitigating measures are planned to address incompatibility, such as sitescreening, buffering building design, open space, traffic flow alteration, etc.? No specific mitigation is proposed as part of the rezone request because this is a non- project application, which means no specific land use is proposed. However, appropriate mitigation is built into the zoning code through regular site plan approval, which is required as part of any proposed development plan for the property. This review helps ensure compatibility between land uses. In essence, incompatibility mitigation measures will be required during a specifical project review process conducted by the City. 5. What is the public need for the proposed change? The public need arises from the fact that there is a demonstrated need for additional Local Business (B-2) zoned property in the Ahtanum Community. The area is growing due to several large subdivisions occurring along South 64th Avenue,Ahtanum Road(mainly between S. 64'h Avenue and South 78th Avenue) and around the Apple Tree Golf Course. The addition of 5.57 provides the opportunity for new businesses to locate on the subject property. New businesses can provide goods and services to the surrounding community and those passing by the property enroute to destinations beyond the local market area (i.e. Wiley City and Tampico areas). A review of the Local Business zoning district inventory in this general area indicates that it is fully developed or has approved plans to be developed. This is especially true for Parcel Number 181205-13022, which is zone Local Business and appears to be vacant but is currently approved for a residential mini-storage complex. In closing, this proposal will increase the availability of Local Business zoning in an area where there is little to no commercial zoning available. The increase in residential development in the area creates a need for additional commercial services. This property abuts commercial properties on the east and west sides, it is almost natural that it be the same zone to promote compatibility between land uses. This proposal makes good use of existing urban infrastructure and services in the area and will meet the needs of the local business community and surrounding residential areas by providing commercial property with safe and convenient access to the street network. Meeting the demands of the local business markets, within the City of Yakima requires that occasionally, new land needs to be added to the current commercial inventory. This gives local businesses choices in the location of their business. Approval of this application would permit new and existing businesses to move to this site or possibly attract new businesses to the Community of Ahtanum. Does your proposal address circumstances that have changed since the last time the relevant comprehensive plan or text was considered? If so, how? Yes, circumstances have changed since the original and last relevant comprehensive plan was considered. Specifically, the site and surrounding area have changed significantly. Generally, the subject property is no longer used as a fruit processing facility, and it is now used mainly for indoor fruit storage and outdoor bin storage. This has reduced the land us intensity on the property. This reduction in intensity is more compatible with newer surrounding residential land uses currently occurring in the immediate area. Residential development has been occurring directly north of the subject property. The abutting property to the north has been developed with a roadway (Apple Tree Parkway) that serves a large number of residential lots currently under construction. The larger neighborhood, especially along Ahtanum Road, from the area around South 64th Avenue to South 90th Avenue has seen substantial change. A new traffic signal has been installed at the intersection of South 64th and Ahtanum Road. Numerous residential housing units have been constructed northerly of this intersection. Other newer subdivisions around the intersections of South 72nd Avenue, South 74th Avenue and South 78th Avenue have been developed and have increased the population and traffic in this immediate area. This increase in population and traffic helps maintain the existing service establishments in the area, such as restaurants, espresso stand, gasoline stations and convenience stores. In addition to the above changes, the reduction in intensity on the subject property is a change that warrants additional discussion. The current comprehensive plan designation is Low Density Residential, and the zoning is Suburban Residential (SR). This designation and zoning district were placed on the property to recognize the existing land use, which is classified as an Agriculturally Related Industry. To maintain harmony and permit the agriculturally related industry to prosper, a land use designation and zoning district were placed just on those properties where the agriculturally related industry occurred. The property owner now desires to transition from the agriculturally related industry and into the same zoning district that lies east and west of the subject property. In short,this proposal will remove the current comprehensive plan and zoning district in favor of replacing it with the same comprehensive plan designation and zoning district that adjoins the subject property on its east and west sides. This proposal fills a zoning void in the commercial area along Ahtanum Road, where commercial activities are better absorbed than residential uses. Yes, this proposal better implements applicable comprehensive plan policies than current relevant comprehensive plan because it complies with Goals & Policies found in 2.4 which states: "Goal 2.1 --Establish a development pattern consistent with the community's vision." The goal is backed by all of the following policies: 2.1.1 —Designate the general distribution, location and extent of the uses of land for housing, commerce, recreation open spaces, public utilities and facilities and other land uses. 2.1.7—Allow new development only where public services can be provided. 2.1.10—Require properties to assume zoning consistent with the City's Future Land Use Plan, as adopted or as amended where appropriate, and; "Goal 2.2—Provide a mix of land use designations consistent with the community's vision." The goal is backed by all of the following policies: 2.2.3 —Community Mixed-Use: 2.2.3.A—This designation is intended to allow for a mixture of neighborhood scaled retail, commercial service, office and high density residential uses. 2.2.3.B —Existing and planned future neighborhood center areas, sites along key arterials and collector streets, and transitional areas between residential uses and downtown or other mixed use centers. Proponent Comment—This project specifically meets the above goal and policies because the proposed change in land use would be located adjacent to an existing commercial center, which is located on the west and east side of the subject property. The property can be served with all public services including, but not limited to, domestic water, sanitary sewer, electricity, telephone service and other necessary public services needed for development of the property. A change in the comprehensive plan from Low Density Residential to Community Mixed-Use would necessitate a change in zoning from Suburban Residential (SR) to Local Business (B-2). The neighborhood is currently a mixed-use neighborhood of low-density residential uses, community services and commercial services. All these land uses are located, generally north, of Ahtanum Road and serve as a transitional zoning district between Ahtanum Road on the south and residential uses to the north. This is a voluntary request on behalf of the property owner, which complies with the comprehensive plan update process, provides for a deficiency in the plan and promotes economic development. It should be noted, however, that the current zoning district is very small in area and was originally designated and zoned to recognize an agriculturally related industry, which is transitioning away from its current use. 4. Does your proposal address an identified deficiency in the Comprehensive Plan? If so,what is the deficiency? Yes, the deficiency is due to the low supply of property designated Community Mixed- Use in the immediate area. Because of this, it is necessary to request a change in the land use designation of these properties so that an adequate supply of Local Business zoning can be expanded along this roadway corridor within the Community of Ahtanum. Since the Comprehensive Plan is only periodically updated, annual amendments must be requested to fulfill the deficiencies until the next major update occurs to the comprehensive plan. A successful comprehensive land use change and rezone will help alleviate the deficiency by permitting commercial businesses a new, larger and safer area to locate. 5. In this situation, the impact is small because the proposal is the addition of three separate, but contiguous parcels, that total 5.57 acres in size. The cumulative impact of a project this small is minimal compared to the overall size of the Yakima Urban Area. 8. The proposal consists of three parcels that total 5.57 acres in size. One parcel contains a fruit warehouse and a large concrete pad used for the storage of fruit bins. The other two lots are vacant.
