WHEREAS, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Yakima Municipal Code Section 1.80.040: Purchases without calling for bids—Exceptions, shall be amended to read as follows: 1.80.040 Purchases without calling for bids—Exceptions. Supplies, material, equipment or services, except for public work or improvement, may be purchased without calling for bids in any amount less than one hundred thousand dollars ($100,000.00) for any individual purchase. Any purchase of supplies, material, equipment or services, when the cost thereof is one hundred thousand dollars ($100,000.00) or more, shall be made pursuant to a call for bids in the same method and under the same conditions as required by Article VI, Subsection 6 of the Yakima City Charter for a public work improvement, unless an emergency is declared by resolution of the city council so as to authorize such a purchase without calling for bids, pursuant to Article VI, Subsection 6 of the Yakima City Charter. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. For Meeting of: August 5, 2024 ITEM TITLE: Ordinance amending Yakima Municipal Code Section 1.80.040: Purchases without calling for bids - Exceptions SUBMITTED BY: Rosylen Oglesby, Interim Finance Director SUMMARY EXPLANATION: Although state statute does not outline a threshold for requiring public bidding on supplies, material, equipment or services that are not used in a public works project or improvement, the Yakima Municipal Code requires, currently, that any purchase of over$50,000.00 requires public bidding procedures. The amount was raised to $50,000.00 in 2016. Because of the increase in costs associated with goods and services, the proposal is to raise this amount to $100,000.00. This means that the City will not be required to put out to bid the purchase of supplies, material, equipment or services if the cost is less than $100,000.00, for purchases not involving public works projects. The City Council has previously delegated authority to the City Manager to sign contracts in amounts up to $100,000.00 (if budgeted) without City Council action. As such, both the public bidding requirements and the City Council approval threshold would be the same if the ordinance were adopted.
