ITEM TITLE: Resolution designating prohibited areas in SODA (Stay Out of Drug
Area) Orders issued under Chapter 6.13.

SUMMARY EXPLANATION:
If the SODA (Stay Out of Drug Areas) Order ordinance is adopted by the City Council, the City Council
must by resolution establish "prohibited areas." The City Legal Department in consultation with the Police
Chief, and his designees, after reviewing data combined with knowledge gained from on the ground
experience has identified two "prohibited areas." These areas have been identified as areas with high
drug related incidents and are the areas that prohibited persons may be restricted from as the result of a
drug related charge or conviction. These areas encompass a portion of Naches Avenue and North First
Street. A map of the "prohibited areas" is attached to the resolution which defines the "prohibited areas."

RESOLUTION NO. R-2024-
A RESOLUTION designating prohibited areas in SODA (Stay Out of Drug Area) Orders
issued under Chapter 6.13.
WHEREAS, Chapter 6.13 allows the court to issue SODA(Stay Out of Drug Area)Orders,
which specifically order as a condition of pretrial release and/or deferral or suspension of sentence
that the defendant stay out of areas with a high level of illegal drug related incidents; and,
WHEREAS, Chapter 6.13 states that prohibited areas that are set forth in SODA Orders
may be established, modified, or eliminated by a resolution of the city council; and,
WHEREAS, the Yakima police department has provided information to the city council to
support establishing "prohibited areas;" and,
WHEREAS, the establishment of"prohibited areas" is necessary to the enforcement and
operation of Chapter 6.13; and,
WHEREAS, the City Council has reviewed and considered the data and information
provided by the police department; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. Based on repeat and ongoing incidents of illegal drug related incidents in the
vicinity of the below identified city areas, and after consultation between the city legal
department and police chief, and his designees, the city establishes the areas identified
in this section as "prohibited areas" under Chapter 6.13. This designation shall include all
property within the prohibited area's outer perimeters and all rights-of-way located within
the prohibited areas, and all rights-of-way that are adjacent to the area's outer perimeters.
See Attachment "A" "Prohibited Areas Maps" for reference.
Prohibited Area#1: "Naches Avenue"
BEGINNING AT THE INTERSECTION OF EAST YAKIMA AVENUE AND SOUTH
4TH STREET; THENCE NORTHEASTERLY TO THE INTERSECTION OF EAST
YAKIMA AVENUE AND SOUTH 6TH STREET; THENCE SOUTHEASTERLY TO
THE INTERSECTION OF SOUTH 6TH STREET AND EAST PINE STREET;
THENCE SOUTHWESTERLY TO THE INTERSECTION OF SOUTH 4TH
STREET AND EAST PINE STREET; THENCE NORTHWESTERLY TO THE
BEGINNING POINT.
Prohibited Area#2: "North First Street."
BEGINNING AT INTERSECTION OF EAST "H" STREET AND NORTH 2ND
STREET; THENCE NORTHWESTERLY TO THE INTERSECTION OF NORTH
2ND STREET AND EAST "I" STREET; THENCE WESTERLY TO THE
INTERSECTION OF EAST "I" STREET AND NORTH 2ND STREET; THENCE
NORTHERNLY TO THE INTERSECTION OF NORTH 2ND STREET AND
SYCAMORE STREET; THENCE WESTERLY TO THE INTERSECTION OF
SYCAMORE STREET AND NORTH 1ST STREET; THENCE NORTHERNLY TO

INTERSECTION OF NORTH FIRST STREET AND TAMARACK STREET;
THENCE WESTERLY TO THE INTERSECTION OF TAMARACK STREET AND
GORDON ROAD; THENCE WESTERLY IN A STRAIGHT LINE TO THE POINT
WHERE TAMARACK ROAD IF EXTENDED MEETS THE BNSF RAILWAY
COMPANY TRACKS; THENCE SOUTHEASTERLY ALONG THE BNSF
RAILWAY COMPANY TRACKS TO THE INTERSECTION OF THE BNSF
RAILWAY COMPANY TRACKS AND EAST "I" STREET; THENCE EASTERLY
TO THE INTERSECTION OF NORTH FRONT STREET AND EAST "I" STREET;
