Public Meet and Greet with City Manager Candidates Mayor Byers introduced the City Manager finalists Richard Marsh, Jr., Mike Gonzalez, and Vicki Baker and invited the community members present to interact with them and provide feedback. Richard Marsh Jr. highlighted his expertise in economic development and financial management. Mike Gonzalez shared his experience in building relationships with developers and rebranding the perception of the City of Pasco. Vicki Baker noted the importance of working together to provide stability and solve problems in the community. No other business of the Council was transacted. 4. Adjournment MOTION: Brown moved and Herrera seconded to adjourn to the next City Council special meeting on July 2, 2024, at 12:00 p.m. in the Council Chambers at City Hall. The motion carried by unanimous vote. The motion failed by a 5-2 roll call vote; Berg, Brown, Byers, Glenn and Roy voting no. Administration of Oath of Office to Interim Police Chief Shawn Boyle Page 1 of 5 13 Interim City Manager Dave Zabel! introduced Shawn Boyle as the Interim Police Chief for the City of Yakima. City Clerk Ibarra administered the ceremonial oath of office to Interim Police Chief Shawn Boyle. Interim Chief Boyle thanked Council for the opportunity, thanked the Yakima Police Department staff for their commitment, and addressed the community to ensure the department's priority service to their needs. 6. Council Reports None. 7. Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Item G was removed from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. R-2024-117, A RESOLUTION fixing time for a public hearing before the Hearing Examiner on July 25, 2024, on a petition (Petition No. 24-09) to vacate a portion of N 68th Ave. right-of-way, between Englewood Ave. and Scenic Dr. D. Resolution authorizing an agreement with Washington State Department of Commerce for grant funding for the construction of the Aquatic Center at Martin Luther King Jr. Park RESOLUTION NO. R-2024-118, A RESOLUTION authorizing execution of an agreement with Washington State Department of Commerce for a grant of $1,125,200 for the construction of a public swimming pool at MLK Jr. Park. Douglas Trail. F. Resolution authorizing acceptance of the Washington State Department of Archaeology and Historic Preservation grant award for The Capitol Theatre elevator rehabilitation RESOLUTION NO. R-2024-120, A RESOLUTION ratifying and approving the City Manager's execution of a grant agreement with the Washington State Department of Archaeology and Historic Preservation and accepting the grant of$30,414. Items Removed from the Consent Agenda G. Resolution authorizing acceptance of a Department of Transportation State Funding grant award for Wide Hollow Creek Pedestrian Bridge Improvement Project This item was removed from the Consent Agenda. Parks and Recreation Manager Ken Wilkinson briefed Council on the proposed resolution. The City Clerk read the resolution by title only. MOTION: Brown moved and Berg seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. .4111 RESOLUTION NO. R-2024-121, A RESOLUTION authorizing acceptance of a state grant from the Washington State Department of Transportation for Wide Hollow Creek Pedestrian Bridge Improvement Project. 8. Public Hearings A. Public hearing to consider: A) Resolution adopting the Six-Year Transportation Improvement Program for the period of 2025 through 2030, and to amend the Transportation Systems Plan 2040; and B) Resolution amending the Yakima Urban Area Comprehensive Plan Capital Facilities Element City Engineer Bill Preston briefed Council on the public hearing regarding the Six-Year Transportation Improvement Program (TIP). Mayor Byers opened the public hearing. Joey Anderson, spoke regarding the Hearing Examiner's review of pending business licenses. City Attorney Sara Watkins provided additional information to Council and Ms. Anderson regarding her concerns. Phil Hoge, member of Bikes and Walks, expressed approval and appreciation of the Safe Routes to School Program and related projects on the TIP list. Mr. Hoge commented on three projects: 1) 18th St. underpass — recommended it be designed Page 3 of 5 15 to include bicycle lanes; 2) 6th Ave. - recommend pathway along Willow and Hathaway to connect to William O. Douglas Trail; 3) E 8th St. - recommended a separated path along H Street which could connect to Greenway and Powerhouse Canal Pathway. Mr. Hoge inquired about a grant award for green safety paint. Bill Preston addressed the question about the grant award; it has not yet been awarded and will require a TIP amendment in the future. With no one else coming forward or calling in to speak, Mayor Byers closed the public hearing. The City Clerk read both resolutions by title only. MOTION: Brown moved and Deccio seconded to adopt both resolutions. The motion carried by 7-0 roll call vote. RESOLUTION NO. R-2024-122, A RESOLUTION adopting the Six-Year Transportation Improvement Program (TIP) for the period of 2025 through 2030 for transportation improvements to arterial streets in the City of Yakima and amending the Transportation Systems Plan 2040. RESOLUTION NO. R-2024-123, A RESOLUTION to amend the Yakima Urban Area Comprehensive Plan Capital Facilities Element to incorporate the Six-year Transportation Improvement Program (TIP) for the period of 2025 through 2030. 9. Department Items A. Resolution adding July 27, 2024 as a day when cruising shall be permitted under YMC 9.25.020 Planning Manager Trevor Martin briefed the Council on the proposed resolution to add July 27th as a day permitted for cruising due to another special event taking place on Yakima Avenue on July 13th. The City Clerk read the resolution by title only. MOTION: Deccio moved and Brown seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R 2024-124, A RESOLUTION adding July 27, 2024, as a day when cruising shall be permitted under YMC 9.25.020. B. Ordinance amending the 2024 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2024 for various purposes (First Reading) Interim Director of Finance and Budget Rosylen Oglesby briefed Council on the first reading of proposed amendments to the 2024 budget. City Manager Update Interim City Manager Dave Zabel! briefed Council on the cost associated with providing Transit shuttle service to the 4th of July event at the Central State Fairgrounds. Public Works Director Scott Schafer provided additional information regarding Transit service to the fairgrounds. MOTION: Glenn moved and Berg seconded to support the decision to cancel bus transportation for the 4th of July. The motion carried by a 6-1 vote; Deccio voting no. 11. Other Business • None. 12. Mayor Byers opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The Deputy City Clerk read the resolution by title only. MOTION: Deccio moved and Brown seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2024-125, A RESOLUTION declaring the property rights obtained by the City in the Easement Deed (Water Line), running through parcel number 181313-31516 recorded under Auditor's File Number 8059100 and re- recorded under Auditor's File Number 8062906, to be surplus to the uses and needs of Page 1 of 2 18 the City of Yakima, and authorizing disposition of such property rights to the Yakima Housing Authority. B. Presentation of Draft City of Yakima Strategic Priorities for 2024-2025 Interim City Manager Dave Zabell introduced the topic and opened the discussion. Zach Ratkai, Sageland Strategic LLC, briefly provided an overview of the draft strategic priorities identified through the recent Council retreat session. Following Council discussion, there were no changes to the document. The final City of Yakima Strategic Priorities document will be presented at the next City Council business meeting for Council adoption. C. Discussion regarding recent United States Supreme Court decision in City of Grants Pass, Oregon v. Johnson, et al. City Attorney Sara Watkins briefed Council on the Supreme Court's recent decision regarding the Grants Pass, Oregon ordinances related to unlawful encampments. After extensive discussion, it was agreed that current City ordinances will need to be reviewed and some changes will be brought to Council for consideration at a future meeting. 5.
