Walnut St. RESOLUTION NO. R-2024-110 A RESOLUTION fixing time for a public hearing before the Hearing Examiner on July 25, 2024, on a petition (Petition No. 24-04) to vacate a portion S. 10th Ave. between W. Chestnut Ave. and W. Walnut St. WHEREAS, pursuant to RCW 35.79.010, a petition (Petition No. 24-04, RWV#002-24) has been filed with the City Clerk, requesting the vacation of a street or alleyway (or portion thereof) within the City of Yakima, a true copy of which petition is attached and incorporated into this resolution (Exhibit "A"); and WHEREAS, such a petition has been signed by the owners of more than two-thirds (2/3) of the property abutting upon the street or alley (or portion thereof)which is requested to be vacated, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The above-referenced petition for vacation is hereby referred to the Hearing Examiner for public hearing pursuant to section 1.43.080 of the City of Yakima Municipal Code. The Hearing Examiner is directed to make written recommendation to the City Council regarding said petition. The Hearing Examiner's Public Hearing shall be held on July 25, 2024 at 9:00 a.m. in the City Council Chambers of City Hall, which date and time are not more than sixty (60) days nor less than twenty (20) days after the passage of this resolution. It is further resolved that the City Clerk, or administrative official, give notice of the Hearing Examiner Public Hearing in the form and manner prescribed by RCW 35.79.020 and Section 14.21.040(C) of the City of Yakima Municipal Code. For Meeting of: June 18, 2024 ITEM TITLE: Resolution setting July 25, 2024, as the date for an open record public hearing before the Hearing Examiner to vacate S. 10th Ave. between W. Chestnut Ave. and W. Walnut St. SUBMITTED BY: Bill Preston, Interim Community Development Director *Eric Crowell, Senior Planner SUMMARY EXPLANATION: On March 28, 2024, YWCA Yakima submitted a petition (Petition 24-04, RWV#002-24) on behalf of Hogback Healthcare Partners, LLC to vacate S. 10th Ave. between W. Chestnut Ave. and W. Walnut St. The former St. Elizabeth's building, which in 2023 was approved to be converted into an emergency domestic violence shelter, is partially located within the S. 10th Ave. right-of-way. This request aims to eliminate the entirety of the approximately 347-foot-long portion of right-of-way. The City Council is being asked to set the date for this public hearing before the Hearing Examiner for July 25, 2024. The Hearing Examiner's Recommendation will be presented to Council for final consideration—date to be scheduled for a future Council meeting upon receipt of the HE Recommendation.
