R-2024-141 A RESOLUTION authorizing an agreement with HLA Engineering and Land Surveying, Inc. to provide engineering services for the Pedestrian Bridge project over Wide Hollow Creek at West Valley Community Park. WHEREAS, the City has the need to replace the existing bridge and design a new pedestrian Bridge over Wide Hollow Creek at West Valley Community Park located at 1330 S. 80th Avenue, Yakima, Washington. The new pedestrian bridge may be referred to herein as "Pedestrian Bridge", and; WHEREAS, the current bridge is narrow and does not provide ADA compliant access to the park, and; WHEREAS, the Pedestrian Bridge project will provide access to West Valley Community Park and West Valley Middle School and Junior High School, and; WHEREAS, the Yakima City Council and Yakima Parks and Recreation Commission have previously approved a comprehensive plan that includes the replacement of the pedestrian bridge; and WHEREAS, the City of Yakima used the procedure established by the State of Washington and FHWA to select and recommend HLA Engineering and Land Surveying, Inc. to perform the Scope of Work; and WHEREAS, HLA Engineering and Land Surveying, Inc. has provided a Scope of Work included in this Professional Services Agreement that meets the needs and requirements of the City of Yakima for this project; and, WHEREAS, the City desires to contract with HLA Engineering and Land Surveying, Inc. to complete the design of the project, and; WHEREAS, the design of the Pedestrian Bridge project will utilize Washington Department of Transportation grant funds for the design work, and; WHEREAS, the City Council of the City of Yakima finds that entering into the Professional Services Agreement is in the best interests of the City and its residents; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute a Professional Services Agreement with HLA Engineering and Land Surveying, Inc., attached hereto and incorporated herein by this reference, not to exceed One Hundred Ninety Five Thousand Eight Hundred Dollars ($195,800) to provide the Professional Services as described in the Agreement. After submission of a Statement of Qualifications on June 9, 2023, HLA Engineering and Land Surveying, Inc. (HLA), was notified on July 28, 2023, of its selection to perform engineering design services for this project. HLA contracted with the CITY to provide project management and administration, supplemental land surveying, environmental documentation, and preliminary design engineering (30%). This Supplemental Agreement No. 1 is to complete the project SCOPE OF SERVICES: The Scope of Services included in the Agreement for Professional Services - Exhibit A shall be amended to include the following: 5.0 Preliminary Design Engineering (60%) 5.1 Based on approved 30% preliminary engineering plans, perform and present design to CITY at 60% completion for review and approval 6.0 Preliminary Design Engineering (90%) 6.1 Based on approved 60% preliminary engineering plans, perform and present design to CITY at 90% completion for review and approval. 7.0 Final Design Engineering (100%) 7.1 Based on approved 90% preliminary engineering plans, perform and present design to CITY at 100% completion for final coordination. 7.2 Perform quality control and assurance review of all final documents 7 3 Prepare Engineer's final cost estimate 7.4 Provide final plans and specifications to the CITY in electronic format suitable for printing and use at time of bid advertisement. It is anticipated HLA will prepare one (1) complete set of plans and specifications for one bid call, additional bid packages will be considered additional services. 9.0 Bidding Assistance 9.1 Prepare advertisement for bids. Coordinate with CITY on number and location publications. (All advertising fees to be paid by the CITY.) 9.2 Post documents to HLA website, notify potential bidders and utility companies of PROJECT posting, and maintain planholder list. 9.3 Answer and supply information as requested by prospective bidders. 9.4 Prepare and issue addenda to contract documents, if necessary 9.5 Attend the bid opening and participate in the evaluation process. \\fs02\General\Contracts&Task Orders\Yakima\2024\Wide Hollow Creek Ped Bridge Supplement\2024-07-01 23162E Supplemental Agreement No 1 docx Page 2 of 8 9.6 Prepare summary of bids received and review bidder's qualifications and responsiveness. 9.7 Provide recommendation of an award to the CITY for construction contract. 9.8 Prepare administrative documents to the appropriate agencies which have jurisdiction over funding, design, and construction of the PROJECT. 10.0 Construction Engineering 10.1 Following Council award authorization, prepare notice of award to the Contractor, assemble construction contract documents, and coordinate contract execution with the CITY and Contractor 10.2 Review Contractor's submission of certificate of insurance and contract bond. 10.3 Coordinate and facilitate preconstruction meeting with the CITY, Contractor, private utilities, and affected agencies, including preconstruction agenda and meeting record. 10 4 Prepare and transmit notice to proceed to Contractor. 10 5 Furnish a field survey crew to provide geometric control, including construction staking. 10.6 Furnish a qualified resident engineer(inspector) to observe construction for substantial compliance with plans and specifications and CITY Construction Standards. 10.7 Review Contractor's submission of samples and shop drawings. 10.8 Maintain record of materials (ROM) for duration of PROJECT. 10.9 Respond to Contractor requests for information (RFI) 10.10 Interpret plans and specifications when necessary 10.11 Prepare daily progress reports 10.12 Prepare weekly statements of working days 10.13 Create and maintain accurate construction documentation for the life of the PROJECT. 10 14 Ensure the CITY has all necessary files for potential audits. 10.15 Consult and advise the CITY during construction and make final review and report of the completed work with CITY representatives. 10.16 Coordinate testing scheduling with the Contractor's materials testing firm and review acceptance sampling and testing for construction materials. 10.17 Coordinate and attend construction meetings anticipated once per week during the duration of improvements 10.18 Perform measurement and computation of pay items 10 19 Prepare and provide monthly progress estimates to the CITY and recommend progress payments for the Contractor. 10 20 Prepare proposed contract change orders and/or force account computations as required 10 21 Conduct final walkthrough inspection with the Contractor and CITY. Prepare and transmit punchlist to Contractor. \\fs02\General\Contracts&Task Orders\Yakima\2024\Wide Hollow Creek Ped Bridge Supplement\2024-07-01 23162E Supplemental Agreement No 1 docx Page 3 of 8 10.22 Prepare and furnish record drawings and field notes of completed work in accordance with PROJECT field records provided by the resident engineer and those submitted by the Contractor. 10 23 Prepare administrative documents to the appropriate agencies which have jurisdiction over funding, design, and construction of this PROJECT 10.24 Monitor the Contractor's compliance with federal and state labor standards 10.25 Assist the CITY with funding reimbursement information and supporting documentation, as requested 10.26 Monitor the Contractor's compliance with Disadvantaged Business Enterprise (DBE) goals and reporting requirements. 10.27 Prepare and submit recommendation of PROJECT acceptance 10.28 Prepare and submit Notice of Completion of Public Works Contract(NOC). Monitor lien releases from state agencies. 10.29 Notify CITY when retainage may be released 10.30 Ensure the PROJECT is completed as designed and contract specifications are adhered to during construction. 11.0 Additional Services Provide professional engineering and land surveying services for additional work requested by the CITY not included above. TIME OF PERFORMANCE: The Time of Performance included in the Agreement for Professional Services— Exhibit A shall be amended to include the following: 5.0 Preliminary Design Engineering (60%) HLA will provide Preliminary Design Engineering, including 60% draft plans, 60% draft specifications, and 60% cost estimate for CITY review within sixty (40) working days from receipt of signed Supplemental Agreement No 1 6.0 Preliminary Design Engineering (90%) HLA will provide Preliminary Design Engineering, including 90% draft plans, specifications, and estimate within forty (40) working days of receiving CITY comments on 60% plans, specifications, and estimate. 7.0 Final Design Engineering (100%) HLA will provide Preliminary Design Engineering, including final plans, specifications, and estimate within thirty (30) working days of receiving CITY comments on 90% plans, specifications, and estimate. 9.0 Bidding Assistance Bidding Assistance shall be completed during one bidding period within forty-five (45) working days following the CITY's authorization to advertise for bids. \\fs02\General\Contracts&Task Orders\Yakima\2024\Wide Hollow Creek Ped Bridge Supplement\2024-07-01 23162E Supplemental Agreement No 1 docx Page 4 of 8 10.0 Construction Engineering 10.1 Construction engineering services shall begin upon construction contract award by the CITY to the lowest responsible bidder and extend through the completion of construction, and completion of as-constructed drawings. 10.2 A maximum of thirty (30)working days has been assumed for the construction of the improvements, utilizing a standard 40-hour work week. 10.3 Should the Contractor be granted time extensions for construction completion due to recognized delays, requested additional work, and/or change orders, services during construction beyond the thirty (30)working days shall be considered additional services. 11.0 Additional Services Time for completion of work directed by the CITY under additional services shall be negotiated and mutually agreed upon at the time service is requested by the CITY. FEE FOR SERVICE: The Fee for Services included in the Agreement for Professional Services— Exhibit A shall be amended to include the following: For the services furnished by HLA as described in this Agreement, the CITY agrees to pay HLA an amount not to exceed $195,800.00 for all added services as estimated by phase tasks below. For Meeting of: August 5, 2024 ITEM TITLE: Resolution authorizing an agreement with HLA Engineers and Surveyors for Engineering Services for the Pedestrian Bridge over Wide Hollow Creek at West Valley Community Park SUBMITTED BY: Scott Schafer, Director of Public Works Bill Preston, City Engineer *Ken Wilkinson, Parks & Recreation Manager SUMMARY EXPLANATION: The foot bridge at West Valley Community Park is a simple wooden bridge of unknown origin, that is beyond its useful life and requires removal and replacement. A grant request was completed to replace the bridge with an ADA bridge and asphalt approaches and connection to sidewalks and the walkways within West Valley Community Park. With the efforts of Sen. Curtis King, the grant request of$900,000 was approved through the Washington State Department of Transportation (WSDOT). In November of 2023, utilizing the City of Yakima's RFQ process, HLA was selected to begin 30% drawings for the pedestrian bridge and the approaches utilizing REET 1 funds. Enclosed for City Council review is the Supplemental Agreement with HLA which enables them to complete the drawings and assist with permitting and the necessary bidding process. The Supplemental Agreement is in an amount not to exceed $195,800 and is funded by the WSDOT grant.
