For Meeting of: August 20, 2024 ITEM TITLE: Resolution authorizing Supplemental Agreement 3 to the Professional Services Agreement with Haley &Aldrich Inc for Tiger Oil Project EV2999 SUBMITTED BY: Scott Schafer, Director of Public Works *Bill Preston, Acting City Engineer SUMMARY EXPLANATION: The City of Yakima (City) has been working with the Department of Ecology to clean up the former Tiger Oil site located at 2312 W Nob Hill Blvd. Task 3 will include a Barrier Soil Vapor Extraction System Design, construction, startup, and Operation Maintenance & Monitoring. The City recommends entering into Supplemental Agreement 3 with Haley &Aldrich Inc to continue the remediation of the site. It is estimated at $214,500 and is funded with a Department of Ecology grant requiring a 10°/o match. Supplemental Agreement 3 has been attached for City Council review in an amount not to exceed $214,500. R-2024- A RESOLUTION authorizing Supplemental Agreement 3 to the Professional Services Agreement with Haley &Aldrich Inc to perform the design and remediation for the former Tiger Oil site at 2312 W Nob Hill Boulevard. WHEREAS, the City of Yakima previously entered into a contract with Haley &Aldrich Inc (C-2022-225) to provide remediation work on the environmental cleanup and redevelopment of the former Tiger Oil site at 2312 W Nob Hill Boulevard; and WHEREAS, the City of Yakima previously approved Supplemental Agreement 1 (R- 2023-141) and 2 (R-2024-032) to the Professional Services Agreement with Haley&Aldrich Inc which included a pilot study work plan, groundwater monitoring event, and continued cleanup efforts utilizing the Nutrient Enhanced Biological Stimulation (NEBS) Work Plan for the former Tiger Oil site at 2312 W Nob Hill Boulevard; and WHEREAS, Supplement 3 provides for a Barrier SVE System Design, construction, startup, and OM&M, by updating the Task 3 Work Order; and WHEREAS, the Department of Ecology has reviewed and approved Task 3 for methods and means; and WHEREAS, the City of Yakima has previously received grant funding from the Department of Ecology (DOE) to aid in the cleanup of this site requiring a 10% match of local funds; and WHEREAS, the Scope of Work included in this Supplemental Agreement with Haley &Aldrich Inc meets the needs and requirements of the City of Yakima for this project; and WHEREAS, the City Council of the City of Yakima finds that it is in the best interests of the City and its residents to enter into Contract Supplement 3 of the Professional Services Agreement with Haley &Aldrich Inc for tasks associated with remediation of the environmental cleanup of the former Tiger Oil site at 2312 W Nob Hill Boulevard; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute Supplemental Agreement 3 with Haley&Aldrich Inc, attached hereto and incorporated herein by this reference, not to exceed Two Hundred and Fourteen Thousand and Five Hundred Dollars ($214,500) to provide the Professional Services as described in the Supplemental Agreement 3. Seattle, Washington for City of Yakima Yakima, Washington File No.0204793-001 5 April 2024 44 EXHIBIT A TASK 3 WORK ORDER PREPARATION OF SCOPE OF SERVICES AND BUDGET ESTIMATE FOR A BARRIER SVE SYSTEM DESIGN, CONSTRUCTION, STARTUP, AND OM&M FORMER TIGER OIL WEST NOB HILL BOULEVARD SITE YAKIMA, WASHINGTON Task 3—BARRIER SVE SYSTEM DESIGN, CONSTRUCTION, STARTUP,AND OM&M Purpose: A full-scale sub-slab depressurization system (SSDS) in the form of a barrier soil vapor extraction (SVE) system for the former Tiger Oil West Nob Hill Boulevard Site (Washington State Department of Ecology [Ecology] Facility Site No. 469, Cleanup Site No.4919), located at 2312 West Nob Hill Boulevard, in Yakima, Washington (Figure 1), is planned to help mitigate potential petroleum hydrocarbons and chlorinated volatile organic compounds (CVOCs)vapor intrusion from the impacted shallow groundwater and sub-slab soil into the indoor air of the adjacent three businesses to the Site and to help remediate the source through vapor-phase mass removal. The proposed barrier SVE system will consist of a blower that draws vapors from the soil beneath the buildings through vapor extraction wells/points and discharges the treated vapors to the atmosphere through a discharge vent stack.The system is designed to extract vapors that migrate from the source area to the adjacent buildings and vent them to the atmosphere, preventing potential petroleum hydrocarbon and CVOC vapors from entering the buildings where they could pose a threat to human health. This task(Task 3) includes preparation of scope of services and budget estimate for the proposed barrier SVE system design, construction, startup, and operation, maintenance, and monitoring (OM&M). An overview of the scope of work for Task 3 is provided below. TASK 3A: PROJECT LOGISTICS, COMMUNICATIONS,AND PROJECT PLANNING Task 3A will consist of coordinating Task 3, communicating internally and externally throughout Task 3 implementation, and project planning. TASK 36: PREPARE TASK 3 WORK ORDER Task 3B consists of preparation of a barrier SVE implementation work order(this document)for submission to Ecology and the City of Yakima (City)for authorization. ASK 3C: FINALIZE ENGINEERING DESIGN FOR BARRIER SVE SYSTEM Task 3C will consist of finalizing the engineering design for the barrier SVE system. Design documents will be developed, including engineering plans and specifications for contractor procurement.The system design will include the following major components: Final system well network and conveyance piping layout; 1 45 Vapor extraction point (VEP) and vapor/vacuum monitoring point(VMP) construction details and specifications; System conveyance piping and trenching construction details and specifications; System process and instrumentation diagram and equipment specifications; System process equipment and instrumentation parts list; System electrical requirements and specifications; System mechanical connections, specifications, and construction details; and System process equipment control design, including control panel specifications, remote telemetry specifications, alarm conditions, and programmable logic controller inputs/outputs schedule. TASK 3D:SCOPING DRILLING/WELL INSTALLATION Task 3D will consist of scoping for the following activities for drilling/installation of VEPs and VMPs: Discuss and coordinate with the potential drilling contractor(s) on the drilling/well installation scope for the barrier SVE system; and Coordinate the drilling work including the following tasks: Drill/install 10 additional VEPs and eight additional VMPs (Figures 2 and 3). A dual use direct push and hollow-stem auger drilling unit (or approved equivalent)will be used for soil core logging and drilling purposes. Professionally survey the locations of the VEPs and VMPs. Dispose of all investigation-derived-waste (soil cuttings, equipment wash, and rinse water) contained in Washington State Department of Transportation approved 55-gallon steel drums. TASK 3E:SCOPING SVE PROCESS EQUIPMENT FABRICATION AND INSTALLATION Task 3E will consist of scoping for the following activities for fabrication and installation of the barrier SVE process equipment in accordance with the general process equipment schematic presented in Figure 4: Discussions and coordination with the potential equipment supplier and fabricator(s) on the process equipment fabrication scope for the barrier SVE system; Shop fabrication of the new or used (in good condition) SVE process equipment; Full shop assembly and integration of a fully assembled SVE process equipment in a container/shed or a temporary equipment trailer; Dry testing and shop inspection of the process equipment prior to shipping; On-Site delivery of the process equipment; and On-Site installation of the process equipment. 2 46 TASK 3F:SCOPING TRENCHING, CONVEYANCE PIPING CONSTRUCTION,AND MECHANICAL AND ELECTRICAL CONNECTIONS Task 3F will consist of scoping for the following activities for trenching, conveyance piping construction, and performing mechanical and electrical connections for the barrier SVE system: Discuss and coordinate with the potential mechanical and general contractor(s) on the mechanical and general construction work scope for the barrier SVE system; Discuss and coordinate with the potential electrical contractor(s) and Pacific Power on the electrical needs for the barrier SVE system; Review the requirements for the mechanical and electrical connections for the SVE equipment installation (Figures 3 and 4); Coordinate the mechanical and general construction work including the following tasks: If needed, install a small concrete pad for placement of the barrier SVE process equipment container. Install and connect a 20-foot-long, 6-inch-diameter PVC Schedule 40 vertical air discharge stack. Construction of VEP wellhead assemblies (with controls i.e., gate valves, sample ports, vacuum indicators) and steel traffic rated above grade flush-mount wellhead vaults. Trenching and construction of the SVE below-grade conveyance piping. Construction of the SVE aboveground manifold. Connection of the SVE below-grade conveyance piping to the aboveground manifold. Connection of the aboveground manifold to the equipment container inlet piping. Installation of a chain-linked fence around the equipment container and associated access gates. Coordinate the electrical work including the following tasks: Obtain on-Site power drop from Pacific Power. Procure a Washington State Department of Labor and Industries (L&I) electrical permit (if applicable) and an electrical permit from the City's Buildings Department for electrical services. Install the electrical transformer to match the process equipment electrical needs and final electrical connections. — Facilitate and attend the final electrical inspection from the City's electrical inspector. TASK 3G:SCOPING BARRIER SVE SYSTEM STARTUP AND OM&M Task 3G will consist of scoping for the following activities for system startup and OM&M initiation: Prepare an OM&M Plan for the barrier SVE system including startup procedures- Document the system startup and operational procedures, monitoring program, and routine and non-routine maintenance and repair protocols. Submit the OM&M Plan to the City and Ecology for approval; Perform an equipment shakedown and pre-startup inspection to verify mechanical and electrical functionality of all unit processes, system controls, and fail-safe mechanisms and to ensure that all individual automation and safety controls are functional; 3 47 Perform the system startup; and • Initiate the system OM&M. TASK 3H:SCOPING PERMITTING AND SITE PREPARATION ACTIVITIES Task 3H will consist of scoping for the following permitting and site preparation activities: Prepare a Health and Safety Plan (HASP) in accordance with applicable health and safety regulations.The HASP will be prepared for Haley&Aldrich personnel.The selected contractor will develop a HASP for their own personnel; Prepare and obtain the necessary permits from the Yakima Regional Clean Air Agency, Ecology, and the City for the installation and operation of active processing equipment and granular activated carbon units for the treatment of extracted soils vapors; Prepare requests for access to the Site throughout the barrier SVE system construction and operation from the Property owner, Heyden Properties, LLC(Heyden), and the City; Prepare and obtain an encroachment permit, if applicable,from the City for installation of limited below-grade SVE conveyance piping and the SVE process equipment container at the southeastern corner of the parcel (the Property)formerly occupied by the Tiger Oil facility.The need to obtain an encroachment permit from the City will be determined as part of this task; Prepare and obtain a building permit and an electrical permit from the City and an electrical permit from the Washington State Department of L&1 (if applicable) prior to initiating installation of the SVE process equipment and the electrical drop; Conduct the underground utility service alert (i.e., Washington Utility Notification Center Call at 811) prior to the start of drilling activities for each of the planned VEP and VMP installation location and trench excavation activities at the Property. Prior to well installation and SVE system construction activities,the Utility Notification Center will be contracted to identify and mark any public underground utilities. Additionally,the selected contractor will coordinate with a private utility locating service to located underground utilities in the work area; and Coordinate all field activities with Heyden,the City, and Ecology Site Manager and as applicable, with the three adjoining businesses (Xochimilco Mexican Restaurant [Xochimilco], Barber HQ, and 1Up Games)to the Site, and the subcontractors. We anticipate that obtaining the air emissions permit (i.e., New Source Review Application and Permit) for the full-scale barrier SVE system implementation from the Yakima Regional Clean Air Agency could be a major milestone for the progress of the project and might take longer than any other permits/approvals.Therefore, we suggest prioritizing this task and associated efforts in order to obtain the applicable air emissions permit in an expedited manner. TASK 31:SYSTEM CONSTRUCTION BIDS/SELECTION AND CONTRACTORS INITIAL COORDINATION Task 31 will consist of performing the following activities for system construction bid preparation, contractor selection, and initial contractor coordination: Prepare bid requirements (i.e., scope of work documents)for the potential subcontractors for the following scope of services, roles, and responsibilities related to the construction of the barrier SVE system: 4 48 Drilling contractor; Equipment supplier or fabricator; Mechanical and general construction contractors; and Electrical contractor. Coordinate and review submitted contractor's bids; Select and award the project scope(s)to the respective subcontractors, pending authorization from the City and Ecology; and Coordinate with and manage the select subcontractors. TASK 3J: FRLFARE A[)RAFT BARRIER SVE WORK PLAN AND BUDGET ESTIMATE A planning level initial engineering cost estimate for the proposed barrier SVE implementation was provided to the City and Ecology in a Draft Technical Memorandum, dated 28 June 2023 (Attachment 1). The planning level cost estimate included initial (preliminary) engineering cost estimates for design, engineering, construction, and OM&M of the proposed barrier SVE system for one year. However,that initial cost estimate was only based on the conceptual design of the barrier SVE system and did not factor in the actual quotes from the subcontractors based on the full engineering design of the system. Task 3J will consist of preparing a draft barrier SVE system implementation work plan and a budget estimate for system construction, startup, and OM&M based on the actual quotes from the select subcontractors (i.e., drilling, equipment supplier/fabricator, mechanical/general construction, and electrical contractors).The budget estimate will be based on the full engineering design of the barrier SVE system and will also factor in any applicable and potential inflation in the materials and labor costs associated with the construction and operation of the system. TASK 3K: FINALIZE THE BARRIER SVE WORK PLAN AND BUDGET ESTIMATE Task 3K will consist of finalizing the barrier SVE system implementation work plan and budget estimate based on the comments and feedback from the City and Ecology.This task assumes that up to two revisions of the work plan and budget estimate will be made based on the comments and feedback from the City and Ecology.This task also assumes that up to two virtual meetings with the City and Ecology will be held in an attempt to present and discuss the barrier SVE system implementation scope of work and associated budget estimate with the City and Ecology. ASK 3L:SYSTEM CONSTRUCTION INITIATION KICK-OFF MEFTIN Task 3L will consist of coordinating and attending a system construction initiation kick-off meeting in person partially at the City's office in Yakima and partially at the Site. Assumptions The following assumptions were made in preparation of the above scope of work: The system construction kick-off meeting,to be held in person, will take place partially at both the City's office in Yakima and at the Site. 5 49 Site access will be granted for drilling and installation of the VEPs and VMPs, system infrastructure (conveyance piping and manifold) construction, and process equipment installation (Figure 3). The necessary permits from the Yakima Regional Clean Air Agency, Ecology, and the City will be issued within approximately four to eight weeks after submittal of the applications. The previously installed electrical power service rated for 208 volt/three phase/100 amps service connection will be adequate for the full-scale barrier SVE system process equipment. Usage of the previously installed electrical power pole at the Site will be approved. Initial OM&M activities will involve weekly Site visits to ensure proper operations and will progress to bi-weekly and monthly Site visits thereafter, as applicable. Project status conference calls will be held on an as-needed basis. Proposed Budget Services for Tasks 3 will be conducted for a total estimated fee of$214,500 to be provided on a time and materials (T&M) basis.The table below presents the specific tasks breakdown, level of effort, and associated costs. Terms and Conditions Services will be provided on a T&M basis in accordance with our"Standard Fee Schedule," dated January 2022, designated 2022 PNW(Attachment 2),which is integral to this proposal. This proposal is valid for a period of 60 days from the date of this work order. If acceptance and authorized to proceed are not received within that period, we reserve the right to renegotiate the estimated costs, schedule for completion, and scope of services. A barrier SVE approach, design, and implementation plan were presented to the City of Yakima and the Washington State Department of Ecology(Ecology) in the Draft Sub-slab Depressurization System (SSDS)Pilot Test Report and Barrier Soil Vapor Extraction Implementation Work Plan, dated 23 June 2023 (hereinafter referred to as the Pilot Test Report).The Pilot Test Report summarized the results of the SSDS pilot testing activities performed at the Site in February 2023 and the subsequent analysis (i.e., radius of influence [ROI] estimation using Linear Regression and MDFITTM pneumatic modeling methods) and provided design parameters for the full-scale barrier SVE system for the former Tiger Oil Site. Introduction and Background The results of the February 2023 SSDS pilot test indicated that vacuum propagation in the subsurface at the Site as a result of active soil vapor extraction is negligible to very low;therefore, conventional SSDS is not an effective vapor mitigation approach for the Site. As a result, a barrier SVE system was proposed to mitigate vapors at the Site and remediate the shallow vadose zone soils.The proposed barrier SVE approach will mitigate potential vapor intrusion from gasoline-range total petroleum hydrocarbons (TPHs) and chlorinated solvent-impacted shallow groundwater and sub-slab soil into the indoor air of the adjacent buildings of the three businesses (Xochimilco Mexican Restaurant to the east, and Barber HQ and 1 Up Game to the south; Figure 1) and help remediate the portions of the source through vapor- v.naleyaldrich. r; 59 City of Yakima 28 June 2023 Page 2 phase mass removal.The barrier SVE system has the added benefit of mass removal, which will help to remediate shallow vadose zone soils at the Site. The proposed barrier SVE system will consist of a blower that draws vapors from the soils beneath the adjacent buildings through vapor extraction wells/points,treats the vapors with two vapor-phase granular activated carbon (VGAC)vessels in series, and discharges the treated vapors to the atmosphere through a discharge stack.The system is designed to extract vapors that migrate from the source area to the adjacent buildings and vent them to the atmosphere, preventing vapors from entering the buildings where they could pose a threat to human health. Key design elements and parameters of the proposed barrier SVE system, as well as the plan for construction and implementation, are outlined in the Pilot Test Report.The proposed barrier SVE design consists of 12 vertical SVE wells (vapor extraction points [VEPs]) and 14 vapor monitoring point (VMP) locations (Figure 2).These proposed locations were selected based on the known on-Site and off-property extent of the constituent of concern (COC) impacts in soil, soil gas, and groundwater,the ease of access of a drill rig at the off-property locations, and the logistics and constructability of the SVE conveyance piping.Typical VEP and VMP construction details are provided in Figure 3. Figure 4 presents a schematic of the SVE process equipment. The fee will be computed as follows. 1. Labor related fees will be computed based on personnel billing rates in effect at the time the services are performed.
